Notification of Implementation of Facility Improvements
Dear Mr. Hall:
Covanta Springfield hereby requests permission from the MADEP to conduct a 60-day evaluation of a
new feeder/screen, which our equipment suppliers assert may further improve the amount and
cleanliness of the recovered metals.
Over the course of a year, Covanta has designed and installed several metals recovery projects at our
various Energy-from-Waste (EfW) facilities. Based on gaining experience through operating these new
installations and also periodically evaluating the feedstocks, we have discovered that even after single-
stage ferrous and nonferrous recovery, there is still valuable metal remaining in the ash that can be
recovered. Based on this information, we are proposing to incorporate improvements in the Bondi Island
project design by running the inbound material through an initial pre-separation step, which involves use
of a feeder/screen. TIris feeder/screen will be located adjacent to the processing area and will allow for
the separation of larger ferrous metal up-front and lessen the magnetic interference with the other
equipment downstream. Additionally, we are proposing to add a new metering feeder to the beginning
of the process under the tension fabric structure that encloses the processing area. The metering feeder
will be equipped with a conveyor that is fitted with a cross belt magnet to allow for the recovery
additional ferrous metal. From the new cross-belt conveyor, material will be processed as normal
through the current system. The feeder/screen will be powered by a 30 horsepower (lIP) diesel engine.
The demonstration equipment is not anticipated to result in any additional fugitive emissions, or any
other additional environmental impacts.
In addition to increasing the amount of ferrous metal recovered by use of the new feeder/screener and
cross-belt magnet, the removal of the additional ferrous metal will also indirectly improve nonferrous

recovery. The eddy current separators are anticipated to experience less interference from ferrous pieces
that are not collected upstream, thus increasing nonferrous recovery.
The proposed changes are depicted on three (3) sketches: 1) lI26E-002SK (perspective views), l126E-
003SK (plan view), and 1126E-004SK (section views). These sketches, which have been certified by a
Massachusetts Professional Engineer, Mr. Christian Stanley) can be found in Attachment A.
Covanta Springfield proposes to evaluate the feeder/screen, metering feeder and cross-belt magnet
conveyor set-up for a trial period of sixty (60) days. Additionally, if the 60-day trial proves successful,
Covanta Springfield will submit an application to modify the referenced solid waste permit for the
project.
Also, Covanta Springfield has proposed to locate a mobile trailer on the northwest side of the Metals
Recycling System (main tension fabric building) to provide shelter and office space for our employees
working on the Landfill. A markup of the approved site plan showing the proposed location of the trailer
(Attaclilllent B) and a brief description of the trailer (size, color, planned use, etc.) is described below.
The trailer will be a 32x8 mobile office (Williams Scotsman M0328 or equivalent). The exterior finish
will be aluminum, with standard I-Beam frame and drip rail gutters. The specifications for the trailer can
be found in Attachment C.
I have notified the Building Inspector, PlalUung Board and Zoning Board of Appeals in the Town of
Agawam of our proposal and, at their request I am supplying each of them with a copy of this
submission for their records.

Dear Ms. Dachos,
Please accept this letter in response to your discussion with Mr. Gary Pierce on September 10, 2012
regarding revisions to the site plan associated with the Metals Recovery Project at the Bondi Island
Landfill. As discussed, enclosed are four (4) originals of the following revised drawing: Sheet OOl-SK,
Existing Site Conditions and Project Location Plan, 11108112, Rev. O.
Since the initial Special Permit approval in February, we have made advances on the design and
engineering of the metals recovery system, which includes some operational streamlining. As we have
progressed with engineering reviews, the proposed modifications that were previously described in the
initial submittal have been slightly modified to include these improvements. These changes include:
1. Total number of pieces of equipment is reduced compared to original submittal (reduced by 7)
a. Mobile Screener (I) replaces walking floor volumetric feeder (I) and finger deck grizzly (1)
b. Excavator with Magnet Attachment (I) replaces drum magnet (1)
c. There are two (2) less conveyors in the revised design
2. Operations would be streamlined slightly and the maintenance would be reduced (due to reduction in
pieces of equipment);
3. Electrical demand would also decrease (based on power demand for less equipment);
4. The redesign contemplates constructing the processing facility on the same footprint in Subcell 3A
in the SW corner of Cell 2; therefore, there is no change from original submittal.
5. The operations will still be enclosed in fabric structures; and will not exceed 7500 sq. ft. In fact, the
space will be slightly reduced, since one storage bay will be eliminated.
There will be no changes to environmental impacts since the original submittal due to the proposed
improvements to the metal recycling project design.
Ms. Jennifer Bonfiglio, Zoning Board of Appeals has also been advised of the revisions, and updated
drawings have been sent to her attention as well.

The City of Springfield is seeking Site Plan Approval for a proposed metals recycling facility on
Cell 2 of the Bondi Island Landfill footprint for the purpose of removing ferrous and non-ferrous
metal from the incoming ash residue streams. The proposed project is estimated to recover
approximately 4,000 tons of ferrous metal and 1,250 tons of non-ferrous metal products
annually, to be available for recycling. The operation will also save landfill space and effectively
extend the useful life of the landfill. A Special Permit Application seeking a modification to the
previously issued Special Permit (#1847) has also been submitted.

