L PUBLIC HEARING CONT. — Zone Change— Maple/Spencer Streets — Tirone Development Corp. Mr. Ward explained that this item was continued at the last meeting and then opened the continued hearing and allowed for public input. Anthony and Mary Grasso, 14 Spencer Street - Mr. Grasso submitted several letters from other abutters to the Board, in opposition to this zone change request. He reiterated his opposition; to this request for the following reasons: he feels this would be -'spot zoning" a duplex would change the appearance and environment of the street; negative effects on the marketability of his own home and its Value if he were to sell; and would like to see a single family home constructed on this lot as is presently allowed. Mrs. Grasso stated that a large duplex on this lot that would face Spencer Street would "dwarf' her home and would be dangerous as Spencer Street is a narrow street. There being no further public input the Board closed the public hearing. Motion was made by Ms. Baldwin and seconded by Mr. Chase to close the public hearing on the zone change request for Spencer/Maple Streets. VOTE 5-0 Ms. Baldwin stated that she would consider ,this -zone change to be "spot zoning" and is not in favor of granting it. Mr. Morassi stated that he feels the same way and that it does not constitute "good planning" for the neighborhood. Motion was made by Mr. Morassi and seconded by Mr. Paleologopoulos to send a negative recommendation to the Town Council regarding the zone change request of Tirone Development Corp. for Spencer/Maple Streets for the following reasons: this • 0 Agawam Planning Board November 4, 2010 Page; 2 zone change would constitute "spot zoning"; and abutters to the property all spoke in opposition to this request and raised concerns over the effect of a duplex in a single- family neighborhood would have on their property values, marketability and character of the neighborhood. VOTE 5-0 2. PUBLIC l TEARING CONT. — Definitive Plan — Mariella Place— Federal Street— Tirone Development Corp. Motion was made by Mr. Paleologopoulos and seconded by Mr. Chase to continue the public hearing for the Mariella PlaceDefinitive Plan on Federal Street to the next meeting as requested by the applicant's representative. VOTE 5-0 3. FORM A — Suffield/Adams Street — Chriscola This plan shows the creation of a lot from a larger piece of land with frontage on Adams Street and Suffield Street. Motion was made by Mr. Chase and seconded by Mr. "Morassi to approve the plan for Chrscola on Adams/Suffield Street under "Subdivision Control Law Not Required". VOTE 5-0 Motion was made by Ms. Baldwin and seconded by Mr. Chase to amend the order of the agenda. VOTE 5-0' 4, APPROVAL OF MINUTES — October;21, 2010 Motion was made by Mr. Morassi and seconded by Mr. Chase to approve the minutes of October 21, 2010 as written. VOTE 3-0-2 (Baldwin & Ward abstained)' 5, Correspondences' The Board received a memo from the Law Department in response to their questions regarding the North Street Ext. Form A. The memo from the Town Solicitor discusses the procedure for discontinuing a paper street. Mr. Morassi stated that he felt the members did a good job in pulling their questions together for the Town Solicitor and commended them on handling the matter which presented them with "tough questions" from the applicant's attorney. DISCUSSION — Ferrentino's -- Main Street Mike Pietras and Frank Ferrentino were in attendance this evening to discuss with the Board Mr. Ferrentino's proposed parking layout. Mr. Pietras stated that have met with the Building Inspector and are now proposing to remove part of the existing building to allow for more room to park. He went on to say that his client would rather not have to remove part of the building and that it will be dependent on whether his lender will allow him to as well. This new proposal would allow for thirty-four (34) parking spaces vs. the original proposal that showed twenty-two (22) spaces (28% deficit from the parking guidelines). Ms. Dachos asked if he intended to continue to park Six Flags cars there as well. Mr. Pietras suggested that it be made a condition of the approval that no Six Flags parking would be allowed. Mr. Morassi stated that he is more comfortable with the concept plan discussed this evening. Mr. Ward stressed that this property is across the street from Six Flags New England and its design should maintain a level of professionalism with the area. He went on to say that the second plan is a great improvement over the original submittal, however he questions some of the spaces as shown. Ms. Baldwin stated that the area is dangerous and that inadequate parking will add to that problem. She questioned how delivery trucks would get in an out. Mr. Chase stated that deliveries could be timed to avoid interference with patron parking. He stated that he would support the second plan minus the two parking spaces shown in the middle of the parking lot. Mr. Pietras