On behalf of the Applicant, enclosed is a completed Application for Endorsement of Plan Not
Believed to Require Approval (Form A). Included with the application are two (2) Mylar
original and three (3) copies of a Plan of Land dated January 17, 2005 and a check for the
required fling fee of thirty-five dollars ($35.00).
A parcel, noted as "B-1", is being transferred so that the needed 100-foot frontage is afforded for
two other parcels, designated "B" and "C". Since each parcel meets the required frontage and
acreage on an existing way, it does not constitute a subdivision within the provisions of the
Subdivision Control Law and request Planning Board determination and endorsement that
approval under the Subdivision Control Law is not required.
Also by copy of this letter, delivered in person, the applicant gives notice to the Town Clerk of
the above submission for such a determination.

Per your request dated January 27, 2005, we have reviewed the plan entitled, "Plan of Land in
Agawam, MA; Prepared for: Commonwealth Communities Holdings LLC; Prepared by: Lewis
& Cook Surveyors - Belchertown-Palmer, MA; Scale 1"=60'; Dated: 1/17/05", and have the
following comments:
1. The property lines close within the required amount and meet current standards.
2. The new property lines will require pins to be set. This is not indicated on the plan.
3. The following notes should be added to the plan:

construed as either an endorsement or an approval of zoning lot area requirements."
Engineering has the following recommendations based on the assumption that Parcel B will have
a new building for the Country Estates Facility:
1. From a functional standpoint (not looking at Zoning requirements), it would be best for both
Parcel "A" and Parcel "B" to be served by one common driveway. Having two major curb cuts
near each other will not only increase the chances of an accident occurring, but it will also greatly
increase the amount of impervious area.
2. Depending on what is proposed for future improvements on Parcel B, the property line may
have to change again (where Parcel "B" is only 50 feet wide) in order to meet public right of way
and/or emergency access standards. An option might be to extend the southern property line of
Lot "A" (located +/-100' south of and parallel to the existing building) to the west property line
of Lot "A" and establishing a parking lot easement for the existing lot. This will allow plenty of
space for any unforseen requirements or issues that may come up when designing the entrance to
Lot "B"