The City of Springfield is filing a Special Permit Application to modify the existing Special Permit #1847,
granted by the Agawam Zoning Board of Appeals on June 22, 2009. The purpose of the modification is
the installation of a new metals recycling facility on Cell 2 of the Bondi Island Landfill footprint for the
purpose of removing ferrous and non-ferrous metal from the incoming ash residue streams. The
proposed project is estimated to recover approximately 4,000 tons of ferrous metal and 1,250 tons of
non-ferrous metal products annually, to be available for recycling. The operation will also save landfill
space and effectively extend the useful life of the landfill. Attached to this form is supporting

1 General Information
1.1 Introduction
The City of Springfield ("Owner") is herein submitting a Special Permit Application for the
construction and operation of a metals recycling project on the Bondi Island Landfill footprint
for the purpose of removing ferrous and non-ferrous metal from the incoming ash residue
streams from third party municipal solid waste (MSW) combustors and transporting it off-site
for recycling. The metals recycling project will be operated by Covanta Springfield, LLC
("Covanta Springfield", or the "Operator"). Specifically, the recycled metal will originate from
the following sources: a) additional ferrous metal from ash residue generated by the Covanta
Springfield facility and the Pittsfield Resource Recovery Facility (PRRF); b) ferrous metal from
ash residue generated by the Covanta Energy-from-Waste (EfW) facility in Wallingford,
Connecticut; and c) both large and small size non-ferrous metal from all three EfW facilities.
Initially, the metals recycling project is planned to be located on the existing landfill in the
southwest corner of Cell 2. Because it is an active landfill, the metals recycling project will be
designed to be semi-portable, and may be relocated as Cell 2 landfilling operations progress.
1.2 Current Approvals
The most recent Special Permit (Case #1847) issued for the Bondi Island Landfill dated July 22,
2009 allowed for an expansion in the final closure height for the areas known as Celli and Cell
2 in the Bondi Island Landfill at the premises identified as the M Street Extension. A copy of this
most recent Special Permit can be found in Appendix E.
1.3 Process Description
The proposed project is estimated to remove approximately 4,000 tons of ferrous metal and
1,250 tons of non-ferrous metal products annually from residual ash from the Springfield,
Pittsfield and Wallingford EfW facilities, which would then be made available for recycling. In
addition to recycling these metals, the processing operation will provide the environmental
benefit of saving landfill space and effectively extending the useful life of the landfill.
The incoming residual ash will be unloaded into one of two storage piles, depending upon the
origin of the ash residue. Springfield and Wallingford ash residue will be stored together, while
Pittsfield ash residue will be stored separately since it is approved to be used for daily cover or
shaping and grading material. Once unloaded, the incoming ash residue will then be transferred
to process loading enclosure for feeding to the metals recycling operation. The inbound
material will be processed as it arrives or normally within 48 to 72 hours within receipt.

In the event that the inbound storage piles need to be enclosed due to weather conditions that
might impact the efficiency of the processing operation (such as, the material being excessively
wet due to rain or snow loading), a tension fabric enclosure will be considered as a future
addition, if necessary. The combined area of the "future" incoming residue storage enclosure is
considered separate from the processing equipment area and will be not exceed 7,500 square
feet in area.
Tension fabric structures are proposed to be used to enclose the metals recycling processing
equipment. It is proposed that the area comprising the metals recycling equipment, which
includes the process loading (walking floor feeder) structure, the main processing enclosure
and the metal product storage bunkers be counted as one "building" (due to the close
proximity to each other) and together will not exceed 7,500 square feet.
The metals recycling project will include the following processing equipment:
1) One (1) walking floor volumetric feeder;
2) One (1) finger deck grizzly (for large size material separation);
3) One (1) 6-foot diameter drum magnet (for ferrous metal recovery);
4) Two (2) vibratory feeders;
5) Two (2) Eddy Current Separators (ECS):
a) One (1) ECS to recover the large non-ferrous metal; and
b) One (1) ECS to recover smaller pieces of non-Fe (small non-Fe); and,
6) Miscellaneous belt conveyors.
Once the residual ash is processed through the metals recycling equipment, the recovered
ferrous metal and the non-ferrous metal products will be stored in three (3) separate bunkers
outside the main processing enclosure. The resulting ash residue after metals processing will be
transported to the designated cell in the landfill for final disposition by the end of each working
day.

No "new" landfill area is created by this project; the "footprint" of the Bondi Island Landfill will
not change as a result ofthe metals recycling project.
1.4 Fees
The Applicant has submitted a fee of $250.00 to the Agawam Zoning Officer in conjunction with
the Application. Proof of payment is provided as Appendix A.

The proposed metals recycling project will not be located within the 100-foot wetland buffer
zone. The project area will be graded and bermed as necessary to prevent any runoff from
flowing into the wetlands area.

