DACHOS, DIRECTOR OFFICE OF PLANNING AND COMMUNITY DEVELOPMENT SUBJECT: Zone Change -Tirone -Maple Street/Spencer Street DATE: October 19,2010 On September 10, 2010, the Town received a zone change request from Tirone Development Corporation for a 11,968 square foot lot located on the comer of Maple and Spencer Streets. The applicant wishes to change the parcel from Residence A-2 to Residence B. The Planning Office has conducted a review of this proposal and submits this report for your information. Land Use and Zoning As stated above, the property for which the zone change is being requested is currently zoned Residence A-2. Please see the attached zoning map. The lot is abutted on the north, south and west by lots zoned Residence A-2. Across Maple Street to the east is the Sutton Place apartment complex which is zoned Residence B. The Residence A-2 District is primarily a single family district, though the following uses are allowed: ( Please refer to 180-23 of the Zoning Ordinance which is attached for a full description.) • Single family residential (a second house keeping unit is allowed by Special Permit) • Office or studio of a dentist, artist, architect, professional engineer or teacher of scholastic subjects • Renting of rooms for not more than four residents • Schools for academic purposes • Colleges, public libraries or museums, churches • Private kindergartens or day nurseries • • • Bus passenger stations or shelters • Telephone exchange buildings • Accessory buildings Residence B allows the construction of duplexes. The applicant, in his cover letter, states that this is the intended use of the property. Also under the proposed Residence B District the land can be used for the following: ( Please refer to 180-31 of the Zoning Ordinance which is attached.) • Any use permitted in a Residence A-lor A-2 District • Two-family dwellings • Four-family dwellings on not less than an acre • Lodging houses • Clubs, lodges and social center buildings • Hospitals, sanitariums or charitable institutions • Private garages The lot in question is abutted by a single family home to the north, west and south. As indicated above, the Sutton Place apartments are abutters across Maple Street to the east. Environmental Considerations There are no known environmental issues regarding this lot. Other Considerations The Safety Officer's memo raises issues concerning motor vehicle safety, primarily entering and exiting the site. The Zoning Officer has also expressed a concern regarding "spot zoning" verbally. Summary All of the lots in the immediate vicinity of the parcel on the west side of Maple Street are zoned Residence A-2 and are occupied by single-family dwellings. On the east side of Maple Street is a more mixed use rone containing multi-family dwellings and commercial uses. Changing the zoning as requested could be construed to be "spot roning". Dear Councilors: Tel. 413-786-0400 Fax 413-786-9927 At its duly called meeting held on November 4,2010, the Agawam Planning Board voted unanimously (5 -0) to send a negative recommendation to the Town Council regarding the proposed zone change on Spencer and Maple Streets by Tirone Development Corp. The Spencer Street/Maple Street neighborhood is primarily an older single family neighborhood. There are apartments on the east side of Maple Street, but these are physically separated from the rest of the neighborhood. On the west side of Maple Street there are single family dwellings. Abutters to the property all spoke in opposition to the zone change. They raised concern over the effect that placing a duplex in a single-family neighborhood would have on their property values, marketability, as well as the character of the neighborhood. ~etters from the abutters are attached. The members are of the opinion that this zone change would constitute "spot zoning". Spot zoning as defined by the Massachusetts Supreme Judicial Court is where one lot or a small area has been singled out for the economic benefit of the owner of the property and is not in accordance with a well considered plan for the public welfare. During that time, we have built up an equity in our home and enjoyed living in this neighborhood which consists of single family homes. This neighborhood was zoned Residence A2 when we purchased our home and we feel that this is the reason we have been able to enjoy this neighborhood and build an equity in our home. The vacant lot on the corner of Spencer St. and Maple St. abuts our property at 13 Orchard SI. Our feeling is that a duplex being built on the piece of property on the corner of Spencer St. and Maple st. would devalue the surrounding homes in this neighborhood causing a Significant loss of money should we decide to sell our home. This is of great concern to us.. . A multi-family dwelling will cause the complexion and chemistry of our neighborhood to change negatively and will not fit in with the