Dear Councilors:
At its duly called meeting held on October 7, 2010, the Agawam Planning Board voted
3-2 t'o send a negative recommendation to the Town Council regarding the proposed zone change on
Garden Street by Thomas Russo, Jr. The three members are of the opinion that this area is not
appropriate for residential use and does not constitute good planning. Under the current Residence B
zoning, the parcel can be used for commercial and/or industrial purposes. The town haS very few
parcels zoned for this type of use. Due to the municipal services associated with residential
development, residential development represents a net deficit to the town, whereas commercial and
industrial development generate much needed municipal revenues. Finally, there was concern over
the incompatibility of residential development with the uses currently found in the area. Attached,
for your information, is a copy of the zone change report prepared by the Planning Department.

SUBJECT: Zone Change -Russo -Garden Street

On September 14, 2010, the Town received a zone change request from Thomas Russo for 6.6 acres
of land located on the south side of Garden Street. The property is bounded on the west by 206
Garden Street, to the east by 257 Garden Street and to the north by Vermette Autobody. The
applicant wishes to change the existing Business B zoning to Residence A-3.
The Planning Office has conducted a review of this proposal and submits this report for your
information.
Land Use and Zoning
As stated above, the property for which the zone change is being requested is currently zoned
Business B. The parcel is in a mixed zone area. The property to the west and north are zoned
Business B. However, the property to the east is Industrial B and to the south Industrial A. Please
see the attached zoning map.
Under the present Business B District the following uses are allowed: (Please refer to 180-48 of the
Zoning Ordinance which is attached for a full description.)
• Body shops
• Amusement parks, bowling alleys and roller skating rinks
• Wholesale sales and warehousing
• Converting, fabricating, manufacturing, altering, fmishing or assembling
• Trucking terminals by Special Permit
• Retail shopping centers
• •
Under the proposed Residence A-3 District the land can only be used for apartment houses or
garden-type apartments and accessory uses. (Please refer to 180-29 of the Zoning Ordinance which
is attached.)
The subject property is also in a mixed used area. In the immediate vicinity of the parcel are single
family dwellings, the Springfield Turnverein, an auto body shop and large industrial uses.
The applicant has indicated that he is interested in building approximately 41 condominium units.
Given the size of the parcel, he would be allowed to build 52 multi-family units.
Environmental Considerations
The property slopes from Garden Street to a large wetland at the rear of the property in a southerly
direction. The elevation at Garden Street is 199' sloping to 166' at the wetland edge. The wetland
boundary was approved by the Conservation Commission on June 28, 2010. Due to the size of the
parcel a drainage permit must be sought from the Department of Public Works. Controlling drainage
on these slopes will be important to prevent erosion and sedimentation.
According to the USDA Soil Conservation Service the non-wetland area of the site is broken down
into three (3) soil types. See the attached soils table. Approximately one-third of the site contains
Windsor loamy sand with a slope of 25% to 35%. This is the area just north of the wetland.
According to the soil survey, it represents severe constraints to development due to the soils.
Other Considerations
The site is served by both sewer and water, though, due to the difference in elevation from the front
to the rear of the property, a pump station may be required. A site distance analysis may also be
necessary. The applicant must also provide the distance from the proposed internal roadway to the
on ramp for Rt. 57.
Summary
Of the 6.6 acres for which the zone change is being sought, approximately one-half is buildable. The
surrounding area is very diverse ranging from single family homes to industrial to recreation. The
area is also diverse with regard to the zoning. The proposed use presents challenges due to the slope
of the site. A single building would be easier to accommodate. In terms of taxes, a light industrial
building would generate much needed revenue while necessitating few services. The proposed
condominium project would require more services. Once zoned Residence A-3, the property could
be developed as condominiums or apartments.

B. Side yards are not required for business buildings.
C. Rear yards shall have a minimum of 25 feet.
D. Space shall be provided for vehicle parking and for the loading and unloading of all
materials, equipment and merchandise on the premises and entirely off the traveled way,.
with such additional space as may be necessary to provide free and easy access to that
portion of the buildings so as not to interfere with traffic on the public way. Loading and
unloading platforms and doorways especially designed for loading and unloading goods
are prohibited on the front of any building.
E. A building devoted in whole or in part to residence or other purposes permitted in
§ 180-44A shall comply with the requirements prescribed for Residence B Districts.

