Mr. Ward announced that the next item on the agenda (Preliminary Plan — Cooper Street
— Kot) will not be discussed until 7:00 PM as the abutter letters that were sent out stated
that the meeting started at 7:00 PM.
Motion was made by Mr. Paleologopoulos and seconded by Ms. Baldwin to take the
agenda out of order.

3. SITE PLAN — Cooper Street — Dr. Morris
Dr. Nancy Morris of Mass. Veterinary Cardiology Services, Inc. was in attendance to
present her site plan to use the existing building at the corner of Cooper/Suffield Streets
for her specialized veterinary practice. She stated that she is currently in West
Springfield and has found that this site in Agawam meets her needs very well. She
explained that it was originally, a residence but was most recently used as a beauty/skin
salon. She stated that her business is very low volume and this location would be open
three days per week. She has two other locations in Greenfield and Vernon, CT. She
went on to say that she takes appointments on the hour and that a very busy day might
include eight to ten people. She has two full time and one part time employee which
would need two to three parking spaces. She stated that she does not board animals and it
is rare that an animal is kept overnight but it is a possibility at this location. Her business
hours are 8:00 AM to 5:00 PM. Mr. Ward asked if she was proposing to make any
changes to the exterior of the building. Dr. Morris stated that it is currently a gravel lot
with a handicapped access ramp. She plans to install a dumpster at the end of the garage
with a fence around it. She stated that she plans to remove the door on the garage and
install a 3' door and fill in the end of the garage with T-11 1. She stated that the dumpster
will be installed along with a green -slotted chain link fence around it. Ms. Baldwin asked
if she had received the Engineering Department comments. Dr. Morris stated that she
received them this evening and that to install 50' of paving on the Suffield Street side to
reduce gravel being tracked onto the road would be a huge expense for her. She went on
to say that since there was a former business at this location, her understanding was that
the gravel lot was o.k. Ms. Dachos stated that this matter was not brought up at the Team
Meeting on the project and that it appears that the apron is paved up to the sidewalk. Mr.
Paleologopoulos stated that the revised plan Dr. Morris presented this evening shows the
garage being turned in a different direction. He asked how far the dumpster would be
from the road. Ms. Dachas stated that it is close and she had suggested planting
arborvitae to screen it. Dr. Morris agreed to that suggestion. Mr. Pandolfi questioned
whether there was enough room for the dumpster truck to access the area. Dr. Morris
stated yes there is. Mr. Paleologopoulos stated that the plan shows lines in the parking lot
and asked if she was proposing to line the gravel lot. Dr. Morris stated no, that the lines
were placed on the plan to indicate the number of spaces that could be accommodated.
She went on to say that she will provide the handicapped parking space sign that the
Engineering Department is requiring. Ms. Baldwin stated that she did not have an issue
with the lot remaining gravel as this will be a very low volume business. Mr. Ward
explained that the Engineering Department is recommending the lot be paved and that

this Site Plan provides the Board to review the site once again and require any changes
they deem necessary. Ms. Dachos explained that in 2007 when the Board reviewed the
site plan for the previous business, the plan indicated that the parking lot was to be
retained as gravel/trap rock. Mr. Paleologopoulos stated that he has no problem with the
parking lot remaining gravel. He is concerned, however, with the entrance onto Suffield
Street and that any additional landscaping no impede the sight distance. Mr. Morris
stated that other than arborvitae to screen the dumpster, the only additional landscaping
she is proposing is in the Spring to "square off' the grassed area and install timbers. She
went on to say that she plans to "beautify" the site and has already taken down one tree
near the road.
Motion was made by Ms. Baldwin and seconded by Mr. Paleologopoulos to approve the
Site Plan for Dr. Morris on Cooper Street with the following conditions: the dumpster is
to be fenced and screened; no additional landscaping is to be installed that would impede
traffic or pedestrian safety; the handicapped accessible parking signs are to conform to
the design and verbiage specified in MGL C.40 S.22A and AAB 521 CMR 23,00.

