The Board of Appeals conducted veral public hearings concluding with a public meeting on
May 26,2009 at the Agawam Public Library Ohildrens' Room, 750 Cooper Street,Agawam,MA
for all parties interested in the appeal of Coyote Realty,Inc. which is seeking a Special Permit in
accordance with Section 1 0-44,Paragraph I of the Zoning Ordinances, which would allow for
the construction of a bank drive-through service window at the premises identified as 1340
Springfield Street.
,After the public hearing and a thorough review of the facts presented, the Agawam Board o
.Appeals made the following findings:
1. The subject property is located in a Business A zoning district. ti
. The petitioner proposes to construct a bank with three drive-thru service windows on the
subject property.

windows utilized by any business
shall require a special permit from the.Board.of Appeals in conformance with Section 18

f On April 16, 2009, the Planning Board voted to approve, with conditions, the site plan for the
subject property. j

The proposed bank is an allowed use in a Business A zoning district, The subject property is
an appropriate location for such a use and structure:
8. No evidence was submitted demonstrating that this proposed use would have an adverse>
affect on the health., safety or property value of the neighborhood.:
.. The site plan,reviewed by the Police Dept,;Fire Dept.,and Engineering, satisfies the concern
that there will be no nuisance or potential hazard to vehicle or pedestrian safety.
10. Adequate and appropriate facilities and controls will be provided by the issuance of this �
special pennit for the proper and safe operation of the proposed drive-through service
windows.
11. The proposed drive-through service windows are not considered so objectionable of �
obnoxious that the proposed use would be against the public interest or detrimental or
injurious to the character of the neighborhood. (;

Based on its findings,the Board is of the opinion that it is within the authority of the Board of
Appeals to grant a Special Permit as stated under Section 18044, Paragraph I of the Zoning
Ordinances.
Now, therefore,by a;unanimous vote of its three members,the goring Board of Appeals hereby
grants the petitioner a Special Permit to allow for the three drive-through service windows with
the following conditions:
1. The plan titled"Mixed Use Commercial for Coyote Realty, 1340 Springfield St
Agawam,Massachusetts",dated 1 081 8 and revised 4I1 I09 and signed by the
members of this Board, shall be incorporated into and male part of this decision.
. All conditions set forth by the Planning Board in its approval of this site plan,slated April
16,2009, except for the second recommendation,must be adhered to
3. The dumpster located at the rear of the building must be relocated so as not to interfere<
with any pedestrian or vehicular traffic.
4. The rear sidewalk must be extended for the use of all rear entrances of the building,
5. The traffic control island at the entrance/exit must be extended to the comer of the
building
6. During inclement weather,all parking spaces on the subject property must be plowed and
clear of snow.
7. The drive-through service windows may not be utilized for any restaurant.
8. The traffic lane on the south and-east sides of the proposed building must be at least
eighteen(18 )feet in width as required by the Board of Fire Prevention Regulations, 527
CMR 1.00-50.00, Section,10.0 (10).
9. A cross property easement between this property and 1350 Springfield Street.trust be
added to the deeds of both properties and proof of such must be submitted to this Board
and to the Inspector of Buildings.
10, This special permit is for the drive-through service windows only. All other zoning and
building regulations must be met.
11.. The petitioner shall record with the Hampden County:Registry of Deeds a"Notice o
Special Permit''form, which shall be provided by this Board,and proof of said filing
must be submitted to this Board and to the Inspector of Buildings.
12.This Special Permit shall become null and void if construction does not commence within
two ( )years from the date of this decision.
This decision is subject to appeal.in accordance with M.G.L. Ch.4 A, Section 17 within 20 days
aver this decision is filed with the Agawam Town Clerk.