2 Standards for Special Permits
This section of the Application provides an overview of the project's compliance with the Town
of Agawam's standards for reviewing applications for Special Permits, at Section 180-11(G) of
the Agawam Zoning Bylaw, which states:
(1) The Board of Appeals shall not approve any such application for a special use permit unless
it finds in its judgment all of the following conditions are met:
(a) The specific site is an appropriate location for such a use, building, structure or
services.
(b) The use as developed will not adversely affect the health, safety or property value of
the neighborhood.
(c) There will be no nuisance or potential hazard to vehicle or pedestrian safety.
(d) Adequate and appropriate facilities and controls will be provided for the proper and
safe operation ofthe proposed use or service.
2.1 Section 180-11(G)1a
The specific site is an appropriate location for such a use, building, structure or services.
The proposed metals recycling project will not substantially change existing uses or use
patterns at the site. The project will not affect off-site land or land use at a level greater than
the pre-existing landfill area. The project does not involve an increase to landfill capacity, and
there will be no increase in environmental, public health or safety impacts associated with the
project. The project is within previously Site Assigned and permitted landfill areas, and overlies
pre-existing landfill cells.
Since the metals recycling facility would be considered an "alternative use of assigned site",
pursuant to 310 CMR 16.21(3)(a), this project will not require a new site assignment
application.
310 CMR 16.21 Alternative Use of Assigned Site
(3) Specific Use Site Assignment. Where a site is assigned for a specific solid waste
purpose, a different solid waste activity shall not be conducted at the site except in
accordance with a new or modified site assignment, except as allowed at 310 CMR
16.21(3)(a) or (b) [emphasis addeQ]:
a) Recycling, Composting or Other Processing. Recvcling or composting may be
appraved at any assigned, permitted active disposal or handling facilitv without
reguiring a new or modified site assignment when such activity is integrated into
the assigned solid waste management operation and the tonnage limits, if any, for
recvcling or composting are not exceeded. After the solid waste facility ceases
operation the recycling or composting of solid waste shall not be permitted at the

site except in accordance with 310 CMR 16.21(3)(b) and the processing of
recyclable or compostable material shall not be permitted except in accordance
with a Department approval for post-closure use of the site.
Section 180-11(G)lb
The use as developed will not adversely affect the health, safety or property value of the
neighborhood.
Since the metals recycling facility would be considered an "alternative use of assigned site",
pursuant to 301 CMR l1.03(9)(a), and is therefore exempt from site assignment requirements,
it will not require a Massachusetts Environmental Policy Act (MEPA) review. This has been
determined based on the language found in 301 CMR 1l.03(9)(a) [with emphasis added) below.
301 CMR 11.00: MEPA REGULATIONS
Section 11.03: Review Thresholds. The review thresholds identify categories of Projects or
aspects thereof of a nature, size or location that are likely, directly or indirectly, to cause
Damage to the Environment. Except when the Secretary requires fail-safe review, the review
thresholds determine whether MEPA review is required. MEPA review is required when one or
more review thresholds are met or exceeded and the subject matter of at least one review
threshold is within MEPA jurisdiction. A review threshold that is met or exceeded specifies
whether MEPA review shall consist of an ENF and a mandatory EIR or of an ENF and other
MEPA review if the Secretary so requires. The subject matter of a review threshold is within
MEPA jurisdiction when there is full-scope jurisdiction (i.e., the Project is undertaken by an
Agency or involves Financial Assistance) or when the subject matter of the review threshold is
conceptually or physically related to the subject matter of one or more required Permits
(provided that the review thresholds for Land and Areas of Critical Environmental Concern shall
be considered to be related to the subject matter of any required Permit) or the area subject to
a Land Transfer. The review thresholds do not apply to: a lawfullv existing structure, facility or
activity; Routine Maintenance; a Replacement Project; or a Project that is consistent with a
Special Review Procedure review document, or other plan or document that has been prepared
with the express purpose of assessing the potential environmental impacts from future
Projects, has been reviewed as such in accordance with MEPA and 301 CMR 11.00, and has
been allowed or approved by any Participating Agency, unless the filing of an ENF and an EIR
was required by a decision of the Secretary on any such review document, plan or document.
The review thresholds are the following:
(9) Solid and Hazardous Waste.
(a) ENF and Mandatory EIR. New Capacity or Expansion in Capacity of 150 or more tpd
for storage, treatment, processing, combustion or disposal of solid waste, unless the
Project is a transfer station, is an Expansion of an existing facility within a validly site
assigned area for the proposed use, or is exempt fram site assignment requirements.

(b) ENF and Other MEPA Review if the Secretary So Requires.
1. New Capacity or Expansion in Capacity for combustion or disposal of any
quantity of solid waste, or storage, treatment or processing of 50 or more tpd of
solid waste, unless the Project is exempt from site assignment requirements.
2. Provided that a Permit is required in accordance with M.G.l. c. 210, New
Capacity or Expansion in Capacity for the storage, recycling, treatment or
disposal of hazardous waste.
The proposed metals recycling project will be housed in tension fabric enclosures. Following
metals recycling processing, all processed ash will be removed from the loading area and
transported to its final destination by the end of the operating day. In the event that dust, noise
or odor concerns do arise, the operators of the processing facility shall take immediate steps to
abate such nuisance conditions.
The metals recycling project may be powered by connecting to the existing utility power in the
vicinity, if feasible. If power is not available, the equipment will be powered by a 350-400 ekW
diesel generator set and associated power distribution equipment. The power distribution
equipment will be housed in a small electric power distribution and control enclosure (approximately
8-foot X is-foot in size), which will be located in close proximity of the metals recovery processing
equipment.
In the event that a diesel engine is necessary, it will be designed to operate at full load with a
maximum fuel consumption of 25 to 29 gallons per hour. low sulfur fuel oil will be used to
power the generator, which will be stored onsite in a 1,000-galion capacity aboveground
storage tank. The aboveground tank will be of double-walled construction. The fuel oil storage
tank will also be equipped with a filling nozzle to enable fueling of mobile equipment.
The diesel-fueled generator will be an insignificant source of air emissions, and will be designed
to meet applicable air emission requirements. An air permit will be obtained from MassDEP for
the generator, if necessary.
Mobile equipment exhaust emissions due to metals recycling operations will be equivalent to
existing site use. Diesel vehicles used during metals recycling operations will be equipped with
particulate traps or oxidation catalysts for air pollution control. Additionally, the metals
recycling processing will take place under cover in the tension fabric enclosures, which will also
help to minimize emissions.

