The Board of Appeals conducted a public hearing and meeting on January 27, 2014 for all parties
interested in the appeal of CHristina Maguire, who is seeking a Special Permit in accordance with
Section 180-7, Paragraph B(2) of the Town of Agawam's Zoning Ordinances which would allow for the
enlargement of a lot found to be nonconforming at the premises identified as 19 Alhambra Circle South.
After the public hearing and a thorough review of the facts presented, the Agawam Board of ~eals

1. The subject property is located ·inan area of town zoned ResidentialA"2.
2. The subject property is an existing legal nonconforming lot.

3. Residence A-2 requires "a frontage of not less than 110 feet nor an area ofless than IS,OOQ=square
feet". (Section 180-27 of the Town of Agawam's Zoning Ordinances) a .. 4. The subject property currently has a frontage of 77.3' and a lot size of 8,250 square feet.
S. The petitioner wishes to enlarge the subject property by a total of 1200 square feet.
6. The 1200 square footage would be taken from a newly created abutting lot in which two
nonconforming lots would be merged to create this conforming lot.

7. One of the current abutting properties is owned by the petitioner at 0 River Rd and the other lot by
the petitioner's father, Mr. Joseph Liberatore, at 1099 River Rd.
8. A memo from Sgt. Donald Gallerani, Agawam Safety Officer, dated January 14,2014, was received
by this board. He states this petition "will have no impact on pedestrian or motor vehicle safety".
9. Section 180-7, Paragraph B (2) allows land to be enlarged in that use, but only after the granting ofa
permit thereof by the Board of Appeals.
10. The residential use of the subject property in a residential neighborhood is an appropriate location.
11. Keeping the use as residential in a residential neighborhood will not adversely affect the health,
safety or property value of the neighborhood.·
12. There will be no nuisance or potential hazard to vehicle or pedestrian safety.
13. Adequate and appropriate facilities and controls are provided for the proper and safe operation of the
proposed use.
14. This special permit is not considered so objectionable or obnoxious that the proposed use would be
against the public interest or detrimental or injurious to the character of the neighborhood.

Based on its findings, the Agawam Zoning Board of Appeals is ofthe opinion that it is within the
authority of the board to grant a special permit as stated under Section 180-7 (B2) of the Town of
Agawam's Zoning Ordinances.
Now, therefore, by a unanimous vote of its three members, the Agawam Zoning Board of Appeals
hereby grants the petitioner a special permit to allow for the enlargement of the subject property with the
following conditions:
I. The addition ofl,200 s.f. ofland to the subject property is contingent on 0 River Rd. and 1099 River
Rd merging to create a new conforming lot.
2. A copy of all new deeds must be submitted to this board and to the Inspector of Buildings.
3. The petitioner shall record with the Registry of Deeds, a "N olice of Special Permit" form, which sha11
be provided by this board and proof of said filing must be submitted to this board and to the Inspector
of Buildings.
4. This special permit shall become null and void if action does not commence within two (2) years from
the date of this decision.
This decision is subject to appeal in accordance with M.G.L.Chapter 40A, Section 17 within 20 days
from the date this decision is filed with the Agawam Town Clerk.