6. FORM A — Silver Street — Lucia
This plan shows a small piece of land from Mr. Lucia's site to the abutting lot owned by
his son.
Motion was made by Mr. Paleologopoulos and seconded by Ms. Baldwin to approve the
plan for Lucia on Silver Street under "Subdivision Control Law Not Required".

2. PRELIMINARY PLAN — Cooper Street — Kot
Ron Huot of Anderson Associates was in attendance along with the property
owner/applicant, Vadim Kot. He explained that this is a proposed three lot subdivision
(existing house with three additional lots) on 2.5 acres on Cooper Street. He stated that
the site slopes front to back and is zoned RA-2 and Agriculture. Sewer and water are
available from Cooper Street. He stated that there are wetlands located just off this site
and a Notice of Intent will have to be filed with the Conservation Commission as the
propose detention pond would be in the buffer zone. He explained that the applicant is
proposing 1800-2400 SF houses. Mr. Ward explained the preliminary plan process for
those in attendance. He asked Mr. Huot if he had received the Engineering Department
comments. Mr. Huot stated that he did and that they have submitted a waiver of the 300'
offset requirement between adjacent and parallel streets and that he will do a sight
distance analysis, provide contour lines and will to test holes. He stated that he has found
that the water table is approximately 6' deep on the site. Mr. Ward stated that per the
Agawam Police Department memo there are three trees at #519 Cooper Street that may
affect the visibility. Mr. Huot stated that they will remove the trees if necessary. He

The Agawam Zoning Board of Appeals conducted a public hearing and meeting on August 13,
2018 at the Agawam Public Library Community Room, 750 Cooper Street, Agawam, MA for all
parties interested in the application of Mass Veterinary Cardiology Services, Inc., which is seeking
a Special Permit in accordance with Chapter 180-46 (C) of the Town of Agawam's Zoning
Ordinances to allow for the construction of an addition with less than the required rear yard at the
premises identified as 305 Suffield Street.
After the public hearing and after a thorough review of the facts presented, the Agawam Zoning
Board of Appeals made the following findings:
1. The subject property is located in an area of town zoned Business A.
2. The petitioner was granted a special permit (case # 1907 in 2012) to conduct a veterinary
cardiology practice on the subject property.
3. The petitioner is now requesting a special permit to construct an addition, which will allow
for the reconfiguration of interior space to better service the needs of their patients.
4. The existing structure has a rear yard of 6 feet 3 inches. The rear yard of the proposed addition
will remain at 6 feet 3 inches.
5. Chapter 180-46 (C) of the Town of Agawam's Zoning Ordinances requires a rear yard setback
of no less than 25 feet.
6. Chapter 180-7 (B2) of the Town of Agawam's Zoning Ordinance allows for the enlargement
of a non -conforming structure "only after the granting of a permit thereof by the Board of
Appeals."
7. A memo, dated July 11, 2018, from Sgt. Steven Grasso, Town of Agawam's Safety Officer,
stated no opposition to the parking lot as shown. However, he does oppose any curb cuts to
Cooper Street.
8. The Agawam Planning Board voted to approve the site plan review on July 19, 2018.
9. The requested addition will not create a rear yard encroachment greater than that which
already exists.
10. This site is an appropriate location for the proposed addition to a veterinary practice. Animal
hospitals are an allowed use in a Business A zoning district.
11. Sgt. Grasso's positive recommendation helps to ensure that there will be no nuisance or
potential hazard to vehicle or pedestrian safety.

Based on the most current plans I do not see any significant changes in the parking lot that
would create any safety concerns to pedestrian or vehicle travel. As I mentioned in the Team
Meeting I do oppose any curb cuts to Cooper Street. Entrance/Exits on both Suffield St and
Cooper St will just create a "cut thru" for vehicle traffic which will cause safety concerns within
the parking lot.