stated that the two spaces in the middle of parking lot are not desirable but dimensionally will work. Mr. Paleologopoulos brought up the previous Engineering Department comments regarding the curbcut. Mr. Pietras stated that they would have to alter the opening to address those concerns. Mr. Paleolggpooulos expressed concern over delivery trucks as well. Mr. Pietras indicated that he would take the Board's concerns into consideration and bring back a revised plan for action. The meeting adjourned at 7:50 PM. Agawam Planning Board October 21,, 2010 Page ;2' Valerie; Douglas, Federal Street asked if the Homeowners Association would address the maintenance of the sidewalk on Federal Street on land owned by Tirone. She stated that during the winter it is difficult for children to go up and down the hill as the Town uses a tractor to plow it and it leaves compacted snow. Mr. Levesque stated that there is:a portion of that sidewalk that will be the responsibility of one of the new lot owners as the backyard to it reaches Federal Street. He stated that portion of the sidewalk could be included in the Homeowners Association documents to be maintained. Motion was made by Mr. Paleologopoulos and seconded by Mr. Chase to continue the public hearing for the Definitive Plan of Mariella Place to November 4, 2010. VOTE 3-0 2. PUBLIC HEARING —Zone Change — Spencer/Maple Streets Tirone Dev. Corp. Rob Levesque presented this zone change request on behalf of Tirone Development Corp. for a 11,968 sf lot located at the corner of Maple and Spencer Streets. He explained that this property is currently zoned Residence A-2 and they are seeking a change to Residence B to allow for a duplex to be built with a driveway off of Spencer Street. Mr. Morassi asked for any public input. Paula Burke, 13 Orchard Street asked if the address for this parcel would change to Spencer Street; the number of units and garages. Mr. Levesque stated the address would be Spencer Street; two units and with attached garages and one driveway on Spencer Street. Anthony Grasso, 14 Spencer Street asked if these would be high end duplexes. Mr. Tirone stated that his son will live in one and one will be rented. The sizes will be 1,000 sf and 1,200 sf and the building will look like a single family. Mr. Grasso expressed concern over the ;affect on the ;neighborhood if this zone change were granted as this lot has always contained a single family residence. He stated that he is against the zone change as it will change the make-up of the; neighborhood and set a precedent. He feels a single family property owner tends to take more pride in their property. Bob Burke, 13 Orchard Street questioned what affect this zone change would have on the value of surrounding properties. Letters of opposition to this zone change request from Joann Hogen, 22Spencer Street and Sofiya Polovo of I l Spencer Street were read at the meeting and are included in the public record. Mr.-Paleologopoulos stated that the Board received a memo from the Safety Officer outlining his concerns with pedestrian, bicycle, and/or motor vehicle safety with the creation of`a two family home and two driveways. He mentioned the Planning; Department's report and the building inspector's verbal comment that this would be spot zoning. Agawam Planning Board October 21, 201,0 Page 3 Mr.:Morassi stated that the Board is trying to plan better in town and apply more consistent zoning. He stated that he is against the zone change request. In conclusion, the members felt they should continue the hearing and hold off on voting to allow the full Board to vote. Paula Burke, 13 Orchard Street stated that she wanted to go on record as being opposed the zone change request. Motionwasmade by Mr. Paleologopoulos and seconded by Mr. Chase to continue the public hearing for the Tirone Zone Change request to November 4, 20'10. VOTE-3-0 3. FORM A —North Street Ext. — VIP Homes & Associates LLC Attorney Liquori, representing VIP Homes& Associates LLC, was in attendance this evening. He stated that his client has purchased the former Montanez;property. There was a lengthy discussion regarding this plan and, more specifically, the matter of rights on a paper street. Attorney Liquori 'stated 'that his client does not want to go through the paper street discontinuance process as it will be costly. Mr. Chase stated that he feels the proper way to handle this situation would be to eliminate the paper street. The members came up with many questions to pose to the Law Department. Mr. Paleologopoulos stated that the Board already has a legal opinion from the Law Department dated October 14th. The members were in agreement that some type of action must be taken on the plan tonight to avoid it being approved by default. Motion was made by Mr. Paleologopoulos and seconded by Mr. Chase to approve the plan by VIP Homes & Associates LLC on North Street Ext. under "Subdivision Control Law Not Required". VOTE 1-2 (Morassi & Chase