(a) Retail shopping centers may include department stores, variety stores,
supermarkets, furniture slOres, household appliance stores, home
improvement stores, lawn equipment stores, gift shops, restaurants, including
drive-in and drive-throu gh restaurants, drugstores, barbershops, beauty shops,
office supply stores, food stores, optical stores, clothing stores, financial
institutions and banks (with or without drive-through windows), health clubs,
movie theaters. 'doctors' offIces, dentist offices and other professional offices
open to the public, cliildren's day-care and activity centers. Only one
principal building per lot is allowed.
(b) These uses will not include, as a principal or accessory use, motor vehicle
services, such as new or used motor vehicle sales, freestanding tire, brake
and muffler shops, automobile repair shops, and gasoline stations. No
accessory use 0-' building is permitted under thi s zoning.
(c) Unless by special permit of the Agawam Town Council, temporary· outside
uses upon the parcel are prohibited, including but not limited to, corcuses,
festivals, tent sales, sidewalk sales, retail di sp lays, vehicle displays.
, (2) Retail shopping center requirements .
. (a) Application procedures.
[1] Site plan. Site plans for any such retail shopping center shall be
submitted to the Planning Board for its lIpproval as to site layout,

provisions for handling traffic flow, parking area, landscaping, traffic,
and architectural characteristics before a building permit is issued. To
assure that retail shopping centers shall be reasonably attractive in
appearance, the developer or its representative shall submit to the
Planning Board, in addition to the requirements set forth in § 180-13, an
architect's rendering or comparable illustration of the planned
construction, including landscaping, prior to applying for a building
permit. The architectural concept will be required to fit the character of
the community and be at the approval of the Planning Board prior to
issuing a building permit. Unless such a drawing approved by the
Planning Board is submitted to the Inspector of Buildings, no building
permit shall be issued, nor shall an occupancy permit be granted unless
and until the finished construction reasonably conforms to the drawing
submitted.
[2] Special permit.
[a] No building permit shall be issued for, and no' person shall
undertake, any use or improvement for a retail shopping center
unless an application for a special permit has been prepared for the
proposed development in accordance with the requirements and
§ 180-11. For the purpose of this section, the special permit
granting authority shall be the Agawam Town Council.
[b] No building permit shall be grantee! by the Inspector of Buildings
until the Agawam Town Cpuncil 'has given its final approval that
the development or any phase thereof and any associated off-site
improvements conform to the approved application for a special
permit under this section, including any conditions imposed by the
Agawam Town Council. No temporary occupancy permits shall be
granted.
(b) Parking. No space within the required front setback area may be used for:
. parking unless approved by the Planning Board. An overall shared parking
scheme is preferred and developed in such a way that conforms to parking
space requirements for retail shopping centers as specified herein. In the
overall shared parking scheme, the. applicant shall specify how shared
parking areas are to be owned, constructed, operated and maintained and'
provide the Planning Board with the proposed deeds, deed restrictions,
association bylaws or other legal documents or mechanisms for ensuring the
same. All parking lots shall be designed according to the following standards:
[1] Minimum 4.511,000 overall parking ratio inclusive of all buildings (no
unheated garden shop or seasonal retail or wholesale sales);
[2] Minimum size for parking spaces shall be nine feet by 18 feet unless'
when using angled parking as specified in the Institute of Transportation
Engineers, Traffic Engineering Handbook, Parking ClassA.
[3] Minimum width for drive aisles shall be:

sidewalks and entrances to all buildings shall be specified to provide
safe access and internal circulation within the s ite',
[7] No overnight parking of vehicles not related to the ongoing operation of
the shopping center.
(c) Traffic impact report. A traffic impact report, indicating projected traffic
fl ows to and from the project at its build-out, projected traffic flows and
le vels of service on nearby roadways in fLve years and at build-out of the
development, current traffic fl ows, levels of service and accident records for
said roadways, projected capacity, service level and safety problems
anticipated in five years and at proj ect build-out, proposed mitigation
measures and other relevant information shall be submitted as part of the site
plan application and presented to the Pl anning Board at a public meeting by a
professional traffLc engineer or transportation planner. The area to be
included in the traffic impact study shall be determined by the Planning
Board. The Planning Board may require traffic signal s, traffic or turn lanes,
sidewalks, bikeways or any other mitigation measures that it believes
necessary to protect public safety and mainlain proper traffic flow on
roadways within or impacted by the 'development.
(d) Streets and drives. Streets and dri ves within the development shall be
constructed in accordance with the Planning Board's subdivi sion regulations,
except that the Planning Board may requi re additional sidewalks, traffic
lanes, turn lanes, traffic signals, additional 'lane width based on truck traffic,
additional pavement depth based o n truck traffic or other items or increases
in exisling standards as needed or required. A minimum of two means of
egress from a public way must be pro vided,
(e) Buffers and greenspace. Retail shopping centers shall contain a minimum of
25% greenspace not including parking and/or interior roadways, A space of
not less than 100 feet shall be maintain ed as an open space buffe r with

