Upon submIssIon of an application for a zone change to add a parcel to the Wireless Telecommunications Overlay District under thIs article, the applicant shall pay a review fee determined by the aty Council, consisting of reasonable costs to be Incurred by the Oty Council for the employment of Independent consultants. This will allow the Council to utilize experts to assist in determining whether the parcel should be added. The provision exists for the Board of Appeals in the special permit process but leaves the Council on its own when dealing with zone change requests. Below you will find a brief summary of such legal process. Receiving Submission of Proposed Change in Zoning Ordinances To initiate a change in zoning ordinances, submission of the proposed change may be given to the City Council by a City Council , board of appeals, an individual owning land that will be affected by the change, by request of registered voters of Agawam pursuant to MGL c. 39 § 10, by ten (10) registered voters in Agawam, by a planning board, or by a regional planning agency. Within fourteen (14) days of receiving the zoning ordinance, the City Council shall submit it to the Planning Board for review. , Public Hearing on Proposed Changes The Planning Board and the City Council must hold a public hearing together, or separately, to elicit public comment, which hearing must be held within sixty-five (65) days after the proposal is submitted to the City Council. Notice of the public hearing must include the time and place of the hearing, the subject matter of the hearing, sufficient for identification, and of the place where texts and maps of the proposed zoning ordinance change may be inspected. Such information must be made available by publication in a newspaper of general circulation in Agawam once in each of two successive weeks. The first publication must not be less than fourteen (14) days before the day of the public hearing. Notice must also be posted in a conspicuous place in the town hall for a period not less than fourteen (14) days 1 before the date of th.aring. Notice of the hearing must als. sent via mail, postage prepaid, to the department of housing and community development, the regional planning agency, and to the planning board of each abutting city and town. The council voted unanimously Monday to add the proposed tower site at 459 Mill St. to the town's list of wireless telecommunications overlay districts. The town code related to cell tower locations reads, "The Wireless Telecommunications Overlay District is intended to protect the scenic, historic, natural and other resources of the town of Agawam while allowing adequate personal wireless telecommunications to be developed." There are currently nine sites and 52 land parcels in Agawam that fall under that category. Verizon hopes to install a lOO-foot cellular tower on Mill Street, which would potentially provide significant improvements to reception in the middle of town, company representatives said. The tower would mostly be hidden by trees, although the top of it would be visible from downtown, project renderings show. Several councilors and residents who live and work in the center of town have said their reception is spotty, at best, and often have to go outside to make phone calls. Council President Christopher C. Johnson said the town should request the company pay for an expert to survey all possible locations for the tower before the site is approved. Verizon has told council the spot at Mill Street is ideal. "I'm frankly not impressed by Verizon's memo on alternate sites," Johnson said.
