You have asked if Private Garages are allowed in Residence B zones.
The relevant section is quoted here:
§ 180-31. Peiiiliitted uses.
In any Residence B District as indicated on the Building Zone Map, no building or other structure
shall be erected, altered or used and no land shan be used or occupied for any other
purpose except one or more of the following:
G. Private garages, provided that no busi-, seJVice or industry is conducted tt.eteftom or
therein. Not more than one motor vehicle shall be kept for each 2,500 square feet of lot
area, except that three vehiclas may be kept, in any case, not more than one of which
may be unregistered. Only one such vehicle may be a c:ommen:ial vehicle of not more
than 1112 tons· weight of c:apacity. Space shall not be leased or ranted for a co".,liHcial
vehicle. No commercial vehicle shall be parked on a lot in the open. 1besa space
regulations shall apply to vehicles regularly left on the lot, whether housed or in the
open.
It would appear from the text that "private garages" are allowed as long as "no business, seNice or
industry is conducted therefrom or therein." In analyzing the language of a statute, the courts in
Massachusetts have consistently held that "A statute is to be construed as written, in keeping with its
plain meaning. Town of Canton c. Commissioner of Massachusetts Highway Department, 455 Mass.
783 (2010) See also Foster v. mayor of Beverly, 315 Mass. 567 (1944) stating that "the words of [an]
ordinanoe must be construed according to their natural import in common and approved usage."
It is evident that the sentenoe, "Private garages, provided that no busi-, seJVica or industry is
conducted theoe"om or therein.", as constructed shows, a "comma" after "garage." Therefore any
language remaining is simply modifying the term "private garages." Therefore, ~ is my opinion that private
garages are allowed in the residenoe B zone, but may not be used for business, service or industrial
purposes.

To all parties NOTED above. This letter is a formal WITH DRAWL of
ALL previous "Special Permit" and 'Variance" applications that I was
told I had to file regarding 1710 Main SI. parking 101.
Please remove 171 a Main SI. and the name Sullivan from the Public
hearing agenda scheduled for this Thursday, August 2, 2012 @ 7 pm at
the Public Library.
Also I am formally requesting that The Board of Appeals cancel
the 6:30 PM Public hearing regarding 1710 Main SI. that is scheduled
for Monday August 13th, 2012@the Public Library.