single family homes that have been established in this neighborhood for many years. A single family house built on this property would make a good fit for the neighborhood . . Due to the above reasons we Wish to voice our Objection to the zone change from Residence·A2 to Residence B. (2) The owner of the lot adjacent in the rear of the petitioner's property. (3) The owner of the lot directly across the street therefrom. Where the petitioner is the owner of a lot on either side, in the rear or across from the property for which a variation is requested, such lot shall be omitted, in which case written corisent and approval shall be se~ured from the owner of the property next to that owned by the petitioner. In case there are two or 'more lots adjacent in the rear or sides of the petitioner's property, the owner of the lot which abuts the greater length on the petitioner's property shall be deemed the owner of the lot adjacent to the petitioner'S property, as used in this section. 180:20 05 -15 -2006 [ [ [ [ l r f I I I I , I j I J , 1 , i i I ! ; i J i X § 180-23 • • ZONING § 180-23 In the case of an appeal for a variation involving a dwelling situation on a corner lot or so located that the obtaining of the exact numerica.! assents of the owner above enumerated is unreasonable or impossible, the Board of Appeals may grant the variation, provided that the' consents of the property owners are obtained substantially in accordance with the principals herein set forth as may be determined by the Board of Appeals. The power to authorize such variation of the use of existing dwellings shall be within the sound discretion of the Board of Appeals, and no variation in use shall be granted unless it shall be clear that the relief requested will not be detrimental to the best interests of the vicinity and will be in harmony with the general purpose and intent of this chapter. Each case shall be considered on its own merits, and no case shall raise a presumption in favor of any other case. No decision of the Board of Appeals shall be considered as changing or affecting the wning of any Residence A-2 District. C. The office Or studio of a dentist, artist, architect, professional engineer or teacher of scholastic Subjects residing on the premises or a beauty parlor wherein one of the ,residents is the sole operator. The space occupied by such office, studio or parlor shall not exceed 20% of the total floor area of the dwelling, exclusive of the basement. No display, sign or other advertising devise shall be permitted except an interior illuminated, reflective or nonilluminated professional nameplate having an area of not more than 144 square inches. The studios or offices of dancing or music teachers, photographers, masseurs, veterinarians, riding schools and other similar businesslike pursuits are prohibited. D. The renting of rooms and the furnishing of table board to not more than four resident persons in a dwelling occupied as a private residence. No display, sign or other advertising device, illuminated or otherwise, shall be visible from the street except a nonilluminated announcement sign having an area of not more than 144 square inches. E. Schools for academic purposes only and community center buildings, except dancing or bowling and like activities, provided that there is no display or advertising visible from the street, other than as permitted in Subsection C of this section. F. Colleges, public libraries or museums, churches or other places of worship, parish houses and Sunday school buildings. G. Private kindergartens and day nurseries conducted in otherwise pennitted buildings in this district, provided that not more than 250/0 of. the nuor area uf the building, exclusive of the basement, is used primarily for this purpose. H. Bus passenger stations or shelters, not including repair service or garaging. I. Telephone exchange buildings. J. Accessory buiJdings and uses customarily incident to any use permitted in this section, provided that such use shall not be offensive or dangerous to life by reason of health or fire, and provided further that such accessory use shall not include any activity conducted for gain. K. The keeping and raising of poultry, livestock and pigeons, whether for the table or other purposes, Or other like objectionable uses are prohibited. L. Private garages, provided that no business, service or industry is conducted therefrom or therein. Not more than one motor vehicle for each 5,000 square feet of lot area or fraction thereof, nor more than five motor vehicles, not more than one of which may be unregistered, shall in any case be kept on the premises. Only one such vehicle may be a commercial vehicle and of not more than 3/4 ton's weight of capacity. Space for motor vehicles shall not be leased or rented for commercial vehicles. No commercial vehicles shall be parked on a lot in the open. These space regulations shall