As you know, we represent South Agawam Storage, Inc. ("SAS")and its principals
Richard and Michael Palazzi with respect to issues regarding the parking and/or storage of cars
on SAS property. I write to you in your capacity as chief executive officer of the City known as
the Town of Agawam("Agawam").
Agawam and its public officials wrongly prevented SAS from parking cars at its facility
for many months prior to the November 2007 repeal of Agawam's so-called "temporary parking
ordinance ("Ordinance"). After allowing SAS to park or store cars at its site for approximately
20 years,including the cars of those drivers looking to access Riverside Amusement Park and
now Six Flags Amusement Park on a daily basis,Agawam attempted wrongfully to preclude that
parking/storage. It did so by a number of wrongful means including: by attempting to enforce
selectively the Ordinance—now repealed—which was unlawfully vague, discriminatorily
applied and did not apply to SAS in any event; by refusing to recognize SAS's legal
authorization through its original permitting and amendments thereto to store cars on its
property; by refusing to recognize Agawam's own long-standing practice of allowing cars to be
parked or stored on SAS property; and by selectively and discriminatorily enforcing or
threatening to enforce other provisions of the zoning code which were previously deemed not to
apply or to have been complied with. Agawam officials appear also to have acted with improper
motives, including in an attempt to further the political fortunes of certain Agawam officials or to
further the economic interests of SAS's neighbor and competitor for parking revenue, Six Flags

SAS seeks to recover damages from Agawam in the amount of$54,000 for the harm
caused to it and its principals over the last many months. This letter is to serve as notice
pursuant to G.L. c. 238, Sec. 4 of SAS's intent to file suit against Agawam and the involved
officials, including you as Mayor and the several members of the boards and committees
involved, unless the matter can be resolved promptly without such an action.

Based upon the assumption that the occupants of the motor vehicles that would park
on this lot would become pedestrians with their destination to and from Six Flags, the
following measurements and observations were made.
1. The total width of Main Street at this site is 39.4'
2. There are no sidewalks on either side of Main Street at this site.
3. The distance from the entrancelexit of this site to the foot path leading to the Six
Flags foot bridge is 400'
4. Pedestrian will have to cross over the entrance/exit of TJ Sport House and of Six
Flags Central Receiving Warehouse.
5. The average width of the breakdown lane (site to foot bridge) is 1.2'
* Six Flags Central Receiving Warehouse personnel state Tractor Trailer units utilize the
warehouse's entrance/exit during normal hours of park operation. The TT units are

At its duly called meeting held on September 6, 2007, the Agawam Planning Board voted to
approve your site plan for Temporary Parking for you property located at 1668 Main Street with
the following conditions:
• The comments contained in the memo from the Engineering Department dated
September 6, 2007 and attached must be addressed.
• Handicapped parking for the temporary parking must be provided in compliance with
all applicable codes and regulations including the Massachusetts Architectural
Access Board regulations,Mass CMR 780 and Public Law 101-336. Four of the five
handicapped spaces shown are currently provided for existing uses on the site.
• Walkways through the parking area must be delineated by paint and must be T wide.
The walkway must be further delineated by cross-hatching 4' apart.
• Safe and legal access to the destination for the temporary parking customers must be
provided in conformance with applicable codes and regulations, including the
Agawam Department of Public Works, Massachusetts Highway Department,
Agawam Police Department, Agawam Fire Department, the Massachusetts
Architectural Access Board regulations, Mass CMR 780 and Public Law 101-366.
• The existing dumpster must either be removed or fully screen with fencing and/or a
natural screen.
• Restroom facilities must be provided for the temporary parking lot patrons. Portable
restroom facilities shall be fully screened so as not be visible from the public way or
adjacent properties.
• Comments received from the Agawam Safety Officer dated October 27, 2006 and
cornments from the Agawam Fire Chief dated July 30, 2007,both attached, must be
addressed.
• No ovcmight parking shall be allowed.

Per your request, Engineering has reviewed the Site Plan for South Agawam Storage and we
have the following comments_
Engineering performed an inspection of this site on August 15, 2007 and the previous comments
from November 15, 2006 haven't changed:
1. This site has a history of causing flooding problems for the owners located at 1670 Main
Street. In particular, the parking lot area between the storage building in the southeaster
corner of the site and the one to the west of it_ The parking lot drains to a low spot here where it
eventually overtops the 6* berm/wall and floods the building next door. Also, in the winter, snow
tends to be plowed up along the southern edge bf the property which melts and causes flooding.
The original plan was to have the stormweter flow toward the western part of the property and
eventually to the detention pond.
2. There are a significant number of cam and large trucks which appear to be non-functional
around the entire site. This includes a large semi and box truck along the western property line,
a number of cars behind the office maintenance building, and in several of the proposed parking
spaces.
3. There are two dumpsters on the site which are not shown on the plan. The one behind the
south west corner of the southern front store will not be accessible if cars are parker) where they
are proposed. Neither of them have a fence around them.