natural vegetation or landscaping along and adjacent to agriculturally and
residentially zoned property lines. The buffer shall not be built on, have no
structures to include barrier fencing, be paved or used for parking, dumpsters
and/or storage, but may be utilized for stormwater management and
greens pace only. All buffer areas shall be maintained and kept free of litter.
Additional area, plantings, decorative ' fencing or other items may also be
required by the Planning Board to protect adjacent property owners from
adverse impacts or to protect the character of the neighborhood, including
landscaped berms and/or fences along and adjacent to residentially zoned
property lines.
(I) Parking lot interior landscaping. Fifteen percent of the interior space of all
parking lots shall be landscaped areas. All parking lot islands, connecting
walkways through parking lots and driveways through or to parking lots shall
be landscaped according to the following standards:
[I] Visibility. To avoid landscape material blocking driver sight di stance at
driveway-street intersections, no plant material greater than 24 inches in
height shall be located within 15 feet of a curb cut.
[2] Landscape islands. In addition to any pedestrian refuge areas, each
landscaped island shall include two, minimum two-and-five-tenths-inch
caliper canopy deciduous trees, be of length greater than eight feet in its
smallest dimension, include at lea~t 80 square feet of ground area per
tree to allow for root aeration, and have raised concrete curbs.'
[3] Walkways and driveways. Connecting walkways through parking lots
shall have two, minimum two-and-five-tenths-inch caliper canopy
deciduous trees per 60 linear feet of such walkway planted in landscape
areas within . five feet of such walkway. Driveways through or to
parking lOIS shall have two minimum two-and-five-tenths-irich caliper
canopy deciduous trees per 60 linearfeet of and along each side of such
driveway, in landscape areas within five feet of such driveway.
[4] Parking bays shall extend no more than 20 parking spaces without an
intervening tree, landscape island or landscape peninsula where
landscaped end islands are provided. Where landscaped end islands for
parking bays are not provided, an equivalent landscaped area must be
provided internally within the parking lot.
[5] . Adhere to all existing engineering regulations and requirements.
(g) Lighting. Parking lot lighting shall be as unobtrusive as possible to provide
safe circulation and protect people and property. Light sources shall be
concealed and fully shielded and shall feature sharp cutoff capability so as to
minimize up-light, spill-light, glare and unnecessary diffusion on adjacent
property. Unique areas or neighborhoods within the Town may have
additional design guidelines for li ghting as required by the Planning Board.
Maximum on-site lighting levels shall not exceed 10 footcandles, except for
loading and unloading platforms where the maximum lighting level shall be

