Discussion: Massachusetts General Laws c. 40A, §G provides that". . . a zoning ordinance or by- law shall not apply to structures or uses lawfully in existence or lawfully begun, or to a building or special permit issued before the first publication of notice of the public hearing on such ordinance or by-law. . ." Although at the time the lots in question were sold by the original owner,a 50'strip was reserved and used as a driveway/road, this strip of land was never accepted as a street by the Town of Agawam. Because the street has not been accepted, the construction of a street as part of Northfield Estates is new and must conform to the current zoning requirements. Agawam Code §159-8A(7). Therefore, lots labeled as # 1 and #2 on the 1961 plan cannot be considered nonconforming. Agawam Code §180-25C requires that a corner lot in a Residence A-2 district have a setback of 25' from any street line. According to the information I have, currently house 242 has 15' setback and house 232 has 20' setback. This means that construction of the street would violate current zoning requirements. In order to remedy this violation,Mr. DePahna could either file an application with the Board of Appeals for a variance, or the Planning Board could grant a waiver of the regulations if". . . such action is in the public interest and not inconsistent with the Subdivision Control Lain'. Agawam Code §159-35. Conclusion: The lots in question cannot be considered nonconforming under Massachusetts Law. The southerly property line abuts houses on Yale Street the easterly property line abuts houses on White Oak Drive, the northerly property line abuts Elizabeth Street and undeveloped land, the westerly line abuts North Westfield Street. North Westfield Street and Elizabeth Street has municipal sewer and municipal water. SCS Soil Maps indicate the site to contain Ninigret and Agawam soils. Proposed Developmat This proposal shows the creation of a new proposed street which connects Elizabeth Street with North Westfield Street. The length of the road is about 1,450+/long. Fifteen lots are proposed and all lots meet or exceed the minimum dimensions for an agricultural zone. Municipal services existing in North Westfield Street and Elizabeth Street will be utilized for this project. The proposed storm drain system will be designed to collect the run-off through catch basins and drainage manholes,which will flow into a detention basin, and overflow into an existing drainage easement and Swale which flows in a northeast direction. No historic structures nor archaeological important areas are apparent on this site.
