The subject property is located in a Business A zoning district. ti . The petitioner proposes to construct a bank with three drive-thru service windows on the subject property. .. Section 180-44,Paragraph I states: "give-through service windows utilized by any business shall require a special permit from the.Board.of Appeals in conformance with Section 18 r ilk The proposed structure will meet all zoning requirements for the Town ofAgawam. I f On April 16, 2009, the Planning Board voted to approve, with conditions, the site plan for the subject property. j '. The Conservation Commission voted to grant an Order of Conditions on the subject property P on April 23 2009 I The proposed bank is an allowed use in a Business A zoning district, The subject property is an appropriate location for such a use and structure: 8. No evidence was submitted demonstrating that this proposed use would have an adverse> affect on the health., safety or property value of the neighborhood.: .. The site plan,reviewed by the Police Dept,;Fire Dept.,and Engineering, satisfies the concern that there will be no nuisance or potential hazard to vehicle or pedestrian safety. 10. Adequate and appropriate facilities and controls will be provided by the issuance of this � special pennit for the proper and safe operation of the proposed drive-through service windows. 11. The proposed drive-through service windows are not considered so objectionable of � obnoxious that the proposed use would be against the public interest or detrimental or injurious to the character of the neighborhood. (; 1; 1 DECISION Coyote Realty,Inc Case 4 184 ' Based on its findings,the Board is of the opinion that it is within the authority of the Board of Appeals to grant a Special Permit as stated under Section 18044, Paragraph I of the Zoning Ordinances. Now, therefore,by a;unanimous vote of its three members,the goring Board of Appeals hereby grants the petitioner a Special Permit to allow for the three drive-through service windows with the following conditions: 1. The plan titled"Mixed Use Commercial for Coyote Realty, 1340 Springfield St Agawam,Massachusetts",dated 1 081 8 and revised 4I1 I09 and signed by the members of this Board, shall be incorporated into and male part of this decision. . All conditions set forth by the Planning Board in its approval of this site plan,slated April 16,2009, except for the second recommendation,must be adhered to 3. The dumpster located at the rear of the building must be relocated so as not to interfere< with any pedestrian or vehicular traffic. 4. The rear sidewalk must be extended for the use of all rear entrances of the building, 5. The traffic control island at the entrance/exit must be extended to the comer of the building 6. During inclement weather,all parking spaces on the subject property must be plowed and clear of snow. 7. The drive-through service windows may not be utilized for any restaurant. 8. The traffic lane on the south and-east sides of the proposed building must be at least eighteen(18 )feet in width as required by the Board of Fire Prevention Regulations, 527 CMR 1.00-50.00, Section,10.0 (10). 9. A cross property easement between this property and 1350 Springfield Street.trust be added to the deeds of both properties and proof of such must be submitted to this Board and to the Inspector of Buildings. 10, This special permit is for the drive-through service windows only.