20 footcandles. Lighting levels measured 20 feet beyond the property line of
the development site (adjacent to residential uses or public rights-of-way)
shall not exceed 0.1 footcandle as a direct result of the on-site lighting.
Parking lots shall remain fully lit for one hour following the closing of the
store or establishment for which the parking lot serves, and shall be lit by
security lighting thereafter.' All lighting level measurements shall be
determined by mean footcandles over the designated lighted area. Maximum
height on lot poles shall be 20 feet and the fixture shall be shielded to
prevent excess spillage of light onto adjoining propenies.
Outdoor storage areas/mechanical equipment.
. [1] No areas for outdoor storage, trash collection or compaction, loading or
other such uses shall be located within 100 feet of any public street,
public sidewalk or internal pedestrian way , and in no event shall be
visible from roadways (such areas will be screened from view,
including the use of live plantings such as arborvitae). These enclosed
areas for only the above purposes must be shielded by an opaque fence,
or site-obscuring landscaping, either of which shall be not less than six
feet.
[2] Loading docks, truck parking, outdoor storage, utility meters, HV AC
and other mechanical equipment, trash collection. trash compaction and
other service fun ctions shall be incorporated into the overall design
theme of the building and the landscape so that the architectural design
is continuous and uninterrupted by ladders, towers and equipment.
[3] All rooftop mechanical equipment shall he screened.
[4) No oiltside sales areas/yards are permitted at any time, which include
any type of stationary or mobile vendor cans (i.e., food stands).
[5) No temporary or fabric structures shall be used for outdoor storage.
(i) Building facade. All exterior building elevations that face public streets
and/or customer parking areas shall be designed so that there are no large
expanses of blank walls. This requirement can be met by employing the use
of architec(ural features, including but not limited to the following, doors,
windows, pila~ters, columns, horiwntal and vertical offsets, material and
color variations, decorative cornices, awnings, dormers, pediments and
'. canopies. At least 75% of the building facades shall have decorative block,
glass, brick, or ·other decorative facing, or a combination thereof. Buildings
are to have reasonably consistent architectural elements to provide continuity,
while allowing individuality in architectural features to distin guish individual
businesses. In order to assure conformance with this requirement, ex terior
building elevations must be reviewed and approved as a part ofJhe overall
final site plan process by the Planning Board.
(j) Noise. No outside loudspeaker or audio sound systems shall be installed or
used other than for drive-through uses.

(k) Maintenance. All properties developed for commercial purposes, whether
they are occupied or not, shall be regularly maintained by the owner of the
property to the reasonable satisfaction of the Zoning Enforcement Off.cer, so
that they are not allowed to rail into a state of disrepair or neglect; and they
shall consistently present a neat and orderly appearance to the general public
as well as adjacent and nearby tenants and property owners. Re gu lar
maintenance shall include at · a minimum, mowing of lawns, general
maintenance of landscaping beds, landscaping irrigation, trash and litter
removal, removal of signs, painting/maintenance of facades and signs, and
proper snow removal.
(I) Other requirements.
[I] Minimum size: five acres.
[2] Maximum facility 100,000 square feet, overall single building size. The
square footage of a mezzanine shall be included in the calculation of the
total square footage.
t3] Minimum frontage: 100 feet.
[4] Front yard setback: 100 feet.
[5] Rear yard setback: 100 feet.
[6] Side yard setback: 100 feet.
[7) Highway setback: 100 feet.
[8] Maximum building coverage shall not exceed 35% of the lot area.
[9] No building within the retail shopping center shall be greater than one
story in height. Notwithstanding the foregoing, internal mezzanines (i.e.,
a low-ceilinged intermediate floor above the· ground .floor) shall be
allowed.
[10) Signage for individual businesses within retail shopping centers shall be
allowed as provided by § 180-80. In addition to the signs permitted for
the individual businesses, retail shopping centers are. allowed One
multifaced ground sign at each major street providing :access to the
property identifying the retail shopping center and any specific uses or
occupancies within the shopping center. The maximum signage area for
each individual business depicted on the retail shopping ·center ground
sign shall not exceed 100 square feet per face for each individual
business. The total maximum signage area for each face of the retail
shopping cenler ground sign shall be limited as follows: a) If the sum of
the building area for all inaividual businesses within the retail shopping
center is less than 100,000 square feel, e'ach face of the retail shopping
center ground signage shall not exceed 200 square feet plus 20 square
feet per each individual business listed; b) If the sum ·of the building
area for all individual businesses within the retail shopping center

exceeds 100,000 square feet, each face of the retail shopping center
ground signage shall not exceed 350 square feet plus 35 square feet per
each individual business listed. Ground signs shall not exceed 20 feet in
height as measured from the top of the sign. Signage design shall fit the
character of the community and be in communion with the architecture
of the proposed retail complex as well the surrounding environment.
Signage for thi s type of development requires the approval of the
Planning Board. No scrolling, tethered or temporary signs are permitted.
Signage per individual establishment shall not exceed 15% of the
establi shment's facade.
§ 180-49. Height regulations. [Amended 6-6-2005 by TOR-2005-8]
A business building shall not be erected or altered to a height in excess of three stori es or
more than 45 feet except as expressly provided herein. These provisions shall not apply to
chimneys, fla g or radio poles, water tanks, hose towers or required bulkheads or elevator
penthouses. A residence building shall comply with the height provisions for Residence B
Districts. Heights of other buildings or structures permitted in § IBO-48A shall 'not exceed the
he ights permitted in Residence B Districts. Notwithstanding the foregoing, business structures
may be erected or altered by special permit to a height in excess of three stories or more than
45 feet when the business structure constitutes part of an amusement park.
§ ISO-50. Setbacks; yards; loading areas.
A. Setbacks and rear yards shall be at least 35 feet in their least dimension.
B. Side yards requirements shall be a minimum of 10 feet, except adjacent to residenti al or
agricultural zones, at which time it would be 15 feet. [Amended 4-7-1986 by
TOR-86-6]
C. Space shall be provided fot vehicle parking and for the loading and unl oading of all
materials. equipment and merc handise on the premises and entirely off the traveled way,
with such additional space as may be necessary to provide free and easy access to that
portion of the building so as not to interfere with traffic on the public way. Loading and
unloading are prohibited on the front of any building.
D. A building devoted in whole or in part to residence uses shall comply with the
requirements for setbacks, side yards and rear yards of the Resident B Distri ct.