There will be no nuisance or potential hazard to vehicle or pedestrian safety.
Nuisance
The following potential "nuisance" conditions have been evaluated for the construction and/or
operation of the project, along with mitigation or prevention measures:
• Noise -Construction and operation activities associated with the metals recycling facility
will not contribute to an increase in noise levels at the landfill. The proposed facility will
generate heavy equipment noise including engine, back-up alarm and truck gate noises,
which will be similar to current levels. Mitigation measures include:
o Limiting metals recycling processing operations from lam to lpm, five days per week
and Saturdays, when required; and,
o Housing the proceSSing equipment within a tension fabric enclosure.
o If a diesel generator set is required, the generator will also be equipped with a sound
attenuating muffler.
• Dust -Construction and operation at the site may generate occasional dust emissions.
Mitigation measures include:
o Utilization of a water spray tanker to wet landfill access roads and suppress dust
emissions;
o Periodic street sweeping on M Street by the City of Springfield DPW or the
construction contractor during periods of activity during the metals recycling facility
construction; and,
o Limiting truck travel speeds on facility access roads to minimize fugitive dust
emissions.
• Litter -None. The metals recycling project will not generate windblown litter. Materials
received at the facility for metals recycling will be limited to residual ash generated at the
Covanta Springfield facility, Pittsfield Resource Recovery Facility and other resource
recovery facilities.
• Vectors -None. As noted above for litter, inbound loads for the metals recycling facility will
be limited to residual ash. Residual ash is not an attractive to nuisance vectors such as birds,
flies or rodents.
• Odors -None. The residual ash to be disposed will not generate any landfill gas emissions
since the organic content of the source municipal solid waste (MSW) will have been
reduced to residual ash during the combustion process; thereby limiting the potential for
any anaerobic decomposition of the feed material to the metals recovery equipment. In the
unlikely event that nuisance odors are generated as a result of the metals recycling
operations, mitigation measures such as the use odor suppressants will be evaluated.
• Bird Hazards to Air Traffic -None. Residual ash and metal is not attractive to nuisance
vectors such as birds.
• Other Nuisance Conditions -None identified.

• Vehicle and Pedestrian Safety
•
•
Overall traffic impacts of the metals recycling project are minor and less than those previously
reviewed as part of the previous Bondi Island Landfill Special Permit applications. A 1979
Environmental Notification Form (ENF) for the Bondi Island Landfill expansion project
submitted to the Massachusetts Environmental Policy Act (MEPA) office estimated a traffic
impact of 100 vehicle trips. This traffic count accounted for the disposal of municipal solid
waste (MSW), waste water treatment plant (WWTP) biosolids, cover materials and residual ash
from Covanta Springfield. Traffic associated with waste disposal and cover materials for the Cell
2 vertical expansion outlined in the most recent Special Permit approval (dated July 22, 2009)
was estimated to be fifteen (15) vehicle round trips per day, which was a significant reduction
in the number of vehicle trips previously evaluated in the 1979 ENF.
Inbound residual ash traffic flow to the landfill will not increase as a result of the metals
recycling operations, since the same trucks that currently transport ash residue to the existing
landfill will transport the ash residue to the metals recycling facility instead of unloading
directly into the landfill. The average daily number of incoming ash truck round trips will remain
at approximately fifteen (15) round trips per day.
M Street in the City of Agawam serves the Bondi Island Landfill. There is no through traffic from
M Street in Agawam to Agawam Avenue in West Springfield. The Agawam Avenue intersection
is gated on M Street at the intersection. The City of Springfield owns M Street adjacent to the
landfill and limits traffic at the site to vehicles using the facility.
Road use for the hauling of residual ash from the nearby Springfield facility is limited to M
Street in the City of Agawam. Residual ash from the EfWs is delivered using the Massachusetts
Turnpike, Route 91 and Route 5 to M Street.
There are no adverse traffic impacts associated with the use of the site for the disposal of
residual ash generated at the adjacent Springfield facility, the Pittsfield Resource Recovery
Facility (PRRF) and the Covanta facility in Wallingford, Connecticut. Traffic patterns for residual
ash hauling from the Covanta Springfield facility are limited to round trip direct route from the
facility on M Street to the landfill and back, a one-way distance of approximately 2,000 feet.
Traffic patterns for Pittsfield and Wallingford residual ash are primarily limited to state
highways. Continued use of the site for disposal of residual ash will limit off-site hauling of
Pittsfield and Wallingford residual ash to distant waste disposal sites.
As a result of the metals recycling facility, a slight increase in truck traffic exiting the landfill is
expected due to the transportation of the outbound ferrous and non-ferrous metal products to
third party recyclers; however, this slight increase is not anticipated to have any adverse impact
on daily traffic patterns in any way. It is anticipated that the proposed metals recycling project
will result in an additional average daily increase of approximately two (2) truck round trips,
which will be associated with transporting processed bottom ash and recovered metals
products for reuse/recycling. Overall, this is significantly less than the number of vehicle trips