The Planning Board is in receipt of a copy of an application for a temporary parking permit for
Michael Palazzi, 1668 Main Street. Since this is one of the first applications submitted under the
new ordinance, Article XVIII of the Zoning Ordinance, 1 have carefully followed its requirements
and note the following:
§180-132 B—Conditions
1. No overnight parking- No where in the application does it indicate that there will be
no overnight parking. In fact, the attached application indicates that there will be
overnight parking (see attached application to the Board of Appeals).
2. Shielded lighting— The proposed lighting is shown on the plan_ However, there are
no cut sheets or other information to determine whether the lighting is shielded.
3. Parking shall not extend beyond the property lines—Since a surveyed plan has not
been submitted, it can not be determined whether the cars shall be parked on the
applicant's property.
4. Access/Egress— Radii and widths should be shown on the plan.
S. Handicapped parking— The handicapped parking shown on the plan is provided for
the other uses on the site (i.e., the restaurant and convenience store). There does not
appear to be adequate handicapped parking provided.
6. No flagmen—Not addressed

§180-13 Site Plan of the Zoning Ordinance states "A site plan shall be required and shall be
submitted in each of the following situations-
(3) Any use requiring a special permit from the Board of Appeals."
Since a temporary parking permit requires a special permit from the Board of Appeals, the plan
for a temporary parking permit must comply with the requirements of§1 S 0-13. This plan not
only does not meet the new requirements for a"temporary parking permit"but also does not
meet "site plan"requirements.
It is for these reason that I recommend that the plan be returned to the applicant until the
requirements of the Agawam Zoning Ordinance be met.

During the Planning Board's review of a Site Plan for South Agawam Storage, Inc., a number of
unregistered and disabled vehicles were observed on the site. There was also a car for sale
parked in the front of the site, a junk vehicle in the detention pond, various propane tanks, and
buildings that do not appear to be previously approved through site plan approval.
The Planning Board asks that you visit the site and inform the Board whether all of the activities
on the site are in conformance with previously approved plans and the Agawam Zoning
Ordinance.

Dear Mr. Palazzi:
At its duly called meeting held on December 7, 2006, the Agawam Planning Board reviewed
your site plan for your business located at 1670 Main Street. The Site Plan was submitted in
conjunction with your application for an open-air transient parking permit from the Board of
Appeals.
During the on-site inspections performed by Planning Board members, a number of
unregistered/disabled vehicles were viewed on the site. There also is a car for sale parked in the
front of the site. The Board members also observed a junk vehicle in the detention pond, a
number of propane tanks, and buildings for which site,plan approval does not appear to be
granted. The Planning Board will be sending a request to the Inspector of Buildings to clarify if
all activities on the site are in conformance with previously approved plans and zoning.
In addition to the above mentioned issues, the plan submitted with your application does not
conform with the requirements of a Site Plan as described in §180-13 of the Agawam Zoning
Ordinance. Please submit a professionally prepared plan prior to the Planning Board's next
meeting to be held on January 4, 2006 so that it can be reviewed by the professional staff. The
plan should clearly delineate the various uses presently found on the site as well as the exact
location of the new transient parking.
Finally, the plan must clearly indicate how pedestrians will safely access the Six Flags pedestrian
bridge. Safe access must be by way of a sidewalk or other structure dedicated to pedestrian use.

Per your request, Engineering has reviewed the Site Plan 'for South Agawam Storage and we
have the following comments:
1. This site has a history of causing flooding problems for the owners located at 1670 Main
Street. In particular, the parking lot area between the storage building in the southeastern
comer of the site and the one to the west of it. The parking lot drains to a low spot here where it
eventually overtops the 6" berm/wall and floods the building Next door. Also, in the winter, snow
tends to be plowed up along the southern edge of the property which melts and causes flooding.
The original plan was to have the stormwater flow toward the western part of the property and
eventually to the detention pond_
2. There are a significant number of cars and large trucks which appear to be non-functional
around the entire site. This includes a large semi and box truck along the western property line,
a number of cars behind the office maintenance building, and in several of the proposed parking
spaces.
3. Them are two dumpsters on the site which are not shown on the plan. The one behind the
south west corner of the southern front store will not be accessible if cars are parked where they
are proposed. Neither of them have a fence around them.

We Received the site plans for South Agawam Self Storage Main Street, on
Monday, October 23, 2006.
We found- The non-architecture prints provided were extremely difficult to
decipher, and needed to do a currant site evaluation to understand the prints, along with
looking at the Town Assessors Cards. At this time - according to the information on the
Town Assessors Cards, there is no 1670 Main St., but the cards for Parcel ED K2 1 12
(address 1666, 1668, and 16661672)was built about 1989, and are currently in
noncompliance for 521 CMR of the AAB, and doesn't comply with the in-forced code
since 1974.
At this point in time, with all that has been provided, and with the information
gathered during the research, we"Reluctantly DECLINE"approval of this permit.

Description of Site: The proposed location for the parking is in and among the existing
storage facilities.
Provision for Traffic Flow: Unchanged.
Parking: The proposed parking for approximately 40 vehicles is dispersed throughout
the site. The dimensions of the spaces have not been shown.
There appears to be to many vehicles proposed for a site that is already fully occupied.
Some of the spaces are shown next to the fence on the north side of the site. This area
appears to be presently occupied by junk vehicles. There are cars shown behind the
buildings which would appear to block delivery to these buildings. Some cars are shown
in the area which is the dumpster location according to the previously approved plan.
Also, when the plan was originally approved, there should have been 38 parking spaces
for the retail space. There are only 24 spaces in front of the buildings. There was an
additional 22 parking spaces shown adjacent to the two storage units built behind the
retail space. These spaces are now not shown on the new plan.

Landscaping/Screening and Buffers: The following landscape note must be placed on
the plan: "All plantings must be maintained and that portion of the public way abutting