opposed) The members asked that a memo be sent to the Law Department outlining their questions and concerns on this plan and agreed to place it on the next agenda for discussion if Attorney Liquori so desired or if he would like to resubmit the plan for that meeting. The memo to the Law Department will ask the following questions: " in your memo dated October 14, 2010 you state "the developer can proceed; however, he may only proceed so long as no other property owner has an interest in the paper street in question". Attorney Liquori represented to the Board and the new plan illustrates that the former Montanez property has been purchased by VIP Homes. However, as you can see from the attached map taken off the Towns GIS, there are other properties that abut the Alexander paper street. Do these other properties have interest in the paper street? Is there a process for discontinuance of paper streets and, if so, why isn't this process appropriate in this case? If the paper street is not discontinued, can the area which may be used as a future street be used as frontage for the benefit of one individual lot? Attorney Liquori contends that Agawam Planning Board October 21, 2010 Page 4 this is a totally unique situation. The Board knows that there are many paper streets throughout Agawam. If the Board were to approve this plan, would it not seta precedent?" 4. BOND STATUS Dova Subdivision — Aimua The Performance Agreement for the Dova subdivision will expire on November 15'h. Mr. Aimua has requested an extension. The last vacant lot is under, construction at this time. Motion was made by Mr. Chase and seconded by Mr. Paleologopoulos to extend the Performance Agreement for the Dova subdivision to May 30, 2011. VOTE 3-0 5. NEW PERF. AGREEMENT &-LETTER OF"CREDIT — Farmington Heights — Hillside Development Corp. The Law Department has approved the Letter of Credit submitted for the Farmington Heights subdivision and Mr. DePalma has signed a new Performance Agreement. Motion was madeby Mr. Chase and seconded by Mr. Paleologopoulos to approve and execute the new Performance Agreement and Letter of Credit for Farmington Heights. VOTE 3-0 b. APPROVAL OF MINUTES— October 7, 2010 Motion was made by Mr. Chase and seconded by Mr. Paleologopoulos to approve the minutes of October 7, 2010 as written. PUBLIC HEARING CONT. — Definitive Plan — Mariella Place—Tirone Development Corp. Rob Levesque was in attendance this evening and submitted a letter to the Board dated today outlining "two outstanding items" with the Mariella Place Definitive Plan. The first is the request for waiver of borings and the second the narrow strips of land incorporated into the design of lot I and lot4. Mr. Morassi asked if they were able to address the sewer cover issue. Mr. Levesque stated yes and calculations were done which shows there will be a reduction in the amount of fill needed. Michelle Chase, Town Engineer, sent an email stating that her department supports waiving the requirement for borings as they get the information they need from the tests pits (soil type, seasonal high groundwater elevation, etc). She went on to say in her email that Mr. Levesque has been very accommodating with additional requests for test pits over the past few months. Motion was made by Mr. Chase and seconded by Mr. Paleologopoulos to allow for a waiver of the subdivision regulation requirement for soil borings for the Mariella Place Definitive Plan. VOTE 3-0 Mr. Morassi stated that the subdivision rules and regulations do not prohibit the strips that are shown on lots 1 and 4, the members are just trying "to do good planning" in asking for the elimination of the strips. He went on to say that maintenance of these strips is hard to enforce and they are hoping that the best solution will be found. Mr. Levesque stated that there will be a Homeowners Association for this subdivision and that maintenance of the strips will be provided for and enforced` through that. PUBLIC HEARING — Zone Change —186 Maple Street — Tirone Development Corp. Mr. Tirone was in attendance along with Rob Levesque of R. Levesque Associates who presented this zone change request from Residence A-1 to Residence B. Mr. Levesque explained that Mr. Tirone would like to build a duplex on the property and it is not financially feasible for him to build a single ;family home there. He stated that Mr. Tirone -sought this zone change in 2010 and was not successful. He stated that the property has been surveyed and is an existing substandard lot at 11,971.97 SF. He went on to say that it was likely the original intent that the lot be 12,000 SF but that over the years many surveys have been done and it is now just short of that amount. He stated that this zone change request is the first step in Mr. Tirone seeking approval to build a duplex on the lot; and next he will go to the ZBA or to the Building Inspector for a decision on whether it's a buildable lot. Mr. Paleologopoulos stated that it appears that there is a different figure for the lot area on the Town's G1S, the plan before the Board this evening and the plan that was submitted previously. He stated that the lot area as shown on the plan before the Board this evening is accurate. Mr. Chase asked if he could currently build a single family home on the lot. Mr. Levesque stated under the current zoning he needs 15,000 SF for a single family home and the lot does not meet that requirement. Mr. Chase asked if the lot- was buildable. Mr. Levesque stated that it up to the Law Department but that they are currently 3,000 SF deficient. He went, on to say that if the zone change is granted Mr. Tirone would only need 12,000 SF for a duplex which would be a small variance needed. Mr. Chase stated that it appears that most of the homes on Spencer Street in this area are single family. Mr. Levesque indicated that a driveway would come in off of Spencer Street. Mr. Tirone stated that it was the Engineering Department's request to locate the driveway off of Spencer rather than Maple Street. Mr. Paleologopoulos then asked for public input. Robert Burke, 13 Orchard Street stated he was at the meeting in 2010 when this was rejected and he was opposed to it then and still is. His concerns are: duplex would not fit in with the Agawam Planning Board August 4, 2016 neighborhood (cited the new duplex built on Begley Street), it's all single family homes in the area; duplex means renters and may not be long term residents; and it will devalue his property. He stated he would have no objection to a single family home there. Dennis Marchetto, 74 Spencer Street agreed with Mr. Burke; and expressed concerns over additional traffic. Also would support a single family home there. Mr. Tedeschi asked how many parking spots could be accommodated in the driveway of a duplex. Mr. Levesque stated that it is Mr. Tirone's plan to construct a single car garage in front of each unit which with the driveways would provide approximately 3 spaces per unit. Paula Burke, 13 Orchard Street stated that she does not feel the lot is big enough for a duplex. Mr. Levesque stated that this lot is double the size of the neighboring lots but is still deficient under zoning and would likely need ZBA approval. He went on to say that it is Mr. Tirone's intent for this to be a condex and one side will be owner occupied. Eric Sackowitz, 27 Spencer Street asked how big the proposed structure would be. Mr. Tirone stated approximately 1400 SF per unit. Mr. Sakowitz stated that the average homes in the area are 1200 to 1800 SF. Mr. Levesque stated that each unit would be ;comparable to the homes in the neighborhood. Robert Defiilippi, 3 Orchard Street stated that this lot is in his backyard and he has a three bedroom ranch. He expressed concern over how close the duplex could be built to the rear line; stated that he does not support a two family structure on the property and it will devalue his home and others in the area. Mr. Levesque stated that there is a required 20' rear yard. Tony Grasso, 14 Spencer Street stated that he is a direct abutter and would prefer to see a single family home built there. He is concerned that a duplex would affect the property values of the homes in the area. Mr. Grasso met with Mr. Tirone and expressed his concerns about how a duplex would affect how close-knit the neighborhood is. Janice DeFilipe, 24 Prospect Street asked how many letters were submitted for or against the proposed zone change. Mr. Paleologopoulos state approximately 5-6, all against the zone change. Nis. DeFilipe is neither for nor against. Jean Zueco, 50 Rowley Street asked how the town could consider putting a duplex on such small lot, and believes the Town of Agawam needs to reevaluate the effects of having people living on top of one another.. There is anew duplex on Begley Street that is just down from a school. Mr. Paleologopoulos stated that it is the right of the owner to apply for a zone change; Ms. Zucco asked who determines what the lot size needs to be. Mr. Paleologopoulos answered the zoning officer or ZBA for a variance. Mr. Levesque stated the Building Inspector interprets the zoning laws and the ZBA has the ability to grant relief. Nicole Sakowicz, 27 Spencer Street stated that most of the lots in the neighborhood are double lots that were merged together. Ms. Sakowicz asked how this could not be considered spot 2 Agawam Planning Board ga g August 4, 2016 zoning. Mr. Paleologopoulos said he considers it as spot zoning. Ms. Sakowicz believes the zone changed would be for the benefit of the developer and not the; neighborhood. She does support a single family home and not a duplex. Peter Bertera, 87 Spencer Street asked for a show of hands of who would support a single family home being constructed on the lot. Those in attendance raise their hand in support of a single family home. Robert Burke, 13 Orchard Street stated he does not want a duplex built in the neighborhood. Paula Burke, 13 Orchard Street commented that a duplex will be too large and will not fit into the neighborhood. There is a duplex across the street, but it stands alone without another house near it. Ms. Burke gave an example of how large the duplexes on Begley Street and Rowley Street look compared to the existing homes in the neighborhood. Laurie Bertera, 87 Spencer Street asked why the zone change request has come up again if it was turned down in`2010. Mr. Paleologopoulos explained that the applicant has the right to request a zone change again after two years. Ms. Bertera commented that the vacant lot is currently overgrown with weeds and looks horrible. She would rather see a single family home constructed on the lot than nothing at all.. Mr. Tirone stated that the he has owned the lot for a long time, and a demolition delay on the original home on the ,property cost him a contract to build a single family home. Mr. Tirone expressed that he has no interest in building a new single family home, and that his only option is to build a condex. The condex will be half the size of the duplex that was built on Begley Street, and will have the appearance of a single family home. His daughter will live in one of the units and the second unit will be sold. Twice during the public hearing a show of hands was asked for (once by applicant's engineer and once by an abutter) as to whether there would be support for Mr. Tirone to construct a single family dwelling on the lot and both times the abutters showed support for that. Mr. Paleologopoulos stated he is an agreement with the abutters, and that a zone change would only benefit the developer and not the abutters. Mr. Tedeschi concurs with Mr. Paleologopoulos and is not in favor of the zone change. Mr. Chase stated the current zoning is all about the originalintent for the area. If the parcel is zoned for a particular use in a neighborhood, then it should be kept that way. Motion was made by Mr. Chase and seconded by Mr. Tedeschi to close the public hearing for the Tirone zone change. VOTE 3-0 Motion was made by Mr. Chase and seconded by Mr. Tedeschi to send a negative recommendation to the Town Council on the Zone Change request by Tirone Development Corp. Agawam Planning Board g g August 4, 2016 for 186 Maple Street based upon the discrepancy with the square footage of the lot and the testimony given this evening; and it is the Board's opinion that this zone change would constitute spot zoning and a duplex would not be consistent with the area zoning. VOTE 3-0 2. PUBLIC HEARING— Zone Change — 0 Suffield Street & 83 Mill Street -- Murphy's Pub c/o Thomas Murphy Rob Levesque was in attendance as well as Thomas Murphy to present this zone change request. Mr. Levesque explained that his client would like to formalize his parking lot (paving, drainage) and that the properties are zoned as follows: 0 Suffield Street is currently zoned Residence A-2, Agricultural, and Business A, while 83 Mill Street is zoned Residence A-2 and Business A. The Applicant Murphy's Pub c/o Thomas Murphy —requests that both parcels be rezoned to Business A. There is a third parcel that Mr. Murphy has recently purchased from the Town but is not included in this application. Mr. Levesque explained that they have not yet determined what the zoning is on the third parcel at this time. Mr'. Tedeschi asked how many parking spots are required for this business. Mr. -Levesque stated that they will be filing a site plan for Planning Board approval for the parking lot and it will be compliant with the parking guidelines. Mr. Paleologopoulos then asked for any public input. Bill Reid, 106 Mill Street asked if the will be a change from the current parking conditions. Mr. Levesque stated that the parking lot will be paved and striped, curbing and drainage will be added along with a specified dumpster location. Mr. Paleologopoulos asked about the fence near the parking lot. Mr. Levesque stated there is chain link fence and some stockade fencing that is in disrepair. A site plan review will be submitted for parking lot improvements and a notice of intent will be filed with the Conservation Commission. Steve Cirillo, 13 Gunn Geary Lane asked if there would be an expansion of the lot. Mr. Levesque answered that the paved area may cover slightly more than the gravel area of the current lot. Mr. Cirillo asked if any of the vegetation will be cleared. Mr. Levesque stated that the details are not finalized, and that site plan review for parking lot improvements and the notice of intent under the wetlands protection act will show the intentions for vegetation. Mr. Cirillo then asked if there would be outdoor concerts. Mr. Levesque said there are no intentions for that, but the existing outdoor area will remain as is. Fay Reid, 106 Mill Street stated she is concerned about expansion of the outdoor areaandthe noise at night. Ms. Reid asked if there would be sufficient parking if the zone change its granted.. Mr. Levesque stated the minimum number of spots required will need to be met. Ms. Reid is in stated more parking is needed so that patrons are not parking on her lawn. Motion was made by Mr. Chase and seconded by Mr. Tedeschi to close the public hearing for the Murphy Zone Change. 11 Agawam Planning Board August 4, 2016 VOTE 3-0 Motion was made by Mr. Tedeschi and seconded by Mr. Chase to send a positive recommendation to the Town Council on the zone change request by Murphy on 0 Suffield Street and 83 Mill Street. VOTE 3-0 3. PRELIMINARY PLAN — Rowley Street - Rowley Street Development Trust Gary Weiner, P.E., was in attendance along with Attorney Michael Parker, Trustee. A revised plan had been submitted to the Engineering Department and the Board received comments on the plan this evening. Mr. Weiner went over the comments with the Board. The sight distance study will be prepared and submitted during the Definitive Plan review. Topo lines have been extended 30' off the property. Engineering recommends that the developer construct a sidewalk from the new street along Rowley Street to Lango Lane. Attorney Parker stated that the owner of the duplexes on Rowley have agreed to provide sidewalk easements. The 5' strip that was shown as part of lot 8 will now be deeded to the adjacent duplex and the radius will be provided. Mr. Weiner stated that they are requesting two waivers: dead-end street length of 525' and sidewalks on one side of the 'street to be replaced with a sidewalk from new street along Rowley Street to Lango Lane. Mr. Chase asked what would prevent future development of lot 4 from Rowley Street. Mr. Weiner stated that the driveway for lot 4 will come in on 35' of frontage on the cul-de-sac and that is where the house will be constructed. He stated that as far as further development goes, there is a20' wide access easement by the power company and the required frontage for lot 4 is along Rowley. The members agreed to vote on the waivers this evening. Motion was made by Mr. Tedeschi and seconded by Mr. Chase to waive the 500' maximum dead end street length to allow for a street length of 525' for Rowley Street Development Trust. The Applicant and OwnerTirone Development Group — requests that the parcel be rezoned to Residence B. The square footage of 186 Maple Street seems to be unsettled. The Applicant's current submitted plan indicates that the parcel is 11,97t.97 square feet (0.2:7 acres). The Applicant previously submitted a zone change request and accompanying plan for this same parcel in 2010. That plan indicated that the parcel is 11,986 square feet. Yet the town"s online GI map shows total area at 10890 square feet. The parcel has 100 feet of frontage on Maple Street ;and 120 feet on Spencer Street. The Planning Office has reviewed this proposal, and submits this report for your information. Also attached is a copy of the plan submitted by the applicant showing the proposed zoning map change, -a-copy of the Assessor's map showing the property as it is listed for tax purposes and the tax card information. Land Use and_Zoning As stated above, 186 Maple Street is currently zoned; Residence A-2. A copy of the zoning map for this area has been attached. Under the Residence A-2 district, the following uses are allowed (sec. 180-23 of the Zoning Ordinance —attached): A. Any use permitted in a Residence ,A-1 district. 0 Zone Change 186 Maple Street B. She stated that during the winter it is difficult for children to go up and down the hill as the Town uses a tractor to plow it and it leaves compacted snow. Mr. Levesque stated that there is a portion of that sidewalk that will be the responsibility of one of the new lot owners as the backyard to it reaches Federal Street. He stated that portion of the sidewalk could be included in the Homeowners Association documents to be maintained. PUBLIC HEARING — Zone Change --- Spencer/Maple Streets — Tirone Dev. Corp. Rob Levesque presented this zone change request on behalf of Tirone Development Corp. for a 11,968 sf lot located at the corner of Maple and Spencer Streets; He explained that this property is currently zoned Residence A-2 and they are seeking a change to Residence B to allow for a -duplex to be built with a driveway off ;of Spencer Street. Mr. Morassi asked for any public input. Paula Burke, 13 Orchard Street asked if the address for this parcel would change to Spencer Street; the number of units and garages. Mr. Levesque stated the address would be Spencer Street; two units and with attached garages and one driveway on Spencer Street. Anthony Grasso,,14 Spencer Street asked if these would be high end duplexes. Mr. Tirone stated that his son will live in one and one will be rented. The sizes will be 1,000 sf and 1,200 sf and the building will look like a single family. Mr. Grasso expressed concern over the affect on the neighborhood if this zone change were granted as this lot has always contained a single family residence. He stated that he is against