previously evaluated for the 2009 vertical expansion project and those estimated in the 1979
ENF. The outbound metal trucks are expected to follow the same traffic patterns and use the
same highways in the vicinity of the landfill as the residual ash haulers
2.4 Section 180-11(G)ld
Adequate and appropriate facilities and controls will be provided for the proper and safe
operation of the proposed use or service.
The proposed project will not result in a significant increase or release of pollutants at the
landfill. If power is not locally available, and has to be supplied by a diesel generator set, low
sulfur diesel fuel will be used to run the generator, which will be equipped with air pollution
control equipment, and located in a sound attenuating enclosure.
With respect to fire hazards, the potential for fire is minimal. The tension fabric enclosures will
be designed to comply with NFPA 701, Method 1 and Method 2. A technical data sheet for a
typical fabric enclosure can be found in Appendix D.
The incoming ash residue stream to be processed through the metals recovery equipment is
comprised mainly of noncombustible material. Additionally, flammable or combustible
materials, such as oils or greases are not anticipated to be stored in fabric enclosures.
Furthermore, it is anticipated that typically two employees, one loader operator and one other
operator will be working inside the processing enclosure as necessary. In the unlikely event of a
fire, the fabric equipment enclosure will be designed in such a way that it would be easy for
occupants to escape.
No wastewater discharges are anticipated to be generated as a result of the proposed metals
recycling operations.
The metals recycling project area will be graded and bermed in such a way to prevent
storm water runoff into the wetland area.
It is not anticipated that the metals recycling project will impact any wetlands, streams,
drainage swales or areas subject to flooding, since the existing landfill is not located in the 100-
foot wetlands buffer or inside the wetlands area.
The City and Operator will maintain the facility in conformity with current MassDEP regulations
designed to eliminate or mitigate potential impacts to the environment, public health or safety.

The Board of Appeals conducted several public hearings and concluded with a public meeting on
Jmle 22, 2009 at the Agawam Public Library Community Room, 750 Cooper Street, Agawam,
MA for all parties interested in the appeal of the City of Springfield, Department of Public
Works, which is seeking a Special Permit in accordance with Section 180-55, Paragraph B (12)
of the Zoning Ordinances which would allow an expansion in the final closure height for the
areas known as Cell I and Cell 2 in the Bondi's Island Sanitary Landfi II at the premises
identified as M Street Extension.
After the public hearings and after a thorough review of the facts presented at the public hearings
and an "on-site" inspection, the Agawam Board of Appeals made the following findings:

2. The petitioner proposes several changes to the area known as the landfill. The height of Cell
2 will be increased from 107 feet msl to a maximum elevation of 142 feet msl, which will
include the area of the WMECO overhead electric transmission lines. The height of Cell 1 in
the Town of Agawam and the Town of West Springfield will be increased from 138 feet msl
to a maxinmm elevation of 142 feet ms!.
3. These combined increases will create an approxinlately 28-acre surface for post-closure use.
4. The requested increase in the height of Cell 2 will provide 7.5 to 11 .5 years of additional
lined waste disposal capacity for the residual ash disposal from waste-to-energy facilities and
contaminated soils as approved by the MassDEP.
5. MassDEP issued a Positive Determination of Site Suitability on November 10, 2008 for this
proposed project.
6. The Connecticut River Watershed CouncH, in a memo dated October 3,2008 to MassDEP
stated: " in general, CRWC has not identified major concerns with the expansion plans ~ c

10. A memo received, dated March 25,2009, from Sgt. Richard Niles, Safety Officer for the
Town of Agawam stated: .. it would appear this project would have little negative impact to
pedestrian, bicycle and/or motor vehicle traffic safety".
11. This specific site, which is a landfill, is an appropriate site for the proposed use.
12. Approvals from the above mentioned departments and boards will help ensure that the
proposed project will not adversely affect the health, safety or property values of the
neighborhood.
13. As cited in Sgt. Niles memo, this proposed project will be of no nuisance or potential hazard
to vehicle or pedestrian safety.
14. Adequate and proper facilities and controls will be provided for the proper and safe operation
of the proposed project through the conditions place upon it by the various agencies and
board involved in the permitting of this project.
15. This specific.use is not considered so objectionable or obnoxious that the proposed use would
be against-the public interest or detrimental or injurious to the character of the neighborhood.
Based on its findings, the Board is of the opinion that the requested reliefis within the authority
of the Board of Appeals to grant a Special Permit as stated under Section 180-55, Paragraph B
(12) of the Zoning Ordinances of the Code of the Town of Agawam.
Now, therefore, by the unanimous vote of its three members, the Board of Appeals hereby grants
the petitioner a special permit to allow an expansion in the final closure height for the areas
known as Cell 1 and Cell 2 with the following conditions:
1. The final closure height for the areas know as Cell 1 and Cell 2 shall be no higher than
142 feet ms!.
2. The City of Springfield shall notify this Board of any changes in the operation and/or
ownership of this facility.
3. This landfill is to be used solely for residual ash disposal from waste-to-energy facilities
and contaminated soils as approved by MassDEP.
4. The proposed project shall not extend beyond the footprint of the existing landfill.
5. The petitioner shall maintain the trees and appropriate vegetation along the buffer area
and Route 5 along with the entrance of the landfill along Route 5.
6. Ecological assessments will be undertaken, and if adverse ecological impacts have arisen
from the operations of the landfill, measures shall be taken to lessen or reverse these
impacts, as advised by the Connecticut River Watershed Council and MassDEP.
7. The petitioner shall record with the Hampden County Registry of Deeds, a "Notice of
Special Permit" fonn, which shall be provided by this Board and proof of said filing must
be submitted to this Board and to the Inspector of Buildings.
8. This special permit shall become null and void if construction authorized by this special
permit is not commenced within two (2) years from the date this decision is stamped by
the Town of Agawam Clerk's office.
This decision is subject to appeal in accordance with M.G.L. Ch. 4OA, Section 17 within 20 days
after this decision is med with the Agawam Town Clerk.

