They had previously, informally, told the owner of the flea market (Tracey Bryson) that they would not require the installation of a crosswalk. I explained that there were a lot of cars parking in the Southworth parking lot and expressed my concerns over the safety of those crossing the road. They will be requesting that Tracey formally submit an application for a crosswalk which will then be reviewed by their Engineering Department. After the public hearing and a thorough review of the facts presented, the Agawam Board of Appeals made the following findings: 1. The subject property is located in an area of town zoned Industrial A. 2. The petitioner wishes to create a flea market and will be using the back half of the existing structure. 3. The existing structure is a legal nonconforming structure. 4. Section 1800-64 (B) of the Town of Agawam's Zoning Ordinances states: "Front setbacks shall be a minimum of75 feet". 5. The existing structure has a front setback of 14 feet in its least dimension. 6. There will be no outside dimensional changes to the existing structure. 7. The petitioner is applying for a change of use in the existing nonconforming structure, from industrial to mercantile. 8. Section 180-70 of the Town of Agawam's Zoning Ordinances shall apply to any change of use and to any alteration of a building or structure when the same would amount to reconstruction, extension or structural change. 9. Section 180-7 (3) of the Town of Agawam's Zoning Ordinances allows for a legal nonconforming structure to be changed to a more restricted use. 10. The hours of operation shall be Saturday and Sunday from 6am to 4pm. 11 . The Agawam Planning Board recommended the approval of the site plan on June 6, 2013. 12. There shall be no greater an encroachment than that which already exists. 13. The location of the flea market is appropriate for such a use which is in an Industrial A district. 14. No evidence was presented to this board showing that the use, as developed, will have an adverse affect on the health, safety or property values of the neighborhood. 15. No evidence was presented to this board showing that there will be any nuisances or potential hazards to vehicular or pedestrian safety. • DECISION (Page 2) 270 Main Street Flea Market, Inc. Case # 1916 • 16. The proposed flea market will meet all building regulations providing adequate and appropriate facilities and controls for the proper and safe operation ofthe proposed use. 17. No evidence was presented to this board showing that the proposed use would be considered so objectionable or obnoxious that the proposed flea market would be against the public interest or detrimental or injurious to the character of the neighborhood. Based on its findings, the Agawam Zoning Board of Appeals is of the opinion that it is within the authority of the board to grant a special permit as stated under Section 180-7 of the Town of Agawam's Zoning Ordinances. Now, therefore, by a unanimous vote of its three members, the Agawam Zoning Board of Appeals hereby grants the petitioner a special permit to allow for a flea market with the following conditions: 1. The proposed flea market shall be done in accordance with the site plan submitted, entitled "Change of Use-Industrial to Mercantile-270 Main St., Agawam, MA", prepared by Chaffin Associates, revision date June 5, 2013 and signed by the members of this board. 2. This special permit is for the proposed flea market only. 3. All necessary permits relative to the occupancy permit must be obtained. 4. All comments/concerns expressed by the Agawam Planning Board must be addressed. 5. The petitioner shall record with the Hampden County Registry of Deeds, a "Notice of Special Permit" form wruch shall be provided by this board and proof of said filing must be submitted to this board and to the Inspector of Buildings. 6. This special permit shall become null and void if construction does not commence withln two (2) years from the date of this decision. This decision is subject to appeal in accordance with M.G.L.Chapter 40A, Section 17 within 20 days from the date this decision is filed with the Agawam Town Clerk. The walkway needs to stay at or below 5% grade or it will need to either be reconstructed or meet ADA/ AAB standards for a ramp (railings, landing areas, etc.). Engineering can take a look at the gravel grade before you pave if you would like, however, paving is not as precise as concrete, so extra care will need to be made during construction. 2. The accessible spaces will need to be the same width as the standard parking spaces. 3. The first parking space closest to Main Street needs to moved further away from the entrance. There is a concern that vehicles backing out of this space could potentially cause an accident to occur with vehicles entering the site or with vehicles on Main Street. 4. The area in front of the building needs to be in compliance with the sight distance plan prepared by Fuss and O'Neill. Fuss and O'neill or other professional engineer will need to certify that the sight distance requirement has been met prior to the issuance of the certificate of occupancy. The existing curbcut was suggested to be a one way in with either the exit on to Cooper Street or an exit on the Main Street on the southerly frontage of the property. Neither have been shown. The existing curb cut appears to have safety concerns. The change in use and/or a relocation of the curbcut will require a permit from MassDOT. Parking: Planning will defer to Engineering on the parking lot design. There are 302 spaces shown. 291 spaces are required for just the Flea Market.
