Thank you for talking wit me on the phone today. I represent
Ralph Zavarella, one of the defendants in the above law suit. For purposes of an
impending hearing on April 3D, 2015, I need some documents from your office.
They are: application or Planning Board approval and site plan of
the location of Twisty's at 1504 or 1510 Main Street, Agawam, showing the
building and parking areas on that property. I need the same document and plan
showing the same information for a second Twisty's located at 1744 Main Street
in Agawam.
I will also need a copy of the formal order of the Planning Board
approving the site plan, and any limitation on the parking areas of each property.
If approval is simply stamped on the plan or the application by the Board, that will
be sufficient.
Lastly, I need the minutes of the meeting or meetings of the
Planning Board at which these two sites were discussed or approved.
These documents must be certified as being true and exact copies
of the originals.
The purpose of this letter is to avoid a subpoena of these
documents to the hearing, which would require the presence of some one from

your office at Court on April 30th .• After talking to you, I believe a subpoena can
be avoided.
Of course, I am happy to pay the charges for furnishing these
documents, and will be glad to pick them up from your office. Please call me and

Agawam Town Code § 175-29B; only waste requiring treannent shall be treated by the device. Please
see the attached detail.
2. Please add a detail to the plan showing the accessible parking sign; please see the attached derail sheet
for guidance.
3. Relroreflective "No Parking" signs shaH be installed in the following areas and at a spacing appropriate
for the area that they are intended to restrict:
a. Along the northern wall of the "New Alteration" area.
b. Along the top of the existing retaining wall, facing the parking area.

A. The connection of the building sewer into the public sewer shall conform to the
requirements of the Commonwealth of Massachusetts Plumbing Code, 248 CMR: Board
of State Examinel"S of Plumbers and Gas FittersiBuilding andlor other applicable rules
and regulations of the Town, or the procedures set forth in appropriate specifications of
the American Society for Testing and Materials and the WPC Manual of Practice No.9,
All such connections shall be made gaslight and watertight.
B. Restaurants, banquet faciliries, commercial kitchen requ irements. Any facil ities at which
on-site food preporation, food processing, food service. or other related activities which
may result in fat~. oils, and grease being introduced into the waste stream will be
required to design, install. and maintain an exterior oillwater/grease interceptor/separator
appropriate for the intended use, No "'astes other than those requiring treatment or
separation shall be discharged into any interceptor or separator.
C. Vehicle stDrdgeJmaintenance facilities. Any commercial facilities which store vehicles,
wash "chicle~. and perfonn vehicle maintenance will be required to design, i!lStall, and
maintain an oil and water. sand and other substance separator. and to seal existing
interior floor drains which oudet to the public dr'ainage or sanitary sewer systems. This
may also apply to facilities Where motor oils, gasoline, antifreeze and similar haurdous
liquid wastes are potentially generated or may potentially spill. The system must comply
with the Massachuseus Plumbing Code. Sanitary service piping must be such that only'
wastes requiring treatment or separation shall be discharged into the interceptor or
separator.
D, Existing use. Existing sites with uses as described in Subsections Band C shall have two
years from the time of adoption of this chapter amendment to install required equipment
and make required changes to the site. Failure to meet this deadline will be considered a
violation of the sewer permit for the site and may result in a charge to the owner of any
property which falls under Sub~ections A. B, and C above to cOVer mnterials, Jabor,
equipment., and administrdtive costs incurred by the Town of Agawam as a result of
noncompliance. The owner shall be subject to other enforcement actions as described in
§ 175-54.

15,2010, and revised February 2,2010. On March 18,2010, the Planning Board voted to
return your plan and requested that a number of items were to be addressed before the
plan was resubmitted. A letter dated March 19,2010 was sent to you listing the items to
be addressed. A copy is attached.
I have reviewed the plan you recently submitted and find that most of the items requested
by the Board have not been addressed. I have advised Pam not to place you on a
Planning Board agenda until all items referenced in the March 19th letter have been
addressed.
Please also be advised that the dumpster enclosure must be labeled as to the height and
type of fencing.

Landscaping/Screening and Buffers: The following landscape note must be placed on
the plan: "All plantings must be maintained and that portion of the public way abutting

Sign Location: Unchanged.
Exterior Lighting: Exterior lighting is to be shown on the plan. All lighting must be
shielded and shall not spill over on to adjacent properties. Cut sheets and dimension of
the lighting must be provided.

Dumpster Location: The existing dumpster is not fenced or gated as approved by the
Planning Board on November 15. 2007.
Other Comments or Concerns: The refrigeration unit. located behind the building and

Massachusetts Highway Department (MassHighway) District Two personnel performed site reviews
along Route 159, in the vicinity of the Twisty's property at 1508 Main Street in the Town of
Agawam.
Site investigation revealed the following concerns under permit #2-2005-0549, issued to Cirillo
Realty:
.;. Areas along the driveways and within the SHLO, which is approximately twelve (12) feet
from the edge of road (curb line), were landscaped with rocks and boulders. The permit
states: "ROCK Landscaping, planting pots, barrels, other containers or appurtenances shall
not be allowed under this permit."
The District hereby directs the immediate removal of unauthorized rock landscaping, signs, and
parking spaces within the SHLO. The Permit also states: "No Parking is allowed within the limits of
the State Highway Layout." The submitted plans drawn by R. Levesque Associates, Inc, which are
referenced in the captioned permit, identified the property line and the location of all parking outside
the SHLO.