SITE ASSIGNMENT DECISION
INTRODUCTION
Based upon the findings set forth below and pursuant to M.G.L. c. 111, §
lSOA and 310 CMR 16.00 et. seq., the Town of Agawam Board of Health (the
"Board") hereby modifies the site assignment for thirty (30) acres of land along M
Street (the "Site") to allow a vertical expansion of the landfill for continued disposal
of resource recovery ash (i.e. ash from the combustion of municipal solid waste).
This site assignment is subject to the conditions set forth herein.
STANDARD FOR DECISION
As set forth in 310 CMR 16.Z0(1O)(k)(Z), U[a) board [of health) shall
determine that a site is suitable for assignment as a site for a new or expanded solid
waste facility unless it makes a finding, supported by the record of the hearing, that
the siting thereof would constitute a danger to the public health, safety or
enVironment, based on the siting criteria set forth and established under 310 CMR
16.40."

THE SITE
The site is located at M Street, which is at the intersection of M Street and
Route 5 in Agawam. The record contains evidence that the site had previously been
found suitable for the disposal of solid waste; that facility has been operating as a
solid waste disposal facility since approximately 1970 serving the communities of
Agawam, Springfield and West Springfield. The area of modified site assignment will
be the entire 30-acre site of the so-called Cell 2, the Powerline Easement areas and
the eastern side slope of Cell 1.
Abutting the proposed facility on the east is Highway Route 5 with the
Connecticut River further east beyond Route 5, on the south is the Westfield River,
on the west is Agawam Avenue and on the north is M Street with a large power
generation facility on the north side of M Street.
DEP Report On Site Suitabilitv
On August 6, 2008 the Applicant submitted to the Massachusetts Department
of Environmental Protection ("MADEP") a Site Suitability Report Application MADEP
Transmittal # W125063 for the vertical expansion of the facility (which application is
dated August 2008). The MADEP determined that the proposal met each of the
facility-specific suitability criteria and each of the general suitability criteria and
issued a Positive Determination of Site Suitability on November 10, 2008'.
Hearings
On April 7, 2009, the Board conducted a public hearing pursuant to M.G.L. c.
111, §150A to determine whether the Site was suitable for a vertical expansion for
the disposal of resource recovery ash. Notice was properly given for the hearing
pursuant to 310 CMR 16.20(7). The Board deSignated Attorney Christopher C.
Johnson as the hearing officer for the hearing in accordance with 310 CMR 16.20.
The hearing was held in the Agawam Public Library in the meeting room and
conducted in one evening. Oral testimony was received from three eXPert
witnesses: Mr. Gary Pierce, Covanta Berkshire Operations, LLC; Mr. Dana Huff, Tighe
& Bond, Inc.; and Mr. Jeffery Thelen, Tighe & Bond, Inc .•
I Prior to the hearing, the Applicant waived the requirement of 3 10 CMR 16.20(7)(a) of the MADEP's
rules on public hearings for site assignments, that the Board of Health commence a public hearing pursuant
to 310 CMR 16.40 within thirty (30) days of receipt of the MADEP's Report on Suitability.

On May 21, 2009, at a duly posted meeting, the Board deliberated on the
Application and voted to issue the site assignment, based upon the following findings
and subject to the conditions listed below:
FINDINGS REGARDING SITE SUITABILITY CRITERIA
Specific Criteria for Landfill Facilities (310 CMR 16.40(3)(a)
1. No site shall be determined suitable or be assigned as a landfill
facility where the waste handling area would be within a Zone II
area of an existing public water supply well.
The waste deposition area will not be located within a Zone II area of
any public water supply. Oral testimony by Jeffery Thelen and the
November 10, 2008 findings of the Department of Environmental
Protection found that the site is not within a Zone II. The Board finds
that the site meets this criterion.
2. No site shall be determined to be suitable or be assigned as a
landfill facility where any area of waste deposition would be
within the Interim Wellhead Protection Area (IWPA) of an existing
public water supply provided the proponent may conduct a
preliminary Zone II study, approved by the Department, to
determine if the facility would be beyond the Zone II of the public
water supply well in question;
The waste deposition area will not be located within the IWPA or a Zone
II of any public water supply. Oral testimony by Jeffery Thelen and the
November 10, 2008 findings of the Department of Environmental
Protection found that the site is not within a Zone II. The Board finds
that the site meets this criterion.
3. No site shall be determined to be suitable or be aSSigned as a
landfill facility where any area of waste deposition would be
within a Zone II or Interim Wellhead Protection Area (IWPA) of a
proposed drinking water source area, provided that the
documentation necessary to obtain a source approval has been
submitted prior to the earlier of either the site assignment
application, or if the MEPA process does apply, the Secretary's
Certificate on the Environmental Notification Form or Notice of

