Subject: Form A -North West Street -Brown
It would appear from the plans presented that the land in question is to be attached to Mr.
Brown's current residence. The Statute in s. 14 provides for a change in ownership from a
parent to a child. Therefore, it is my opinion that the Town does not have a right of first refusal
as section 14 also states that such use, as a residence, does not affect the classification of the
land. However, all taxes would become due as the parcel being attached to the current residence
does not meet the statutory criteria to keep its 61A status as it is less than five acres. See M.G.L.
ch. 61A, § 3.
I spoke to AttomeySkolnick regarding the matter and informed him that I could not form
an opinion regarding the status of the remaining land.