apply to vehicles regularly left on the lot, whether housed or in the open. M. Not more than one house trailer may be kept on the premises. The trailer shall not be used for living quarters while so located. Space shall not be leased or rented for trailers. N., Uses outlined in § ISO-37B and C, when the line separating a Residence A-2 District from an Agricultu~al District runs through a property not being used for agricultural purposes so that the future use of the whole property for agricultural purposes would be prohibited. § 180-24. Height regulations. A. A residence building shall not exceed 2 112 stories or more than 35 feet in height. Other buildings such as schools, telephone exchanges and community. center buildings and other uses permitted in § ISO-23E shall not exceed 50 feet in height. Chimneys, steeples and flag or radio poles are exempt from the height provision of this section. B. Accessory buildings or structures, including private garages, shall not exceed 17 feet in height for a one-story building. A one-and-one-half-story accessory building shall not exceed 25 feet in height. § 180-25. Setback requirements. A. No part of any building shall be placed within 30 feet of any street line. B. No part of any garage or other accessory building situated within 65 feet of ~ny street line shall extend within 15 feet of any lot line intersecting such street which serves as a side lot line located in any residence district or within 15 feet of any street line. C. On a corner lot, no part of any building shall be erected or altered so as to be less than 25 feet from any street line. D. Open porches which are 20 feet or more from the' street line may be enclosed on one or more sides with glass enclosures. ISO:22 05 • 15 . 2006 • • § 180-26 ZONING § 180-29 § 180-26. Yards. A. Side yards. (1) There shall be a side yard between a principal building and any side lot line which shall be 15 feet wide in its least dimension. (2) Detached garages or accessory buildings shall be placed at least five feet from the side lot line if located more than 65 feet from a street line. B. Rear yards. (I) There shall be a rear yard on every lot between the principal building and the rear lot line. It shall be 20 feet deep in its least dimension. (2) One-story accessory buildings shall be placed at least five feet from the rear lot line. and one-and-one-half-story accessory buildings shall be placed at least 10 feet from the rear lot line. § 180-27. Lot size. No lot shall have a frontage of less than 110 feet nor an area of less than 15,000 square feet. § 180-28. Lot coverage. No principal building shall be erected or altered so as to COver more than 40% of the area of the lot on which it is located. § 180-29; Use restrictions. ARTICLE IV Residence A-3 Districts In a Residence A-3 District as indicated by the Building Zone Map, no building Or other structure shall be erected, altered or used and no land shall be used or occupied for any purpose except for apartment houses or garden-type apartments and accessory uses incident thereto and subject to the following restrictions: A. Subdivision 'control will not apply except insofar as it applies to road construction, surface drainage and utilities. B. The project shall be located on a lot containing not less than two acres and contain not more than eight family dwelling units per acre of lot area. The building coverage shall not exceed 40% of the lot area. The minimum lot frontage on a street shall be 150 feet. C. No building shall be located nearer than 40 feet to a street line or other property line. D. There shall be a landscaped strip of not less than 15 feet in width appropriately planted with lawn, trees and shrubs adjacent and parallel to all property lines of the site. 180:23 05 -1S -2006 • § 180-31 § 180-31. Permitted uses. AGAWAM CODE ARTICLE VI Residence B Districts • § 180-31 In any Residence B District as indicated on the Building Zone Map, no building or other structure shall be erected. altered or used and no land shall be used or occupied for any other purpose except one or more of the following: A. Any USe permitted in a Residence A-lor A-2 District. B. A twa-family dwelling for two housekeeping units. A semidetached dwelling for two families. provided that there shall not be more than one family in each half of such dwelling. C. Notwithstanding any other provision In the above paragraph. no building or other structure shall be erected. altered or used for residential purposes which shall accommodate or house more than four families. All four-family buildings or structures us<;d for residential purposes shall be erected on a parcel of land containing not less than one acre in area and having not less than 150 feet of frontage" on a street. D. Lodging houses. provided that there is no display. sign or other advertising device visible from the street, whether illuminated or otherwise. other than a