Hood, LLC Premises Affected: 233 Main Street Date: August 10, 2016 Case 9: 1954 The Agawam Zoning Board of Appeals conducted a public hearing and meeting on August 8, 2016 at the Agawam Public Library Children's Room, 750 Cooper Street, Agawam, MA for all parties interested in the appeal of H. P. Hood, LLC, which is seeking a Special Permit in accordance with Section 180-56 of the Town of Agawam's; Zoning Ordinances to allow for the construction of three milk storage silos at the premises identified as 233 Main Street. After the public hearing and ;a thorough review of the facts presented, the Agawam Board of Appeals made the following findings 1. The subject property is located in an area of town zoned Industrial A. 2. The petitioner proposes to replace the existing storage tanks (two 10,000 gallon tanks, two 4,000 gallon tanks and one 5,000 gallon tank) with three new vertical storage silos. 3. The three proposed storage tanks will consist of 10,000 gallons each. Two of the proposed tanks will be at a height of 49'8' and the third tank will be at 461.5". 4. Section 180-56 of the Town of Agawam's Zoning Ordinances states: "Industrial buildings shall not exceed two stories or 40 feet in height, except with approval of the Board of Appeals after a public hearing. These provisions shall not apply to required equipment appurtenant to industrial buildings, except that ;smokestacks, water tanks, grain elevators and the like are not permissible except after approval of the Board of Appeals after a public hearing." 5. On July 7, 2016, the Planning Board voted to approve a site plan review for the subject property. 6. The proposed silos are an allowed use in an Industrial A zoning district. The subject property is an appropriate location for such a use and structure. 7. It is the Board's opinion that this proposed use will not have an adverse effect on the health, safety or property value of the neighborhood. 8. The site plan satisfies the concern that there will be no nuisance or potential hazard to vehicle or pedestrian safety. 9. Adequate and appropriate facilities and -controls will be provided by the issuance of this special permit for the proper and safe operation of the proposed silos. 10. The proposed silos are not considered so objectionable or obnoxious that the proposed use I DECISION (p.2) H. P. Based on its findings, the Board is of the opinion that it is within the authority of the Board of Appeals to grant a Special Permit as stated under Section 180-56 of the Town of Agawam's Zoning Ordinances. Now, therefore, by a unanimous vote of its three members, the Zoning Board of Appeals hereby grants the petitioner a Special Permit to allow for the construction of three new storage silos with the following conditions; 1. The storage tanks are to be built according to the plan submitted entitled "H.P. Hood, LLC Agawam MA Site Plan," revision date June 20, 2016, and signed by Bob Hale. 2. This special permit is for the proposed silos only. All other zoning and building regulations must be met. 3. The petitioner shall record with the Hampden County Registry of Deeds a'"Notice of Special Permit form, whichshall be provided by this Board and proof of said filing, must be submitted to this Board and to the Inspector of Buildings. 4. This Special Permit shall became null and void if construction does not commence within two (2) years from the date of this decision. This decision is subject to appeal in accordance with M.G,L.