No business building shall be erected or altered sQ as to cover more than 50% of the area of

(I) There shall be a rear yard on every lot between the principal building and the rear

In a ResidenCe A-3 District as indicated by the Building Zone Map, no building or other
structure shall be erected, altered or Llsed and no land shall be used or occupied for any
purpose except for apartment houses or garden-type apartments and accessory uses incident
thereto and subject to the following restrictions:
A. Subdivision control will not apply ex~ept insofar as it applies to road construction,
surface drainage and utilities.
B. The project shall be located on a lot containing not less than two acres and contain not
more than eight family dwelling units per acre of lot area. The building coverage shall
not exceed 40% of the lot area. The minimum lot frontage on a street shall be 1 SO feet.
C. No building shall be located nearer than 40 feet to a street line or other property line.
D. There shall be a landscaped strip of not less than IS feet in width appropriately planted
with lawn, trees and shrubs adjacent and parallel to all property lines of the site.

E. There shall be a landscaped foundation strip of not less than 10 feet in width between
each building and any roadway, drive or street. Such strip shall contain a six-foot-wide
grassed and planted area and four-foot-wide sidewalk adjacent to any roadway, drive or
street within the project.
F. No building shall be more than two stories in height, exclusive of the basement. The
basement shall not contain any living quarters.
G. The minimum distance between any two buildings on the same lot shall in no case be
less than 40 feet.
H. Floor area.
(I) No building shall contain more than eight family dwelling units. and no dwelling
unit shall contain less than the following minimum floor areas:
(a) One-bedroom units: 400 square feet.
(b) Two-bedroom units: 600 sq uare feel.
(c) Each additional room: 120 square feel.
(2) In computing floor area, only the space within the dwelling unit used exclusively
for living purposes shall be considered. Halls. closets, stairways. bathrooms and
lavatories are expressly excluded from this computation.
I. All stairways are to be contained within the building structure proper.
1. Each dwelling unit shall have access to not fewer than two egresses remote from each
other and so arranged that to reach one egress it will not be necessary to pass through a
common. corridor or hallway which serves the other egress. The term "egress" is as
defined in § 101.0 of the Department of Public Safety, Board of Standards, Building
Code.
K. Parking space shall be·provided at the rate of two spaces for each family dwelling unit.
Each spate shall contain a minimum of 200 square feet and shall be located at least 25
feet from any principal building, eKcept that if garage parking is to be located within the
building, it must comply with the rules and regulations governing construction of garages
contained in Form FPR-4 of the Massachusetts Department of Public Safety, Board of
Fire Prevention Regulations.
L. There shall be no provision for parking on roadways, drives. or streets.
M. The. balance of the lot not used for buildings, roadways, streets or parking areas shall be
suitably planted and landscaped and maintained.
N. Space contained in apartment units or garden-type apartment units shall not be used,
rented or leased for any commercial or business uses.
O. The plans for any such apartment or garden-type apartment shall be submitted to the
Planning Board for its approval as to si te layout, provisions for handling vehicular traff.c
flow, parking area and landscaping before a building permit is issued.