sign having an area of not more than 144 square inches. A public restaurant or dining room shall be permitted as an accessory use in any part of such building. provided tliat the dining room and kitchen facilities do not occupy more than 75% of the first-floor area of such building. E. Clubs. lodges and social center buildings. except those whose chief activity is a gainful service or activity usually conducted as a business. including in such excepted uses dancing or bowling and like activities. provided that there is no display or advertising visible from the street other than that permitted in Subsection D of this section. F. Hospitals. sanitariums or charitable institutions. except those for contagious diseases. for the care of epileptics or drug or liquor patients. for correctional purposes or for the care of the insane .or feebleminded. G. Private garages. provided that no business. service or industry is conducted therefrom or therein. Not mare than one motor vehicle shall be kept for each 2.500 square feet of lot area. except that three vehicles may be kept. in any case. not more than one of which may" be unregistered. B. Where the alignment of a building is not controlled by the preceding subsection, no part of any building shall be placed within 20 feet of the street line. C. No part of any garage, stable or other accessory building situated within 65 feet of any street line shall extend within IS feet of any lot line intersecting such street which serves as a side lot line located in any residence district or within IS feet of any street line. D. On a corner lot, except as otherwise provided in this section, no part of any building shall be erected or altered so as to be less than 20 feet from any street line. E. Existing open porches which are IS feet or more from the street line may be enclosed on one or more sides with glazed enclosures. § 180-34. Yards. A. Side yards. There. shall be a side yard between a building and each side lot line. For a building of four stories or over 45 feet in height, it shall be not less than 25 feet in width in its least dimension; for a building of three stories or over 35 feet in height, it shall be not less than 20 feet wide in its least dimension; for one-, one-and-one-half-, two-or two-and-one-half-story buildings, the side yard shall be not less than IS feet wide in its least dimensio·n. B. Rear yards. There shall be a rear yard on every lot between the principal building and the rear lot line. It shaH be 20 feet deep in its least dimension. One-story accessory buildings shall be placed at least fi ve feet from the rear lot line, and one-and-one-half-or two-story accessory buildings shall be placed not less than 10 feet from the rear lot line. . § 180-35. Buildings or shelters for the sale of farm products, provided that a major portion of the products offered for sale at all times are raised on the premises and no advertising of products other than those raised on the premises shall be displayed. D. The processing of forests and wood lots by portable woodworking mills and machinery for processing wood cut on the premises. if approved by the Board of Appeals. E. Airports and landing strips and buildings or structures necessary thereto. if located west of Suffield Street. F. Off-street parking for 24 hours or less for motor vehicles when the use is an accessory to an existing conforming amusement park containing at least three acres of land adjacent to agriculturally zoned land and by special permit. [Added 2-20-2001 by TOR-2001-1] § 180-38. Height regulations. Buildings or structures pennitted in this zone under § 180-37 A shall not exceed the heights permitted in § 180-24 of this chapter. For other buildings permitted by this Article. the height limitation shall be 50 feet. § 180-39. Setback requirements. A. Buildings and shelters for the sale of farm products shall be at least 35 feet from the street line. B. Dwellings with or without attached garages shall be at least 35 ~eet from the street line. DACHOS, DIRECTOR OFFICE OF PLANNING AND COMMUNITY DEVELOPMENT SUBJECT: Zone Change -Tirone -Maple Street/Spencer Street DATE: October 19,2010 On September 10, 2010, the Town received a zone change request from Tirone Development Corporation for a 11,968 square foot lot located on the comer of Maple and Spencer Streets. The applicant wishes to change the parcel from Residence A-2 to Residence B. The Planning Office has conducted a review of this proposal and submits this report for your information. Land Use and Zoning As stated above, the property for which the zone change is being requested is currently zoned Residence A-2. Please see the attached zoning map. The lot is abutted on the north, south and west by lots zoned Residence A-2. Across Maple Street to the east is the Sutton Place apartment complex which is zoned Residence B. The Residence A-2 District is primarily a single family district, though