He received a report from the Planning Board with various Site Plan non- conformance,issues. I've enclosed a copy for your review. I have yet to get a resolufion. The trash problem has been resolved. But none of the others. My particular concerns are with the mounted speaker system,the pant spot light that shines directly onto my patio and into my home, the non-recessed or shielded lights on the rest of the premise,and the lack of pea stone to grade the parking lot,this would deter a lot of dirt that lands in my pol due to traffic. There is also the problem of the constantly barking dogs. Animals are prohibited on the Premises of a Food Establishment per FDA Food Code Chapter 6- 501.115. Also living and sleeping quarters are prohibited, see Chapter 6-202.110 and 6- 202.112.I've enclosed a copy for you. There are two new sips erected. I've been told by h1r. We were directed to examine the approved site plan and determine whether the site confonned to the aweed-upon requirments. At the time of our visit the business,a tak"ut restaurant, was closed. The parking lot was empty and we observed no persons on the premim during out visit. The main conctm of. the complainants was the lighting given off at the;restaurant that spilled onto their properties. The timing of ottr visit was deliberate so as to view the site during daylight hours and after'dart We walked the property focusing any no-n rtfo ance is ,while at the same e bane evaluating the site for safety and esthetic concerns. Our findings are detailed below. Site Plan conformance Replacement of existing fence on north side of the property was to be replaced with new 1 ' stockade fence. The fence is less than 107 feet tali No parking signs noted on the plan for installatiori on the fences alongside the entrance d exit driveways were not in evidence: • Compact car spaces do not have signs denoting them as such, Two lights on poles illuminating the rear parking,lot were not shielded, Lights on the north and west sides of the building are not shown on the site plan. The grading oft e handicapped spaces presents a-dangerous situation,. The site plan shows a minimal change in grade from the driveways to the area in front of tine building, but the actual gmde is quite steep. Two temporary signs advertising parking for$10 were found leaning against a wooden railing. 'No speakers are shore on the site plan, Safety conceras * A number of I arse boulders in the landscaping along Main Street could be a safity hazard. * An electrical extension cord,presumably used to supply power to a temporary sign,rAn across the exit driveway on the ground from an cutlet in the center-front of the property. # Handicapped parking spaces in front of the building are placed dangerously close to the take-out windows. * The width of the entrance and driveway looks to be inadequate to allow ingress for emergency vehicles. The width at the front of the building is 14' and the driveway shrinks to 11 1 as you pass the building to enter the rear parkin g lot. • The extreme westerly end of the rear parking lot is unpaved and open to a littered steep slope without barriers or warning for walking patrons orVehicles. Tire tracks and trash are evident all the way to the edge of the property. A loge appliance has be mounted on the south side of the building. It appears to be serving an HVAC function. Given its size and location on the sloped roof,this may constitute a hazardous condition. Aesthedc concerns and questions The rear parking lot was littered with trash- A dumpster on the southom.side of the parking lot in the rear of the property was filled to overflowing. A large dog cage sits next to the dumpster enclosure. We heard the dog barking inside the structure as we surveyed the property. The Inspector of Buildings of the Town of Agawam is charged with the enforcement of zoning ordinances. Site plan review is a part of the zoning ordinances in Agawam and as such, the Inspector of Buildings has jurisdiction to enforce the site plan requirements. A request to enforce the site plan requirements must be submitted to the Inspector of Buildings before he may demand compliance.. e Planning Board should mare a written request to the Inspector of Buildings asking him to enforce the site plan requirements. The Inspector o Buildings must provide written notification to the requesting party (the Planning Board) that action will or will not be taken and the reasons for such a decision* Such notice should be provided within fourteen days of receipt of the Planning Board request. The requirement that notification to the requesting party be within fourteen days is considered "directory and not mandatory." If the Inspector of Buildings chooses not to enforce the site plan requirements, the aggrieved party (the Planning Board) may appeal his lack of action to the Board of Appeals and ultimately into court. The parking lot was empty and we observed no persons on the premises during out visit. The main concern of the complainants was the lighting given off at the restaurant that spilled onto their properties.. The