Despite some opposition
from the business community,
the City Council Wednesday
voted 8-0 to grant. a zone
change that will allow Russo,
who has his own construction·
company, to build the com,
plex.
With two councilors absent
and City Councilor James P.
Cichetti abstaining because he
has a relationship with Russo,
the council changed the zon-
ing of a 6.6-acre pi\rcel frolll

their neighbors in the area,
which he described as pretty
much all commercial.
Although there are no plans

business purposes, Vincunas
said it could be commercial in

He called on councilors to
avoid more of what he called
the "hodgepodge" type of zon-
ing in town that mixes busi-
nesses with residences.
However, councilors argued

Board. nixes zoning change

AGAWAM -The town's planning board
recently voted 3-2 to send a negative recom-
mendation to the cityrouncil in regards to a
zoning change on GartIeo Street requested by
Thomas Russo Ir.
In a letter to the cooncil, board chainnan
Travis Ward said that three mem1len; of the
planning board believe that changing the
present business zone area to a residential-
zone would not be "appropriate for residen-
tial use and does not constitute good plan-
ning."
The proposed area of the zoning change
encompasses 6.6 acres of land located on
the south side of Garden Street, bounded on
the west by 206 Garden St., to the east by
257 Garden SL and to the north by Vennette
Auto Body.
.Russo wanted a change from the. existiog
Business-B zoning to Residence A-3 for a
condominium project. The parreI at issue is
in a mixed zone area aod the property west
aod north are also zoned Business B and to
the south Industrial A.
"Under the cunent (zoning), the parcel can
be used for commercial and/or industrial por-
pooes." wrote Ward. ''The town has very few
parcels zoned for this type of use. Due to the
rnnnIcipal services associated with residential
development, residential development repre-
sents a net deficit to the town, whereas corn-
mereia1arufindustrial development generate
much needed rnnnIcipal revepues."

NARRATIVE ADDENDUM TO SITE PLAN APPROVAL

On behalf of Mr. Thomas Russo Jr. and T Russo Jr. Construction Co. Inc., R. Levesque
Associates, Inc. is submitting an application for the construction of a 36-unit
Condominium Community and associated site improvements to be located on the south
side of Garden Street, in the Town of Agawam, MA.
Property Description
The subject property is approximately 6.6 ± acres with approximately 443 feet of
frontage located on the south side of Garden Street, just east of the Garden Street exit off
Route 57 in the Town of Agawam, MA. The subject property consists of vacant land, of
which, the southern two-thirds is forested land including a large wetland. The northern
third of the property is cleared upland meadow that will be utilized for the proposed
development. The property was recently rezoned to Residence A-3 District which
permits Condominium Communities by right.
Surrouuding Land Uses
The property abuts both commercial and residential uses. To the east of the parcel, lies a
Business "B" zoned property under the same ownership, currently slated for the
construction of a commercial office building. To the north, across Garden Street,
Vermette's Auto Body and O'Connell Construction are direct abutters. To the west, there
is a single family residential home and property associated with Springfield Tumverein,
Inc. To the south, lies Kittredge Equipment Company.
Detailed Project Description
The proposed project consists of the construction of a 36-unit Condominium Community,
divided amongst five separate buildings. The proposed condominiums will be composed
of two and three bedroom townhouses with single car garages. The driveways to each
condominium accommodate an additional parking space and an extra ten parking spaces
are provided in an interior island for overflow and visitor use.
The Condominium Community is accessed from Garden Street where the entry drive
heads in a southerly direction towards the interior of the community. The drive then
loops around the aforementioned visitor parking area and back towards the Garden Street
exit.

Stormwater
All stonnwater from the site will be conveyed into deep sump catch basins, through the
subsurface conveyance systems into a water quality unit prior to being released into two
different subsurface infiltration systems (Please see attached plan set).
The undeveloped portion of the site will remain as forested woodland. There are no plans
for work beyond the limit-of-work shown on the plans submitted herewith.
The site plans and stonnwater plan and report have been submitted to the Town of
Agawam Engineering Department for their review.
Utilities
Gas, electric, cable and phone are all available in Garden Street. The site will be serviced
by Town sewer and water which are both also available in Garden Street. The sanitary
sewer from the site will be pumped to a manhole within the property from which the
effluent will flow by gravity to the municipal sanitary system in Garden Street. There is
a fire hydrant directly adjacent to the curb-cut at the front of the neighboring property
which will provide for adequate flows for fire suppression needs.
Landscape and Lighting
The proposed landscaping will be consistent with the requirements set forth in the
Agawam Zoning Regulations for the Residential A-3 zone. The proposed landscape plan
includes foundation plantings around the proposed building, screening and accent
plantings throughout the site. All trees and vegetation outside the limit-of-work will
remain.
The lighting within the proposed project will provide for safe pedestrian and vehicular
circulation to, from and within the site. Said lighting will be shielded to prevent glare
into neighboring properties