the following uses are allowed: (Please refer to 180-23 of the Zoning Ordinance which is attached for a full description.) + Single family residential (a second house keeping unit is allowed by Special Permit) + Office or studio of a dentist, artist, architect, professional engineer or teacher of scholastic subjects + Renting of rooms for not more than four residents + Schools for academic purposes • Colleges, public libraries or museums, churches • Private kindergartens or day nurseries • + Bus passenger stations or shelters + Telephone exchange builillngs + Accessory buildings Residence B allows the construction of duplexes. The applicant, in his cover letter, states that this is the intended use of the property. Also under the proposed Residence B District the land can be used for the following: ( Please refer to 180-31 of the Zoning Ordinance which is attached.) + Any use permitted in a Residence A-lor A-2 District + Two-family dwellings + Four-family dwellings on not less than an acre + Lodging houses + Clubs, lodges and social center buildings + Hospitals, sanitariums or charitable institutions + Private garages The lot in question is abutted by a single family home to the north, west and south. As indicated above, the Sutton Place apartments are abutters across Maple Street to the east. Environmental Considerations There are no known environmental issues regarding this lot. Other Considerations The Safety Officer's memo raises issues concerning motor vehicle safety, primarily entering and exiting the site. The Zoning Officer has also expressed a concern regarding "spot zoning" verbally. Summary All of the lots in the immediate vicinity of the parcel on the west side of Maple Street are zoned . Residence A-2 and are occupied by single-family dwellings. On the east side of Maple Street is a more mixed use zone containing multi-family dwellings and commercial uses. Changing the :loning as requested could be construed to be "spot zoning". A one-family detached dwelling for one housekeeping unit only; provided, however, that the Board of Appeals, upon an appeal from an order or decision made, by the Inspector of Buildings and if it deems such action wise and if it shall appear to the Board that such action will tend to .preserve the standard and character of the neighborhood, may authorize a variation in the use of a one-family dwelling existing at the time of the adoption of this Article so that such dwelling may be altered and improved and facilities added for a second housekeeping unit. In all such cases the petitioner, as a condition precedeJit to the privilege herein granted, shall present adequate plans setting forth the changes and improvements to be made and shalI have secured the written consent and approval of at least three of the following 'property owners: (I) The owner of the lot on either side of the petitioner's property. (2) The owner of the lot adjacent in the rem of the petitioner's property. (3) The owner of the lot directly across the street therefrom. Where the petitioner is the owner of a lot on either side, in the rear or aCross from the property for which a variation is requested, such lot shall be omitted, in which case written consent and approval shall be secured from the Owner of the property next to that owned by the petitioner. In case there are two or more lots adjacent in the rear or sides of the petitioner's property, the owner of the lot which abuts the greater length on the petitioner's property shall be deemed the owner of the lot adjacent to the petitioner's property,as used in this section. 180:20 05· 15 • 2006 § 180-23 • ZONING § 180-23 In the case of an appeal for a variation involving a dwelling situation on a corner lot or so located that the obtaining of the exact numerical assents of the owner above enumerated is unreasonable or impossible, the Board of Appeals may grant the variation, provided that the consents of the property owners are obtained substantially in accordance with the principals herein set forth as may be determined by the Board of Appeals. The power to authorize such variation of the use of existing dwellings shall be within the sound discretion of the Board of Appeals, and no variation in use shall be granted unless it shall be clear that the relief requested will not be detrimental to the best interests of the vicinity and will be in harmony with the general purpose and intent of this chapter. Each case shall be considered on its own merits, and no case shall raise a presumption in favor of any other case. No decision of the Board of Appeals shall be considered as changing or affecting the zoning of any Residence A-2 District. C. The office or studio of a dentist, artist, architect, professional engineer or teacher of • scholastic subjects residing on the premises or a beauty parlor wherein one of the .residents is the sale operator.' The' space occupied by such office, .studio