Project Change, or where applicable the Secretary's certificate on
the EIR or Final EIR;
Massachusetts DEP's GIS Mapping shows that the site is not within an
IWPA or a Zone II for an existing or proposed public drinking water
supply well. Oral testimony by Jeffery Thelen and the November 10,
2008 findings of the Department of Environmental Protection found that
the site is not within a Zone II or IWPA. The Board finds that the site
meets this criterion.
4. No site shall be determined to be suitable or be assigned as a landfill
facility where any area of waste deposition would be within 15,000
feet upgradient of the existing public water source well or proposed
drinking water source area for which a Zone II has not been
calculated; the proponent may conduct a preliminary Zone II study,
approved by the Department, to determine if the facility would be
beyond the Zone II of the public water supply well or proposed
drinking water source area in question;
The waste depOSition area will not be located within 15,000 feet
upgradient of an existing public water source well or within a Zone II of
any public water supply or proposed drinking water source area. Oral
testimony by Jeffery Thelen and the November 10, 2008 findings of the
Department of Environmental Protection both found that the site is not
within 15,000 feet upgradient of an existing public water source well or
within a Zone II of any public water supply or proposed drinking water
source area. The Board finds that the site meets this criterion.
5. No site shall be determined to be suitable or be assigned as a landfill
facility where it is determined by the Department that a discharge
from the facility would pose a danger to an existing or proposed
drinking water source area;
The waste deposition area will not discharge such that it would prose a
danger to an existing or proposed drinking water source area. Oral
testimony by Jeffery Thelen and the November 10, 2008 findings of the
Department of Environmental Protection both support this finding. The
Board finds that the site meets this criterion.

6. No site shall be determined to be suitable or be assigned as a landfill
facility where the waste handling area would be over the area of a
Sole Source Aquifer, unless all the following criteria are met:
a. There are no existing public water supplies or proposed
drinking water source areas downgradient of the site;
b. There are not existing or potential private water supplies
down gradient of the site; however, the applicant may have
the option of providing an alternative public water supply to
replace all the existing or potential downgradient private
groundwater supplies; and
c. There exists a sufficient existing public water supply or
proposed drinking water source area to meet the
municipality's projected needs;
The waste deposition area will not be located over a Sole Source Aquifer.
Oral testimony by Jeffery Thelen and the November 10, 2008 findings of
the Department of Environmental Protection both support that the facility
will not be over a Sole Source Aquifer. The Board finds that the site
meets this criterion.
7. Any area of waste deposition is within the zone of contribution of an
existing public water supply or proposed drinking water source
area, or the recharge area of a surface drinking water supply,
pursuant to a municipal ordinance or by-law enacted in accordance
with M.G.L. c.40A, §9;
Oral testimony by Jeffery Thelen and the November 10, 2008 findings of
the Department of Environmental Protection provided evidence that
there are no existing public water or proposed drinking water sources or
recharge areas in the vicinity of the Landfill. The Site lies within a
designated Non-Potential Drinking Water Source Area. The Board finds
that the site meets this criterion.
8. Any area of waste deposition would be within the Zone A or Zone B
of a surface drinking water supply;
Oral testimony by Jeffery Thelen and the November 10, 2008 findings of
the Department of Environmental ProtectiOn both found that the waste
deposition area will not be located within the Zone A or Zone B of a

surface drinking water supply. The Board finds that the site meets this
criterion.
9. Any area of waste deposition would be less than 400 feet
upgradient, as defined by groundwater flow or surface water
drainage, of a perennial water course that drains to a surface
drinking water supply which is within one mile of the waste
deposition area;
The waste deposition area will not be located within 400 feet upgradient
of a perennial water course that drains to a surface water drinking supply
which is within one mile of the waste deposition. Oral testimony by
Jeffery Thelen and the November 10, 2008 findings of the Department of
Environmental Protection both substantiate this finding. The Board finds
that the site meets this criterion.
10. Any area of waste deposition would be within a Potentially
Productive Aquifer unless:
a. the proponent demonstrates to the Department's satisfaction,
based on hydrogeological studies, that the designation of the
area as a potentially productive aquifer is incorrect;
b. the proponent demonstrates to the Department's satisfaction,
based on hydrogeological studies, that the aquifer cannot
now, nor in the reasonably foreseeable future, be used as a
public water supply due to existing contamination of the
aquifer, or
c. the area has been excluded as "Non-Potential Drinking Water
Source Area" pursuant to 310 CMR 40.0932, or as otherwise
defined at 310 CMR 40.0006: The Massachusetts Contingency
Plan.
Oral testimony by Jeffery Thelen and the November 10, 2008 findings of
the Department of Environmental Protection both found that the site is
not located within a Potential Productive Aquifer. The Landfill is in a
designated Non-Potential Drinking Water Source Area. The Board finds
that the site meets this criterion.
l1.Any area of waste deposition would be within 1000 feet upgradient,
and where not upgradient, within 500 feet, of a private water supply

well existing or established as a potential supply at the time of
submittal of the application; provided, however, the applicant may
show a valid option to purchase the restricted area, including the
well and a guarantee not to use the well as a drinking supply, the
exercise of which shall be a condition of any site assignment.
The waste deposition area will not be located within 1,000 feet
upgradient, and where not upgradient, within 500 feet of a private water
supply weli existing or established as a potential supply. Oral testimony
by Jeffery Thelen and the November 10, 2008 findings of the
Department of Environmental Protection both found that the site
complies with this criterion. The Board finds that the site meets this
criterion.
12.The maximum high groundwater table is within four feet of the
ground surface· in areas where waste deposition is to. occur or,
where a liner is designed to the satisfaction of the Department,
within four feet of the bottom of the lower-most liner;
The lowest point of the waste deposition will not be within 4 feet of the
maximum high groundwater table. Oral testimony by Jeffery Thelen and
the November 10, 2008 findings of the Department of Environmental
Protection both found that the lowest point of the waste deposition will
not be within four (4) feet of the maximum high groundwater table. The
Board finds that the site meets this criterion.
13. The outermost limits of waste deposition or leachate containment
structures would be within a resource area protected by the
Wetlands Protection Act, M.G.L. c.131, § 40, including the 100 year
floodplain;
Oral testimony by Jeffery Thelen and the November 10, 2008 findings of
the Department of Environmental Protection both found that the waste
deposition area or leachate containment structures will not be located
within a resource area protected by the Wetlands Protection Act, M.G.L.
§ 40, including the 100 year floodplain. The Applicant has filed a formal
Request for Determination of Applicability with the Agawam Conservation
Commission. The Board finds that the site meets this criterion.