timing of our visit was deliberate so as to view the site during daylight hours and after dark. We walked the property focusing any non-conformance issues, while at the same time evaluating the site for safety and esthetic concerns. Our findings are detailed below. Site Plan conformance • Replacement of existing fence on north side of the property was to be replaced with new 10' stockade fence. The fence is Tess than 10''feet tall • No parking signs noted on the plan for installation on the fences alongside the entrance and exit driveways were not in evidence. • Compact car spaces do not have signs denoting them as such. • Two lights on poles illuminating the rear parking lot were not shielded._ Lights on the north and west sides of the building are not shown on the site plan. • The grading of the handicapped spaces presents a dangerous situation. The site plan shows a`minimal change in grade from the driveways to the area in front of the building, but the actual grade is quite steep. • Two temporary signs advertising parking for $10 were found leaning against a wooden railing; L 0 • After dark,an unshielded tinned light on the north side of the building intended to light- the entrance driveway did indeed cast light over the stockade fence into the abutters' properties. • The site plan calls for an area of contrasting colored peastone in the rear parking area. The designated area was of the same material and in the same condition as the rest of the unpaved portion of the rear parking lot. • We observed outdoor loudspeakers mounted on the outside of the building. No speakers are shown on the site plan. Safety concerns- • A number of large boulders in the landscaping along Main Street could be a safety hazard. • An electrical extension cord, presumably used to supply power to a temporary sign,ran= across the exit driveway on the ground from an outlet in the center-front of the property. • Handicapped parking spaces in front of the building are placed dangerously close to the take-out windows. • The width of the entrance and driveway looks to be inadequate to allow ingress for emergency vehicles. The width at the front of the building is 14' and the driveway shrinks to 11' as you pass the building to enter the rear parking lot. • The extreme westerly end of the rear parking lot is unpaved and open to a littered steep slope without barriers or warnings for walking patrons or vehicles. Tire tracks and trash are evident all the way to the edge of the property. • A large appliance has been mounted on the south side of the building. It appears to be serving an HVAC function. Given its size and location on the sloped roof, this may constitute a hazardous condition. Aesthetic concerns and questions • The rear parking lot was littered with trash. A dumpster on the southern side of the; parking lot in the rear of the property was filled to overflowing. • A large dog cage sits next to the dumpster enclosure. We heard the dog barking inside the structure as we surveyed the property. An outdoor grill is visible on a second floor deck up the rear stairs. It could be concluded that the building is being used as a residence as well as a restaurant:- ® Newspapers,:delivered and still bagged,were found-.on the ground in the front of the property.dating back to the;previous Tuesday. • Tables for dining are placed along the sides of the building, shielded only by a wooden railing from the vehicles entering and exiting. One table is adjacent to the gas meter. « Exposed wiring is evident on both sides of the building. + An earthen bank on the south side of the rear parking lot is suffering erosion. The submitted and approved plans showed this as a grass area. Parking in this area was not included as part of the approved permit. -.1- Parking advertisement sips were found along the edge of road and mounted to the southerly utility pole; both sip areas are within the State Highway Layout(SHLO). The permit states: "No signs, fences, or other appurtenances shall be located within or overhang the State Highway Layout Line." Areas within the SHLO and along the driveways were landscaped with rocks and boulders,and have unapproved curbing to retain the landscape. The permit clearly states: "This Permit does not authorize the placement of rock landscaping,shrubs or trees." The District hereby directs the immediate removal of unauthorized rock landscaping, wooden curbing, and parking signs within the State Highway Layout. The regulatory signs at the driveway entrance and exit shall be replaced with signs having appropriate dimensions,height above the ground and installed on breakaway posts per MassHighway Standards. The site plan shows a minimal change in grade from the driveways to the area in front of the building, but the actual grade is • Two temporary signs advertising parking for$10 were found leaning against a wooden railing. • After dark an unshielded timed light on the no side of the building intended to light the entrance driveway did indeed cast light over the stockade fence into the abutters' properties. • The site plan