or parlor shall not exceed 20% of the total floor area of the dwelling, exclusive of the basement. No display, sign or other 'advertising devise shall be permitted except an interior illuminated, reflective or nonilluminated professional nameplate having an area of not more than 144 square inches. The studios or offices of dancing Or music teachers, photographers, masseurs, veterinarians, riding schools. and other similar businesslike pursuits are prohibited. D. The -renting of rooms and the furnishing of table board to npt more than four resident persons in a dwelling occupied as a private residence. No display, sign or other advertising device, illuminated or otherwise, shall be visible from the street except a nonilluminated announcement sign having an area of not more than 144 square inches. E. Schools for academic purposes only and community 'center buildings, except dancing or bowling and like activities, prbvided that there is nu display or advertising visible from the street, other than ~s permitted in Subsection C of this section. F. Colleges, public libraries or museums, churches or other places of worship, parish houses and Sunday school buildings. G. Private kindergartens and day nurseries conducted in otherwise permitted' buildings in this district, provided that not more than 250/0 of the floor area of the building, exclusive of the basement, is used primarily for this purpose. H. Eus passenger stations or shelters, not including repair service {)f garaging. I. Telephone exchange buildings. J. Accessory buildings and uses customarily incident to any use permitted in this section, provided that such use shall nOI be offensive or dangerous to life by reason of health Dr fire, and provided further that such accessory use shall not include any activity conducted for gain. K. The keeping and raising of poultry, livestock and pigeons, whether for the table or other purposes, or other like objectionable uses are prohibited. L. Private garages, provided that no business, service or industry is conducted therefrom or therein. Not more than one motor vehicle for each 5,000 square feet of lot area or fraction thereof, nor more than five motor vehicles, not more than one of which may be unregistered, shall in any case be kept on the premises. Only one such vehicle may be a commercial vehicle and of not more than 3/4 ton's weight of capacity. Space for motor vehicles shall not be leased or rented for commercial vehicles. No commercial vehicles shall be parked on a lot in the open. These space regulations .shall apply to vehicles regularly left on the lot, whether housed or in the open. M. Not more than one house trailer may be kept on the premises. The trailer shall not be used for living quarters while so located. Space shall not be leased or rented for trailers. N., Uses outlined in § IS()C37B and C, when the line separating a Residence A-2 District from an Agricultural District runs through a property not being lIsed for agricultural purposes so that the future use of the whole property for agricultural purposes would be prohibited. § 180-24. Height regulations. A. A residence building shall not exceed 2 112 stories Or more tha~ 35 feet in height. Other buildings such" as schools, telephone exchanges and community center buildings and other uses permitted in § ISO-23E shall not exceed 50 feel in height. Chimneys, steeples and flag or radio poles are exempt from the height provision of this section. B. Accessory buildings or structures, including private garages, shall not exceed 17 feet in height. for a one-slory building. A one-and-one-half-story.accessory building shall not exceed 25 feet in height·. § 180-25, Setback requirements. A. No part of any building shall pe placed within 30 feet of any street line. B. No part of any garage or other accessory building situated within 65 feet of any street line shall extend within 15 feet of any lot line intersecting such street which serves as a side lot line located in any residence district or within 15 feet of any street line. C. On a corner 101, no. part of any building shall be erected or altered so as to be less than 2S feet from any street line. D. Open porches which are 20 feet or more from the' street line may be enclosed on OTIe or more sides with glass enc/osures. 