5. Stormwater Management Plan
The Stormwater Perm~ Application must include submission of a Stormwater Management Plan. The
purpose of the Stormwater Management Plan is to ensure that the runoff from a s~e has been treated for
water qual~y and quantny impacts during the construction of the project and during the long term. This
treatment includes. but is not lim~ed to. erosion and sediment control to the extent practicable via
structural and non-structural BMPs during construction and the establishment of structural BMPs for the
long term controls.
See Agawam Stormwater Management Ordinance (Ch. 175-35) and the Massachusetts Erosion and
Sediment Control Guidelines for Urban and Suburban Areas prepared by the Massachusetts DEP

6, Certification Statement
The owner or authorized representative and all contractors and subcontractors shall sign
certification statements as part of the permit application and Stormwater Management Plan. In
signing the plan, the authorized representative certifies that the information is true and assumes
liability for the plan. In addition, the undersigned agrees:
1. To furnish any additional information relating to the installation of use of the storm drain for which
this perm~ is sought as may be requested by the Superintendent.
2. To accept and abide by all the provisions of Section 175 inclusive of the Ordinances of the Town
of Agawam and of all other pertinent ordinance or regulations that may be adopted in the future.
3. To operate and maintain any storm drain and delention facil~ies, as may be required as a
cond~ion of the storm drainage perm~ in efficient manner at all nems, and at no expense to the
Town.
4. To cooperate at all items with the Superintendent of Public Works and his representatives in their
inspection of storm drains, and any maintenance thereof.
5. To notify the Superintendent of Public Works immediately in the event of any accident,
negligence, or olher occurrence Ihat occasions discharge to Ihe slorm drain of any wasles or
process waters not covered by this perm~ or allowed by Seclion 175 the Ordinance of the Town
of Agawam.
6. To indemnify the Town from loss or damage that may directly or indireclly be occasioned by the
installation of the storm drain and related facility or connection.

On behalf of Thomas Russo, the owner of the above referenced property, R Levesque Associates, Inc is
herein respectfully petitioning the Agawam Town Council for a Zoning Map Amendment (Zone Change)
for a portion of Parcel G8 13 on Garden Street in Agawam, MA.
PropertY Designation:
The subject property is portion of the property known as Parcel G8 13 on the Agawam Assessors Mapping.
The property is also referred to as Parcel "A" on a plan recorded in the Hampden County Registry of Deeds
plan book 358 page 114 for T. Russo Construction Corporation, dated June 16, 2010, prepared by R

The subject property lies entirely within the BB Zoning District and consists of 6.6 acres at the eastern side
of the parent parce\. The property is bounded directly to the west by a residential borne at 206 Garden
Street and farther to the west by the Springfield Tum-Verein, to the north by Vermette's Autobodyand 8
Residential home at 257 Garden Street, to the east by a residential property at 256 Garden Street, and to the

Zoning MaD Amendment (Zone Change) Sought:
The petitioner seeks an amendment (Zone Change) to the Town of Agawam Zoning Map for a portion of
parcel G8 13 also known as Parcel "A" on a plan recorded in the HCRD plan book 358, page 114, as set
forth in section 180-3 of the Town of Agawam Zoning Regulations.
The applicant wishes to rezone the subject property from BB to A-3 to allow for multifamily dwellings.
Reason for the Zoning Map Amendment:
The aforementioned Zone Change is being requested to allow for a proposed condominium community to
be developed within the subject property. By granting the aforementioned Zone Change, the Council will
be allowing the applicant to pursue an economically viable multifamily housing community. Said
community will provide reasonably priced homes in an existing neighborhood made up of a mix of
residential and light industrial uses.

