DACHOS, DIRECTOR OFFICE OF PLANNING AND COMMUNITY DEVELOPMENT SUBJECT: Zone Change -Agawam United Methodist ChurchIFlorida Towers LLC -Mill St. DATE: May 25, 2011 On May 4,2011, the Town received a zone change request from Florida towers LLC and Agawam United Methodist Church to include approximately 15 .17 acres of land located on the south side of Mill Street in Agawam's Telecommunications Wireless Overlay District (TWOD). The current underlying zoning is Residence A-2 and Business B. The applicants are requesting the Zoning Map amendment to enable them to install a telecommunications tower at the rear of 491 Mill Street. The property is currently occupied by a single family dwelling and is owned by the Agawam United Methodist Church. The proposed tower and equipment compound is located 425 ' from the existing hoUse and 41 5' from the church located at 459 Mill Street. The tower is also proposed to be located 376' from the church's playground and 315' from the church's pavilion. The Planning Office has conducted a review of t1tis proposal and submits this report for your information. Land Use and Zoning As stated above, the property for which the zone change is being requested is currently zoned Business B and Residence A-2. Please see the attached parcel zoning map and refer to the Agawam Zoning Map to see the current boundaries of the Overlay District. There are no portions of the Overlay District in the vicinity of the proposed site. It was the Town's intent in 1998, when the Telecommunications Overlay District was adopted, that adequate areas be identified to allow for complete coverage throughout the Town. As such, it is the • • responsibility of the applicant to provide evidence by way of service maps to show gaps in current service levels. The materials as submitted do not provide this type of support data and/or documentation. The adjacent land uses are varied. To the west of the site is low density residential development To the east is a more densely developed residential subdivision. Immediately to the north on the opposite side of Mill Street is the Agawam High School and to the south is Rt. 57. Environmental Considerations A large portion of the 15 acre site is constrained by steep slopes, wetlands and a tributary of Three Mile Brook. It is difficult to tell by reviewing the submitted plan, but at a minimum, the applicant should file a Request for Determination of Applicability with the Agawam Conservation Commission. The front quarter of the Site is adjacent to Mill Street, contains the church building and is located in a residential zoning district. Included herein and attached to this Petition, we have provided the necessary information including zoning information, general location of the Site, legal description ofthe Site, 38 copies of plans stamped by a registered land surveyor and the $500 filing fee. We have also included a letter of support from New Cingular Wireless pes, LLC d/b/a AT&T Mobility ("AT&T"). As you may know, AT&T is licensed by the FCC to provide personal wireless services throughout Massachusetts, including the Town of Agawam. FTP anticipates that AT&T will become the anchor tenant at the Site if ultimately approved. Lastly, we have also included a letter of support from the Agawam Fire Department which indicates a clear public safety need for the tower and emergency communications in this area of the Town of Agawam. We respectfully suggest that the inclusion of the Site into the WTOC will satisfy the purpose as provided in section 180-94 of the Ordinance noted below. Town of Agawam May 4,2011 Page 2 As will be evidenced at the public hearings associated with this Petition, the use of the Site for a personal wireless service facility will protect the scenic, historic, natural and other resources of the Town of Agawam while allowing the provision of personal wireless services. fTP and AT&T have conducted exhaustive searches in this area of the Town of Agawam to locate existing tall structures from which personal wireless services could be provided; however, no such structures were available. FTP and AT&T then searched for parcels in the area at the required elevation which could provide the necessary access and provide benefits to the community. In this instance, FTP was able to identify the Site owned by the Church. As noted above, the rear ofthe Site is located in the Business B zoning district. has the necessary elevation and access, and will provide the coverage needs for AT&T. The Site is well screened by the church building, associated facilities and the existing vegetation to the maximum extent possible. Lastly, the inclusion of the Site into the WTOD will assist the Town of Agawam in complying with its obligations under the federal Telecommunications Act of 1996. We note the Site is split into two zoning districts. The rear two- thirds of the Site is located in the Business B zoning district. If approved, FTP and the Church would eventually seek to locate the tower within the Business B zoning district on the Site. Pursuant to Article IX, Section 180-48, we note that a wide array of business uses are allowed in the Business B zoning district. The front third of the Site is adjacent to Mill Street, contains the church building and is located in a residential zoning district. Included herein and attached to this Petition, we have provided the necessary information including zoning information, general location of the Site, legal description of the Site, 38 copies of plans stamped by a registered land surveyor and the $500 filing fee. We have also included a letter of support from New Cingular Wireless PCS, LLC d/b/a AT&T Mobility ("AT&T"). As you may know, AT&T is licensed by the FCC to provide personal wireless services throughout Massachusetts, including the Town of Agawam. FTP anticipates that AT&T will become the anchor tenant at the Site ifuItimately approved. Lastly, we have also included a letter of support from the Agawam Fire Department which indicates a clear public safety need for the tower and emergency communications in this area of the Town of Agawam. We respectfully suggest that the inclusion of the Site into the WTOC will satisfy the purpose as provided in section 180-94 of the Ordinance noted below. FTP and AT&T then searched for parcels in the area at the required elevation which could provide the necessary access and provide benefits to the community. In this instance, FTP was able to identify the Site owned by the Church. As noted above, the rear of the Site is located in the Business B zoning district, has the necessary elevation and access, and will provide the coverage needs for AT&T. The Site is well screened by the church building, associated facilities and the existing vegetation to the maximum extent possible. Lastly, the inclusion of the Site into the WTOD will assist the Town of Agawam in complying with its obligations under the federal Telecommunications Act of 1996.