180:22 05 -15 -2006 .c. § 180-26 ZONING § 180-29 § 180-26. Yards. A. Side yards. (1) There shall be a side yard between a principal building and any side lot line which shall be 15 feet wide in its least dimension. (2) Detached garages or accessory buildings shall be placed at least flve feet from the side lot line if located more than 65 feet from a street line. B. Rear yards. (1) There shall be a rear yard on every lot between the principal building and the rear lot line. It shall be 20 feet deep in its least dimension. (2) One-story accessory buildings shall be placed at least five feet from the rear lot line, and one-and-one-half-story acceosory buildings shall be placed at least 10 feet from the rear lot line. § 180-27. Lot size. No lot shall have a frontage of less than 110 feet nor an area of less than 15,000 square feet. § 180-28. Lot coverage. "No principal building shall be erected or altered so as to cover. more than 40% of the a;eri of the lot on which it is located. § 180-29, Use restrictions. ARTICLE IV Residence A·3 Districts In a Residence A-.3 District as indicated by the Building Zone Map, no building or other structure shall be erected, altered or used. and no land shall be used or occupied for any purpose except for apartment houses or garden-type apartments and accessory uses incident thereto and subject to the following restrictions: A. Subdivision ·control will not apply except insofar as it applies to road construction, surface ·drainage and utilities. B. The project shall be located on a lot containing not less than two acres and contain not more than eight family dwelling units per acre of lot area. The building coverage shall nOl exceed 40% of the lot area. The minimum lot frontage on a street shall be 150 feet. C. No building shall be located nearer than 40 feet to a street line or other property line. D. There shall be a landscaped strip of not less than IS feet in width appropriately planted with lawn, trees and shrubs adj acent and parallel to all property lines of the site. 180:23 05 ·15 " 2006 § IS0-31 § 180-31. Permitted uses. AGAWAM CODE ARTlCLE VI Residence B Districts (. §IS0-31 In any Residence B District as indicated on the Building Zone Map, no building or other structure shall be erected, altered or used and no land shall be used or occupied for any other purpose except one or more of the following: A. Any use permitted in a Residence A-lor A-2 District. B. A two-family dwelling for two housekeeping units. A semidetached dwelling for two families, provided that there shall not be more than one family in each half of such dwelling. C. Notwithstanding any other proviSIOn in the above paragraPh, no building or other structure shall be erected, altered or used for residential purposes which' shall accommodate or houSe more than four families. AIL four-family buildings or structures ust:d for residentinl purposes shall be erected on a parcel of land containing not less than one acre in area and having not less than 150 feet of frontage on a street. D. Lodging houses, provided that there is no display, sign or other advertising device visible from the street, whether illuminated or otherwise, other than a sign having an area of not more. than 144 square inches. A public restaurant or dining room shall be permitted as an accessory use in any part of such building, provided that the dining room and kitchen facilities do not occupy more than 75% of the first-floor area of such building. E. Clubs, lodges and social center buildings, except those whose chief activity is a gainful service or activity usually conducted as a business, including in such excepted uses dancing or bowling and like activities, provided that there is no display or advertising visible from the street other than that permitted in Subsection D of this section. F. Hospitals, sanitariums or charitable .institutions, except those for contagious diseases; for the care of epileptics or drug or liquor patients, for correctional purposes or for the care of the insaneor feebleminded. G. Private garages, provided thar no business, service or industry is conducted therefrom or therein. B. Where the alignment of a building is not controlled by the preceding subsection, no part of any building shall be placed within 20 feet of the street line. C. No part of any garage, stable or other accessory building siluated within 65 feet of any street line shall extend within 15 feet of any lot line inlersecting such street which serves as a side lot line located in any res,dence district aT within 15 feet of any street line, ' D. On a corner lot, except as otherwise provided in this section, no part of any building shall be erected or altered SO as to be less than 20 feet from any street line. E Existing open porches which are 15 feet or more from the street line may be enclosed on one or more sides with glazed enclosures. § 180·34. Yards. A. Side yards. There shall be a side yard between a building and each side lot line. For a building of four stories or over 45 feet in height, it shall be not 'Iess than 25 feet in width in its least dimension; for a building of three stories or Over 35 ·feet in height, it shall be not less than 2b feet wide in its least dimension; for une-, one-and-one-half-, two-or two-and-one-half-story buildings, the side yard shall be not less than 15 feet wide in its least dimension. B. Rear yards. There shall be a rear yard on every lot between the principal building and the rear lot line. It shall be 20 feet deep in its least dimension. Any use permitted