After consultation with this project's developer and the Agawam Fire
Department's Fire Inspector Scott Mitchell, I am making the following revisions to my
comments of 02- 9-2009:
Exhibit A—traffic control island at entrance/exit:
Inspector Mitchell to consult with Deputy Fire Chief Alan Sirois as to any
concerns he may have with extending this island from where it
presently ends to the corner of the building, I would prefer the curb
extend all the way to the building. However, if this would create a hazard
to the Fire Department personnel, I would withdraw my suggestion of an
extension.
Exhibit B—north west door to'Tenant Space##5
The relocation of the dh pster to the rear of the harking lot would
increase the safe access to&from this door,
Exhibit C—open property liner
Based on concerns by Inspector Mitchell that a physical barrier installed
between the parking lots of 1340& 1350 Springfield Street would create
a hazard to Fire Department personnel, I am withdrawing my suggestion
of a barrier devise. Developer was agreeable to the installation of
pavement markings to;guide customers through the parking lot.

1_ The applicant's en;giracer has ,proposed a one-way traffic circulation scheme for the site's parking lot.
One-way traffic requires extensive signage in order to inform the operator of the circulation;'this
proposed signage shall be shown on the plan. The signs should include: "ONE WAY", "DO NOT
ENTER", "STOP",and others;the signs shall comply with MUTCD.
2: A "KEEP RIGHT" sign, tither a R4-7 or R4-7a, should be used at the driveway curb out at Springfield

llowing:
1. Show size, type, and location of existing/proposed water and sewer services.
2. Indicate where pavement alterations are on plan-Add pavement detail to plan.
3. Show location for all types of curbing; add corresponding details to plan.
4, The proposed sidewalk is to be located completely within the R.O.W. Show the Town
sidewalkicurb ramp detail on the plan (see attached).
5. 90' parking spaces should use a minimum parking aisle width of 24 feet.
6. All the circulation aisles are very wide for one-way circulation. Circulation aisles greater
than 15 FT encourages two-way traffic.
7. Show curb cuts across the street and for the properties next door to the subject site.
8- Designate lanes for the Drive-up and ATM queue and for the escape/exft lane. It
appears that there will be conflicts between the drhk—. through queue & escape lane at

1 Additional existing and proposed spot grades/con s will be needed on the plan, especially along
the eastem-iside of the subject site. It appears that existing spot grades shown'on this plan in the
southern area indicate some existing storimwater ntly flows towards Springfield Street. The
submitted stormwater analysis does not reflect this.
2. The stormwater analysis states that all post-devel ent on-site stormwater will flow through the
grassed $wale. The existing front parking lot, Io between the subject site and the abutting
property to the west, is graded such that it channe the stormwater to the wetland. It appears that
approximately one third of past-development storit I water in the southern area of the site will flow
over this existing parking lot and not the proposed sed Swale.
3. Once comments I and 2 have been addressed, a revised stormwater analysis may be required to be
submitted to Engineering for review.
4. The stormwater in the proposed grassed Swale#Sower a.southerly direction and seems to outlet onto
the abutting property to the west of the site. Re-direct the swale's outlet such that the discharge will
be more towards the wetlands on the applicant's pa . I.

could be built slightly higher for the first fifty feet or so to prevent this from happening.

8. The vegetated filter strip should be designed with sitive pitch towards the swale to =me that
the stormwater will reach the swale. The entire swaic system (including the vegetated filter
strip)will have to be well maint-ained to prevent and clogging.

10. Some type of preventative measure should be> to diswurage vehicular traffic from eakiing

1. How will the proposed ""Exit"curb cut affect the present curb cut for the
entrance/exit of#1350 Springfield Street(Phipps Liquors): Close proximity may
create confusion for motor vehicle operators. Also,the greater the number of
curb cuts, the greater the hazards to pedestrians utilizing the sidewalk;
specifically, Junior High School and Granger Elementary School students.
. Will there be a physical separation (barrier devise);between the parking
lots of#1344 and##130 Springfield Streets? This would control the flow of
traffic from crossing over the property line? The lack of some type of barrier
could lead to the operation of motor vehicles in such a manner that is convenient
to one operator and hazardous to pedestrians,bicyclists,;and/or other motor
vehicle operators (wrong way operation).
3. How will motor vehicle°traffic,which enters at the "Entrance ", turns left to use
one of the 11 parking space bordering Springfield Street,only to discover all 1 f
are in use,be prevented from turning right near the "Exit"? Will these motor'
vehicle operators be expected to turn left, exit onto Springfield Street east bound,
and re-enter via the "Entrance"'in search for a parking space's