14.Any area of waste deposition or the leachate containment structures
would be less than 400 feet to a lake, or 200 feet to a Riverfront
Area as defined in 310 CMR 10.00, that Is not a drinking water
supply;
The waste deposition area or the leachate structures will not be located
within 400 feet of a lake, or within 200 feet of a Riverfront. Oral
testimony by Jeffery Thelen and the November 10, 2008 findings of the
Department of Environmental Protection confirm that the site complies
with this criterion. The Board finds that the site meets this criterion.
lS.Any area of waste deposition would be within 1000 feet of an
occupied residential dwelling, health care facility, prison,
elementary school, middle school or high school or children's pre-
school,. licensed day care center, senior center or youth center,
excluding equipment storage or maintenance structures; provided,
however, that the applicant may show a valid option to purchase the
restricted area, the exercise of which shall be a condition of any site
assignment;
The waste deposition area will not be located within 1,000 feet of any of
the facilities listed in the criterion above. Oral testimony by Jeffery
Thelen and the November 10, 2008 findings of the Department of
Environmental Protection both confirm that the site complies with this
criterion, The Board finds that the site meets this criterion.
16. Waste deposition on the site would result in a threat of an adverse
impact to groundwater through the discharge of leachate, unless It
is demonstrated to -the satisfaction of the Department that a
groundwater protection system will be incorporated to prevent such
threat.
The waste deposition area for the vertical expansion will be completely
contained on top of a groundwater protection system meeting the
groundwater protection requirements established in the Solid Waste
Management Regulations 310 CMR 19.110, Ground Water Protection
Systems and the approval of the MADEP. Oral testimony by Jeffery
Thelen and the November 10, 2008 findings of the Department of
Environmental Protection both confirm that the site will meet this
criterion. The Board finds that the site meets this criterion.

General Site Suitability Criteria 310 CMR 16.40(4)
17. Agricultural Land: No site shall be determined to be suitable or
be assigned as a solid waste management facility where: 1. the land
Is classified as Prime, Unique, or of State and Local Importance by the
United States Department of Agriculture, Natural Resources
Conservation Service; or 2. the land is deemed land Actively Devoted
to Agricultural or Horticultural Uses, except where the facility is an
agricultural composting facility; and 3. a 100 foot buffer would not be
present between the facility and those lands classified at 310 CMR
16.40(4)(a}1. or 2.
The waste deposition area will not be located within Agricultural or
Horticultural lands. Oral t estimony by Jeffery Thelen and the November
10, 2008 findings of the Department of Environmental Protection found
that the site is not within Agricultural or Horticultural lands. The Board
finds that the site meets this criterion.
18. Traffic and Access to the Site: No site shall be determined to be
suitable or be assigned as a solid waste management facility where
traffic impacts from the facility operation would constitute a danger
to the public health, safety, or the environment taking Into
consideration the following factors:
1. traffic congestion;
2. pedestrian and vehicular safety;
3~ road configurations;
4. alternate routes; and
5. vehicle emissions
The record contains evidence that the landfill will not constitute a danger
to public health, safety, or the environment with respect to the 5 criteria
listed above. Oral testimony by Jeffery Thelen and the November 10,
2008 findings of the Department of Environmental Protection found that
the site is meets this criterion. The Board finds that the site meets this
criterion.
19. Wildlife and Wildlife Habitat: No site shall be determined to be
suitable or be assigned as a solid waste management facility where

such siting would: have an adverse impact on Endangered,
Threatened, or Special Concern species listed by the Natural Heritage
and Endangered Species Program of the Division of Fisheries and
Wildlife in its database; have an adverse impact on an Ecologically
Significant Natural Community as documented by the Natural
Heritage and Endangered Species Program in its database; or have an
adverse impact on the wildlife habitat of any state Wildlife
Management Area.
The landfill facility will have no adverse impact on endangered, threatened
of special concern species listed by the NHESP, ecologically significant
communities, or wildlife habitat of any Wildlife Management Area. The
oral testimony by Jeffery Thelen and the November 10, 2008 findings of
the Department of Environmental Protection found that the site will
conform to this criterion. The Board finds that the site meets this
criterion.
20~ Areas of Critical Environmental Concern: No site shall be
determined to be suitable or be assigned as a solid waste
management facility where such siting: would be located within an
Area of Critical Environmental Concern (ACEC), as designated by the
Secretary of the Executive Office of Environmental Affairs; or would
fail to protect the outstanding resources of an ACEC as identified in
the Secretary's designation if the solid waste management facility is
to be located outside, but adjacent to the ACEC.
Both the oral testimony of Jeffery Thelen and the November 10, 2008
findings of the Department of Environmental Protection confirmed that
the site will not be located within or adjacent to an Area of Critical
Environmental Concern. The Board finds that the site meets this
criterion.
21. Protection of Open Space: No site shall be determined to be
suitable or be assigned as a solid waste management facility
where such siting would have an adverse impact on the physical
environment of, or on the use and enjoyment of:
