August 29, 2016 Dear Town Council, We, Citizens for Residential Enjoyment of Agawam, are concerned that insufficient due diligence has been performed and a rush to approve a zoning change was made in the case of Murphy's Pub located at 664 Suffield Street in Agawam. We are sympathetic to the concerns of the abutters and neighbors in the general area of the intersection of Mill' Street and Suffield Street, where Murphy's Pub is located on the northwest corner. i) Has either the Planning Board or the City Council determined the real reason the change is needed, since the property is already zoned Business A? 2) Has either the Planning Board or the City Council investigated how this zoning change and parking lot improvement will adversely affect abutting property values? 3) Has either the Planning Board or the City Council sought to obtain a good faith promise that this zoning change will not be .used to promote activities that interfere with the ,peaceful enjoyment of the properties of the abutters? 4) Has either the Planning Board or the City Council considered if the zoning change ;and parking lot improvement will allow more business flow in an already busy intersection, thereby interfering with the peaceful enjoyment of the properties of the abutters? 5) Has either the Planning Board or the City Council sought to obtain assurances from owner Tom Murphy that he will not remove vegetation or trees (which may be protected by the Wedands Act) that separate' the sight and sound of his property from the abutters, and will erect a privacy fence or plant mature trees to shield abutters to the west and south from noise? Two of our members were at the Planning Board meeting. It was interesting that before Murphy's Pub was discussed, there was a case of a builder wanting a variance to ;build a duplex home in a single- family neighborhood. The chairman used the phrase nit seems to be for the benefit of the applicant, but not for the benefit of the residents. He used the phrase three times, to enforce the denial of the request. And yet, the same argument wasn't used in the Murphy's Pub case - this zone change is for the benefit of Murphy's Pub, and not for the benefit of the neighbors. Normal reasoning would dictate it be denied for the same reason, absent any collusion. Also, we saw;a gentleman stand up and ask why the change is needed, since the property is already Business A and the parking lot can be paved now without the change. The architect was evasive and did not answer the question. The ;gentleman asked again what can't be done now that can be done with the zone change, and again the architect was evasive. That is a red flag to us. We suspect the zone change may allow Murphy's Pub to conduct activities that will be offensive and interfere with the peaceful quality of the neighborhood. We urge all neighbors/abutters to attend the City Council meeting on September 6, 2016 and we look forward to monitoring this issue. If Mr. Murphy is willing to be a good neighbor and to erect- sound/sight barrier fences and/or trees for the properties south and west of the establishment, and to also not engage in noisy outdoor activities or increase the current noise level, we would no longer oppose the zoning change or parking lot improvements. In fairness, an abutter did say that when Mr Murphy first purchased the restaurant, he did respond to complaints about lighting and addressed them. Hopefully he will continue to address the needs of the abutters and neighbors. Farms, dairies, nurseries, truck gardens,;; greenhouses and natural ice harvesting activities and buildings or structures accessory thereto; C. Buildings or shelters for the sale of farm products, provided that a major portion of the products offered for sale at all times are raised on the premises and no advertising of products other than those raised on the premises shall be displayed. D. The processing of forests and woad lots by portable woodworking mills and machinery for processing wood cut onthepremises, if approved by the Board of Appeals. E. Airports and landing strips and buildings or structures necessary thereto, if located west of Suffield Street. F. Off-street parking for 24 hours or less for motor vehicles when the use is an accessory to an existing conforming amusement park containing at least three acres of land adjacent to agriculturally zoned land and by special permit. Under the Business A district, the following uses are allowed (sec.1'80-44 of the Zoning Ordinance --attached) A. Any use permitted in.a residence district or an Agricultural District, B. The major use of a building or structure in this district shall he to store and display goods for sale at retail on the premises or to furnish: a service intended for residents of the immediate vicinity. Banks, hotels, dining establishments, halls and office buildings shall be considered as complying with such requirements. C. No building, structure or land shall be used in whole or in part for any fabricating, 2 Zone Change — 0 Suffield Street and 83 Mill Street manufacturing, converting, altering, finishing or assembling. D. One-story public garages for storage or repair of not more than 50 cars. E. A gasoline filling station, which shall include self-service gasoline filling or service stations, provided that not more than 30,000 gallons of gasoline shall be stored on the premises. G. Cabins, if licensed under MGL-c. 140, § 32A to 32E, inclusive. H. Drive-in; restaurants and drive -through restaurants, after a special permit by the Board of Appeals in conformance with. § 180-11. At no time shall fewer than 50parking spaces be provided on site. Drive -through service windows utilized by any business shall require a special permit from the Board of Appeals in conformance with § 180-11. Environmental Considerations The property contains an existing building, patio and parking, areas (pavedandgravel) to ,service Murphy's Pub. The topography of the developed portion of this site is relatively flat with a gentle slope to the south. The area southwest of the improved areas is wooded and contains a stream and associated wetland. A Notice of Intent filing with the Conservation Commission would be required for work proposed within jurisdictional areas. Other Considerations According to the Applicant, the requested zone changes would allow the pursuit of future business development within the subject properties.
