There are many swales at the rear of this property which have been created naturally to contain and shed water. The swales at the rear of the proposed development qualify as vernal pools as the swales and low lying areas contain melt water and runoff of winter snow and spring rains. These same areas are a habitat for snapping turtles and frogs. I re-iterate that these wetlands remain virgin territory and remain undisturbed. The state of Massachusetts and the Town of Agawam need to protect the status of this land under these tenants. The best time of year to see these vernal pools is in the Spring. Additionally, the rear of 311 School Street appears to have been used as a scrap yard of metal, derelict cars and 55 gallon oil drums. l have photos of rusty, leaking oil drums that have been on this property for many years and it is probable that the oil sludge has permeated the soil and surrounding ground water. This is a health hazard and needs to be treated as hazardous waste and cleaned up in a manner that will not destroy or disturb the ecosystem in this area. This is a serious issue that only complicates the proposed construction. Across the street from my home and the proposed development is the 100 year flood plain that is a delicate area that cannot withstand additional run off burdens that would result from an inadequate drainage plan to alleviate the seasonal water table ad run off produced in this development. Any uncontrolled discharge into the flood plain would destroy this vast ecological gem. The buildable section of this property(if the wetlands demarcation is followed) is very small and the resultant small lot sizes and small houses would diminish the abutters' property values. On a personal note, I am concerned that this development would shed water onto my property, creating a serious basement flooding issue. Drainage is a key issue that has to be addressed. Johnson and Weber with the establishment of the subdivision on School Street. Part of the subdivision involves a small rectangular parcel of land-locked land. Enclosed is a plan showing that parcel. It is also known as assessor's parcel M-11-S from 1910 and assessed to the Town of Agawam. I have searched the property and believe the enclosed affidavit correctly reflects the ownership to be in the heirs of Margaret Fitzgerald. We are in the process of obtaining deeds from the heirs of Margaret Fitzgerald. Mr. Weber researched the records with the Town and no title reference could be found. I did not find a deed to the Town or a taking for taxes in my research either. If title can be established in the town, my client would.be interest in purchasing. Otherwise, they would request a disclaimer. The title company that will be insuring the project has required some resolution with the Town, as the parcel has been assessed for years as Town land. Fire protection: The area will be served by the municipal fire department. A hydrant has been shown on the plan in accordance with the town 's subdivision regulations and good engineering practice. Plans will be forwarded to the fire and water departments in the event that any changes should be requested. Fuel tanks for heating oil will be installed above ground, and in accordance with appropriate permits and regulations when installed. IV. Natural conditions: a. Topography: The central portion of the site is relatively flat plateau with a steeper slope along the easterly portion of the lot. There as a lower valley on the site running from the center of the southeasterly property line to the northerly property line. Soils: The Soil Survey of Hampden County shows that the soils on the site are Pollux (PuB & PuA) decribed as deep and well drained and Amostown (AmB), which are described as deep and moderately well drained, both are C soils. Also on the site is Winooski (Wo), described as deep and moderately well drained and belong to the B soil. These soils are deep and excessively well drained. C. Depth to water table: No soil testing has been performed at this time. The Soil Survey of Hampden County shows Pollux (PuB & PuA) soils as having a high water table at greater the six feet below grade. Amostown (AmB) soils show a high water table at 1-2.5 feet and Winooski (Wo) soils show a high water table at 1-3 . Soil testing shall be performed to establish estimated seasonal high ground water elevation. d. Aquifer recharge area: The proposed project is no within an aquifer recharge area. e. Wetlands: There is an exiting wetland located off the property approximately thirty feet from the northeasterly corner of the property. No work is being proposed within the 100 foot buffer zone to the existing wetland. f. Watercourses: There are no open water bodies within 200feet of the project area. g. Flood prone areas: This project does not fall within the 100 year flood zone, according to Flood Insurance Rate Map(Community Panel#250133-0002-A). h. Vegetative Cover: The site currently contains a large portion of wood and over grown brush. There are some lawn-covered areas in the location of the existing houses. i. Unique wildlife habitats Based on the online Priority Habitats of Rare Species Map, produced by the Natural Heritage & Endangered Species Program, printed April 19, 2007; there are no unique wildlife habitats. j. Unique flora Based on the online Estimated Habitats of Rare Wildlife and Certified vernal Pools Map, produced by the Natural Heritage & Endangered Species Program, printed April 19, 2007; there is no unique flora. V. Environmental Impact: a. Measures taken to prevent surface water contamination: The stormwater runoff'from the proposed subdivision shall be pretreated within a series of catch basins within the proposed roadway with deep sumps, which will discharge stormwater to a proposed detention basin with a forebay and an underground leaching system with an overflow pipe to the existing School Street drainage system. The detention basin will be constructed with a forebay to allow for sediment to settle out before entering into the basin. b.