Argument:
a. Facts to support a finding that the Zone Change will be desirable and withont substantial
detriment to tbe public good:
I. Please see the attached Preliminary Site Plan of the proposed project. Said Plan
illustrates the character of the proposed project.
The subject site is well suited to multifamily development. The required Town services are all available at
the property frontage, the traffic from the site is almost entirely nullified during commuting hours due to its
proximity to Route 57, and the topographic and environmental characteristics of the site allow for said
conununity without any detrimental impacts to the wetland resource areas within the property.
The surrounding properties are residential and light industrial nses. Route 57 provides almost immediate
access to the route 91 corridor making this location ideal for residents commuting to Springfield or
Hartford. The proximity of the subject site also allows the majority of the traffic from the proposed
community to access Route 57 directly northwest of the site, lessening the traffic congestion on the
surrounding roadways and thereby lessening the impact of the development on the surrounding residences.
The applicant plans on leaving the portion of the property to the east zoned Business B (BB) to allow for
the construction of a professional office building.
Understanding the aforementioned, the Zoning Map Amendment (Zone Change) requested herein is not
detrimental to the public good, and does not substantially derogate from the intent of and purpose of said
Zoning Ordinance.
Based on the foregoing, and on the Exhibits attacbed hereto, the applicant respectfully requests that the
Town Council grant the aforementioned Zoning Map Amendment under the Town of Agawam Zoning
Ordinance Section 180-29, qualifying the applicant to construct the proposed condominium project within
the subject property.

Dear Mr. Rheault & Councilors:
On behalf of Thomas Russo, the owner of the above referenced property, R Levesque Associates, Inc is
herein respectfully petitioning the Agawam Town Council for a Zoning Map Amendment (Zone Change)
for a portion of Parcel G8 13 on Garden Street in Agawam, MA.
Property Designation:
The subject property is portion of the property known as Parcel G8 13 on the Agawam Assessors Mapping.
The property is also referred to as Parcel" A" on a plan recorded in the Hampden County Registry of Deeds
plan book 358 page 114 for T. Russo Construction Corporation, dated June 16, 2010, prepared by R
Levesque Associates, Inc.
The subject property lies entirely within the BB Zoning District and consists of 6.6 acres at the eastern side
of the parent parcel. The property is bounded directly to the west by a residential home at 206 Garden
Street and farther to the west by the Springfield Turn-Verein, to the north by Vermette's Autobody and a
Residential home at 257 Garden Street, to the east by a residential property at 256 Garden Street, and to the
south by Kittredge Equipment Company off of Bowles Road.
Zoning MaD Amendment (Zone Change) Sought:
The petitioner seeks an amendment (Zone Change) to the Town of Agawam Zoning Map for a portion of
parcel G8 13 also known as Parcel "A" on a plan recorded in the HCRD plan book 358, page 114, as set
forth in section 180-3 of the Town of Agawam Zoning Regulations.
The applicant wishes to rezone the subject property from BB to A-3 to allow for multifamily dwellings.
Reason for the Zoning Map Amendment:
The aforementioned Zone Change is being requested to allow for a proposed condominium community to
be developed within the subject property. By granting the aforementioned Zone Change, the Council will
be allowing the applicant to pursue an economically viable multifamily housing community. Said
community will provide reasonably priced homes in an existing neighborhood made up of a mix of
residential and light industrial uses.

Argument:
a, Facts to support a finding that the Zone Change will be desirable and without substantial
detriment to the public good:
I. Please see the attached Preliminary Site Plan of the proposed project. Said Plan
illustrates the character of the proposed project.
The subject site is well suited to multifamily development. The required Town services are all available at
the property frontage, the traffic from the site is almost entirely nullified during commuting hours due to its
proximity to Route 57, and the topographic and environmental characteristics of the site allow for said
community without any detrimental impacts to the wetland resource areas within the property.
The surrounding properties are residential and ligbt industrial uses. Route 57 provides almost immediate
access to the route 91 corridor making this location ideal for residents commuting to Springfield or
Hartford. The proximity of the subject site also allows the majority of the traffic from the proposed
community to access Route 57 directly northwest of the site, lessening the traffic congestion on the
surrounding roadways and thereby lessening the impact of the development on the surrounding residences.
The applicant plans on leaving the portion of the property to the east zoned Business B (BB) to allow for
the construction of a professional office building.
Understanding the aforementioned, the Zouing Map Amendment (Zone Change) requested herein is not
detrimental to the public good, and does not substantially derogate from the intent of and purpose of said
Zoning Ordinance.
Based on the foregoing, and on the Exhibits attached hereto, the applicant respectfully requests that the
Town Council grant the aforementioned Zoning Map Amendment under the Town of Agawam Zoning
Ordinance Section 180-29, qualifying the applicant to construct the proposed condominium project within
the subject property.
