The Agawam Zoning Board of Appeals conducted a public hearing on June 26, 2017 at the
Agawam Public ;Library Children's Room and a public hearing and meeting on July 10, 2017 at
the Agawam Public Works and Municipal Annex (DPW) Conference Room for all parties
interested in the appeal of Aleksandr Radionov, who is seeking a Special Permit in accordance
with Chapter 180-23 of the Town of Agawam's Zoning Ordinances, which would allow for the
creation of a 2-family attached dwelling at the premises identified as 241 and 245 Meadow
Street.
After the public hearings and after a thorough review of the facts presented, the Agawam Zoning
Board of Appeals made the following findings:
1. The subject property is located in a Residential A-2 zoning district.
2. Currently, there are two existing residential dwellings on the subject property.
3. Residential A-2 zoning district (for residential purposes) only allows a "one -family dwelling
for one housekeeping unit only".
4. Residential A-2 zoning district also allows fora "one family detached dwelling for one
housekeeping unit only ... to be altered and improved and facilities added for a second
housekeeping unit" subject to certain requirements.
5. The original two one -family dwellings located on the single lot were erected and used prior to
the creation of the Agawam Zoning Ordinances; thus the reason for the nonconformity.
6. The petitioner purchased the property known as 241 and 245 Meadow Street in February of
this year. At time of purchase, the property had two hundred twenty (220);feet of frontage and an
area of approximately eighty-five thousand (85,000) square feet with two residential dwellings.
7. The petitioner submitted and received approval for an ANR plan from the Agawam Planning;
Board on May 4, 2017` regarding the 241 and 245 Meadow Street property. The approved ANR
plan shows two newly created parcels, entitled Parcel 3A and Parcel 3B, with each parcel
showing a frontage of one hundred and ten (I 10) feet. Parcel 3A, the subject of this petition, still
contains the two residential dwellings, but shows an area of 22,846 square feet. Parcel 3B has an
area of 1.47 acres.
8. The petitioner received a Building Permit for Parcel 3B to construct a single family dwelling
on June 13, 2017.

9. The new plan, approved as an ANR Plan, shows a substantial increase in the previously
existing nonconformity, in respects to Parcel 3A.
10. The petitioner's request to connect two separate residential dwellings to create a duplex, as
specified in the application, is also not an allowed use in a=Residential A-2 zoning district.
11. It is the unanimous opinion of the three members that the petitioner's actions of subdividing
the original single lot purchased in February, 2017 has substantially increased the nonconformity
that already existed.
12. It is the unanimous opinion of the three Board members that the petitioner is inviolation of
MGL, Chapter 40A, Section 6.
13. The Board members unanimously agree that the petitioner's subdivision of the original single
lot he purchased was done in a manner that the Zoning Board of Appeals would not have
allowed had it been consulted.
14. The Board members unanimously agree that the petitioner's request to combine the two
existing dwellings located on Parcel 3A is not allowed under the current zoning requirements.
Parcel 3A ;must come into conformance with the current zoning regulations for a Residential A-2
zoning district.
Therefore, by a unanimous vote of its three members, the Agawam Zoning; Board of Appeals
votes to deny the petitioner the request to create ;a two family attached dwelling on the premises
identified as 241 and 245 Meadow Street.
This decision is subject to appeal in accordance with M.G.L. Chapter 40A, Section 17 within
twenty (20) days after this decision is filed with the Agawam Town Clerk.