in a Residence A-lor A-2 District. B. Farms, dairies, nurseries, tmck gardens, greenhouses and natural ice-harvesting activities and.buildings or stmctures accessory thereto. e. Buildings or shelters for the saie of farm products, provided that a major portion of the products offered for sale at all times are raised on the premises and no advertising of products other than those raised on the premises shall be displayed. D. The processing of forests and wood lots by portable woodworking mills and machinery for processing wood cut on the premises, if approved by the Board of Appeals. E. Airports and landing strips and buildings or structures necessary thereto, if located west of Suffield Street. F. Off-street parking for 24 hours or less for motor vehicles when the use is an accessory to an existing conforming amusement park containing at least three acres of land adjacent to agriculturally zoned land and by special permit. [Added 2-20-2001 by TOR-2001-I] § 180-38. Height regulations. Buildings or stmctures permitted in this zone under § 180-37 A shall not exceed the heights permitted in § 180-24 of th'is chapter. For other buildings permitted by this Article, the height limitation shall be 50 feet. § 180·39. Setback requirements. A. Bui Idings and shelters for' the sale of farm products shall be at least 35 feet. from the street line. B. Dwellings with or without attached garages shall be at least 3.5 feet from the street line. We have owned our home at 13 Orchard Street for the past thirty three years. During that time, we have built up an equity in our home and enjoyed living in this neighborhood which consists of single family homes. This neighborhood was zoned Residence A2 when we purchased our home and we feel that this is the reason we have been able to enjoy this neighborhood and build an equity in our home. The vacant lot on the corner of Spencer st. and Maple St. abuts our property at 13 Orchard St. Our feeling is that a duplex being built on the piece of property on the corner of Spencer St. and Maple St. would devalue the surrounding homes in this neighborhood causing a significant loss of money should we decide to sell our home. This is of great concern to us. A multi-family dwelling will cause the complexion and chemistry of our neighborhood to change negatively and will not fit in with the single family homes that have been established in this neighborhood for many years. A single family house built on this property would make a good fit for the neighborhood. Due to the above reasons we wish to voice our objection to the zone change from Residence A2 to Residence B. Feeding Hills By Chelsea Cook Turley Publications Correspondent AGAWAM -Despite the torrential rain, the recent grand opening of a new branch of the Wilcox Insurance Agency remained a festive occasion. The scene was Ijardly one hindered by weather; children running around playing, employees laughing good-naturedly with clients; and the free Ben & Jerry's Ice Cream dido't hurt either. Located at 1100 Springfield St in Feeding Hills, the property was purchased in 2008 and construction began in summer 2009. The H. Porter Distilleryw"·localed on Main Street, near South Street, and the same builiIing was until recently used as a garage for the town's departmen!: of pUblic buildings. The distillery made one product, .and made. it very well. The product, Agawatn Gin, had.as its .principal competitors the Fleischman aiuI Old London brlinds, both of which are still produced today. AgawatJi Gin was not sold in bottles. It was Shipp<:d iill over this couotry andoverseas in SO-gallon ~arrels. Locally, it was delivered in kegs. The bar, club, ~t, or package store who bought it, theI) would bottle )t under their ownJabel. .. At the Agawam Historical Society Museum in the old fire- house on Ehn Street, there are several bottles marlced ''Old Agawam Gin" on display. One may note that this gin packed a wallop at 100 proof whereas most alcoholic beverages on sale today are 80 proof. The reputation of Agawam Gin was quite good. Agawam Gin was also once said to he used ill Africa as payment for slaves, but no proof has ever been presenred for that slory. The gin was aged for five years in barrels made right at the distillery by a coopersmith employed by the company. The grain used in the pi-ocess was processed across the Street in a mill powered by water. The water wbeel was turned by a 15- foot drop of water onto the wheel. Juniper benied comprised the oiher part of the distilling process along with water. A by-product of the gin process was yeast and the compa- ny sold yeast in liquid form or in a sort of baIllcake fonn. Reports are that it w.as a much sought after by-pruduCl by local bakeries, restaurants, and homes. . One wonders if the brand could be restored today with the popularity of the so-called . "Wbite" liquors -gin and vodka and become an entire new industry for Agawam. .