calls for an area of contrasting colored peastone in the rear parking area. The designated area was of the same material and in the same condition as the rest of the unpaved portion of the rear parking lot. • We observed outdoor loudspeakers mounted on the outside of the building. No speakers are shown on the site plan. Safety concerns • A number of large boulders in the landscaping along Main Street could be a safety hazard. • An electrical extension cord, presumably used to supply power to a temporary sign,tan across the exit driveway on the ground from an outlet in the center-front of the property. • Handicapped parking spaces in front of the building are placed dangerously close to the take-out windows. • The width of the entrance and driveway looks to be inadequate to allow ingress for emergency vehicles. The width at the front of the building is 14' and the driveway shrinks to 11' as you pass the building to enter the rear parking lot. • The extreme westerly end of the rear parking lot is unpaved and open to a littered steep slope without barriers or warnings for walking patrons or vehicles. Tire tracks and trash are evident all the way to the edge of the property. • A large appliance has been mounted on the south side of the building, It appears to be serving an HVAC function. Given its size and location on the sloped roof, this may constitute a hazardous condition Aesthetic concerns and questions • The rear parking lot was littered with trash. A dumpster on the southern side of the parking lot in the rear of the property was filled to overflowing, • A large dog cage sits next to the dumpster enclosure. We heard the dog barking inside the structure as we surveyed the property. An outdoor grill is visible on a second floor deck up the rear stairs. It could be concluded that the building is being used as a residence as well as a restaurant. • Newspapers,delivered and still bagged,wm found on the ground in the front of the property dating back to the previous Tuesday, • Tables for dining are placed along the sides of the building,shielded only by a wooden railing from the vehicles entering and exiting. One table is adjacent to the gas meter. • Exposed wiring is evident on both sides of the building. • An earthen bank on the south side of the rear parking lot is suffering erosion. He has enough for all of them.These same restaurants are also located within residential property do not have the appearance of a three-ringed circus. Option: Lesser lateral offsets may be used on,connecting roadway-,or ramps at interchanges,but not less than 1.8 m (6 ft)from the edge of the traveled way. Is the system cost-effective for the community in terms of utility costs, construction, and maintenance'?' Light Quality The part of a,light that emits light energy is what people commonly think of as a bulb. In outdoor lighting this, is called a[amp. A number of options exist when choosing lamp types for outdoor lighting;systems, each of which has trade-offs. Factors to consider in lamp selection include: lamp size, light output, appearance, light color, light pollution, optical quality, efficacy and lamp life, initial purchase price and maintenance cost. A well-designed illumination system can require a lower energy output while amply satisfying illumination needs. To evaluate the benefits of different lamp types it is useful to compare them using the information in Table 4. Lamp color differences can be used to great effect in public lighting to delineate a lighting hierarchy throughout the town. Because yellow lighting causes the landscape to appear as shades of gray, white lighting is generally preferred where accurate color rendering is needed to improve the perception of outdoor environments. Part 1 September,2001 1`6' Signs/Lighting Signs and lighting are design considerations that should be „ addressed in a community's zoning by-laws. The number, heighten size and the method of sign lighting can affect the character of a community,;as well as, safe travel along the roadway. The height and intensity of lighting can also negatively impact neighbors and traffic along roadways. The photos below and to the right show examples of sign blight,excessive lighting (brighter than a professional baseball stadium) and excessive sign size. Lest we not forget the parking debacle of last summer.We fear that this"Plan"would turn out to be a"front"for parking 'V1+'e fail to see the enhancement that another TwistCy's would bring to an area laden with traffic congestion,excess noise levels,trash pollution,and various pedestrians bling on a State Mghway during the Six,Flags operating season.It is also difficult enough,on any given weekend,to navigate in and out of our own driveways,let alone tbrough the center of Agawam. The impact can traffic safety,specifically in this designated area should be seriously considered. Prior to Six Flags relocating their exit area,there were various id is over the courseof a weekerfd, With another business directly across from this drive there would be a potential increase of endangerment on our roadways.
