entitled "Inspection Fee".

The unit rate of inspection fee levied shall be$0.75 per linear foot measured on each of the four
categories cited above. The total inspection fee shall be equal to the unit rate times the total
footage of each line category of inspection(roadway, water, sewer and drain lines) as measured
by the City Engineer. The fees described above must be paid prior to the commencement of
construction, but these fees need only be paid beforehand for the particular phase of work to be
undertaken, e.g., roadway, sewer, water or drain. When warranted by inflation or other factors,
the unit inspection fee will be increased as proposed by the Agawam Department of Public
Works and approved by the Planning Board.

Subject: Subdivision Inspection Fee Increase, Additional Information
As requested, we have performed the following comparison between the current and proposed Agawam
subdivision inspection fees and to those of several Pioneer Valley communities. We used "Windermere
Estates", off of Mill Street, as a typical subdivision to model the rates. Agawam's inspection fee is per linear
foot of installed item for: water, sewer, drain, and roadway. Of the other communities in the comparison only
South Hadley's rate is based on a similar structure where they impose per linear foot inspection fee for: sewer,
storm, road construction, and sidewalks. The other community's fees are based on a linear footage of the
roadway itself.

The proposed inspection fee increase is an adjustment of the existing fee by the Consumer Price Index
(CPI) to bring it up to current level. The CPI is an accepted inflation index, and as code specifies inflation a
warrant for increasing the unit inspection fee.Although the change is a 60% increase, this change is appropriate
because the fee has not been adjusted for about 18 years. Developers have enjoyed the benefit of paying the fee
at the 1991 level, shifting an ever increasing burden to the Town.

II.C. basic Reauirernents
No person shall make a subdivision within the meaning of the Subdivision
Control Law or any land within the Town or proceed with the improvement or
sale of lots in a subdivision,or the construction of ways,or the installation of
municipal services therein,unless and until a Defensive Plan of such subdivision
has been submitted to and approved by the Board as hereinafter provided, and
subsequently recorded at the Hampshire County Registry of Deeds and, in the
case of regi stered land, with the recorder of the Land Court.
R.D. Zoning,
Subdivisions shall meet the Rules and Regulations pertaining to lot size and
restrictions to water courses under existing zoning laws. No subdivision rules
can affect the size,shape,width, frontage or use of lots except that compliance
with the requirements of the zoning bylaw will be required.
H.E. E22 ineerin-&
The Definitive Plan shall be prepared by a Registered Land Surveyor.
Construction details shall be designed by a Registered Professional Engineer.

The following application fees shall be paid at the time of the filing of
subdivision applications:
1. ANR/Fon-n A $50/two lots +$10 extra lot
2. Preliminary Subdivision flan $500 plus $75 per lot
I . Definitive Subdivision Plan $500 plus $100 per lot
4. Definitive Subdivision Plan if no
Preliminary Plan has been filed $1,250 plus$200 per lot
5. Amendment to a Definitive Subdivision Plan $350 plus$75/affected lot
6. Inspectipn $b/linear foot of new road

The unit rate of inspection fee levied shall be $0.75 per linear foot measured on each of the four
categories cited above. The total inspection fee shall-be equal to the unit rate times the total
footage of each line category of inspection(roadway, water, sewer and drain lines)as measured
by the City Engineer.-The fees described above must be paid prior to the commencement of
construction,but these fees need only be paid beforehand for the particular phase of work to be
undertaken, e.g., roadway, sewer,water or drain. When warranted by inflation or-other factors,
the unit inspection fee will be increased as proposed by the Agawam Department of Public
Works-and approved by the Planning Board.-

The Agawam Planning Board will hold a public hearing on Thursday, April 2, 2009-at 7:00 PM
at the Agawam Public Library, 750 Cooper Street, Agawam, MA. The purpose of this hearing
will be to hear the petition of the Agawam Planning Board on a proposed amendment to Section
159-7H(6)(b)of the Agawam Subdivision Rules and Regulations entitled"Inspection Fee".

The Department of Public Works proposes that the subdivision inspection fee outlined in Town subdivision
code be increased to $1.20 per linear foot from the current$0.75. The fee does not appear to have been adjusted
since its inception in 1991.