the zone change as it will change the make-up of the neighborhood and set a precedent. He feels single family property owner tends to take more pride in their property. Bob Burke, 13 Orchard Street questioned what affect this zone change would have on the value of surrounding properties. Letters of opposition to this zone change request from Joann Hogen, 22 Spencer Street and Sofiya Polovo of 11 Spencer Street were read at the meeting and are included in the public record. Mr. Paleologopoulos stated that the Board received a memo from the Safety Officer outlining his concerns with pedestrian, bicycle, and/or motor vehicle safety with the creation of a two family home and two driveways. He mentioned the Planning Department's report and the building' inspector's verbal comment that this would be spot zoning. He stated that his client has purchased the former Montanez property. There was a lengthy discussion regarding this plan and, more specifically, the matter of rights on a paper street. Attorney Liquori stated that his client does not want to go through the paper street discontinuance process as it will be costly. 'Mr. Chase stated that he feels the proper way to handle this situation would be to eliminate the paper street_ The members came up with many questions to pose to the Law Department. Mr. Paleologopoulos stated that the Board already has a legal opinion from the Law Department dated October 14th, The members were in agreement that some type of action must be taken on the plan tonight to avoid it being approved by default. However, as you can see from the attached map taken off the Towns GIS, there are other properties that abut the Alexander paper street. Do these other properties have interest in the paper street? Is there a process for discontinuance of paper streets and, if so, why isn't this process appropriate in this case? Any property owner has the right to propose a zone change but there must be a public hearing in front the Planning Board where abutters have an opportunity to voice their concerns about the proposed change. As an abutter, you received notification of the proposed zone change and are encouraged to attend the Planning Board meeting to be heard. If the Planning Board recommends approval of the zone change, there is another public hearing in front of the City Council where abutters would have another opportunity to be heard before they made their final vote on whether to approve the change. First of all I am a resident who lives on Spencer St and received a letter because we live within 500 ft of lot at 186 maple st The letter is very ambiguous; it states that there is a proposed zoning change from RA-2 to a RB: There is no explanation in the letter as to what this change means, which in my i' opinion is not acceptable. There should be an explanation of what these zoning Odes mean and what will possibly occur if the change is approved. There -are _many older residents on the street that may not fully understand nor have the means to research what this change means. Thankfully I have the means to research and figure out that you are trying to permit a multifamily rental property tobebuilt in a neighborhood of single family homes. After researching things;a little more l came across a Town of Agawam zoning restriction Chapter 180- Zoning- Article V1. Residence B Districts. Under 160-35 Lot size it specifically states: "no lot shall have a frontage of less than 100 feet on a street or an area less than 12,000 square feet". Looking at the town of Agawam Patriot properties assessment it indicated that the property at 186 Maple Street is 0.250 acres which equals 10,890 square feet. Clearly the lot is too small and does not meet the restrictions for a two family home. Is this correct? if so, why is this change even being proposed? Obviously the town has these zoning restrictions for the residents of the town to comply with. If i am expected to abide by the zoning restrictions for the town then so should Tirone Development. I spent all of my previous years in the neighborhood as an Agawam public school student. I enjoyed walking to Robinson Park Elementary and the middle school. I was ecstatic when we were approved to purchase our first home and our offer was accepted for this neighborhood. while I am not excited about how long there has been an empty lot at the end of our street, I absolutely do not want a duplex in that spot. We like our established neighbors and don't want renters coming in and out of the neighborhood. Home owners take pride in their homes and watch out for their neighbors. Renters aren't the same. Since this lot doesn't even meet the requirements for this zoning change, I don't know why this topic is even trying to be pushed through. The obvious answer is no. This issue keeps coming up and we hope after this vote it will be quashed for good. am sad enough driving around a town l am a life long resident of and seeing duplexes going up in every open space.
