Cirillo,Jr. 986 Main Street Agawam, MA 01001 Dear Mr. Cirillo: Massachusetts Highway Department(MassHighway) District Two personnel performed site reviews along Route 159, in the vicinity of the Twisty's property at 1508 Main Street in the Town of Agawam, Site investigation revealed the following concerns under permit#2-2005-0549, issued to Cirillo Realty: Areas along the driveways and within the SHLO, which is approximately twelve (12)feet from the edge of road (curb I ine), were landscaped with rocks and boulders. The permit states: "ROCK Landscaping, planting pots, barrels, other containers or appurtenances shall not be allowed under this permit." The District hereby directs the immediate removal of unauthorized rock landscaping, signs, and parking spaces within the SHLO. The Permit also states: "No Parking is allowed within the limits of the State Highway Layout." The submitted plans drawn by R. The proposed wall must be inspected by the designer/architect to ensure structural sufraciency, due to public safety concerns. The applicant's Engineer must also sign off on the construction of the wall. Please make a note on the plan set to this effect. I The embankment at the base of the proposed retaining wall has an average slope of 1:2.5,the maximum slope allowed is 1:3- the plans should be revised to reflect this. 3, The retention wall cross-section currently shows the ground at the base of the wall as level, the plans show a slope at the base of the wall. The detail should be revised to represent the proposed construction. 4. Please show existing and proposed elevation contours for the site with spot grades and rim elevations. Show the elevations for the high points indicated on the plan in the parldrig lot. 5. Show on the'plan the stormwater flow path for runoff from the new area above the retaining waU- 6, Please confirm that the new addition will not disturb the existing drain line; add notes to the plan as needed. 7, The plans show a proposed riser, frame, and grate to be installed above the existing leaching cell. Please show details on the plans. Adding this grate to the leaching cell will likely increase the maintenance required for the cell; care should be taken when landscaping the area at the base of the wall, near the grate, so as to prevent plant bed mulch from washing into the leaching cell. Caeneral Comment 9. The site plan approved last year shows 10 approved parking spaces. The 2 spares behind building should be shown on the plans. A site visit revealed that the number of marked spaces in the existing 04/12/2007 08'48 FAX 4138210631 it 003/003 lot exceeds number shown on the plats; 16 total spaces w=observed, including I Handicap Accessible space exist, as opposed to the 11 shown on the current plan(with I Handicap Accessible space), The spaces that are the pruinary concern are the 2 spaces next to the stairway in the upper parking area. The layout of these two spaces congest the traffic flow on the site and should be removed;no parking signs should be placed at these locations among others, see comment 9 below. 9. "NO PARKING"signs should be placed along the edges of the proposed compacted gravel area, as well as along the southerly parking lot's edge, just west of the building and also along the north side of the new addition. Show the sign's locations and also a detail, meeting MUTCD standards,on the Plans 10, The plans show the water and gas services off of South Street to be severed at the property line. It is believed that these services were retained for use by the remaining structure;please confirm this, and note the plans as needed. 11. Show the new handicap ramp locations on the plans if any new ramps are proposed,if no are proposed the detail should be removed from the plans. 12. Indicate on the plans the type of fence to be installed around the dumpster. 1*3). The letter submitted by the applicant is from and signed by the current resident, not the owner,of 21 South Street. It states: 1 give permission for Anthony Cirillo to fill in Gully abutting my property and his Twisty lee Cream property." If the applicant is proposing to fill a gully on the abutting property, the plans should show this proposed activity with existing and proposedelevation contours. The contour lines have to extend onto the abutting property far enough so that the pre-and post-construction drainage patterns can be analyzed properly. If the drainage patterns change, Engineering recommends that the applicant obtain drainage casements. CONSERVATION COMMISSION COMMENTS: 14. He stated that this area would be used as a sitting area with a take-out window. Mr. Hopksin asked how much additional seating and parking this would create. Mr. Cirillo stated that per the zoning officer he could seat 18 in this area but he is proposing and additional 1 Q-12 seals. 2) He stated that his slope is washing away and he would like to fill the area to the end of his property and construct a 3" retaining wall with a guardrail. He stated that he will plant grass and shrubs and will place traprock. Ms. Dachos asked if this area was to be used for parking for Six Flags. Mr. Cirillo stated no, not this area but that he now owns 1744 Main Street and is using that property for Six Flags parking and that he is advertising free cones with the parking:. Ms. Machos explained that a site plan is required for that use as it is a house lot. She asked i a revised parking,,analysis was conducted for the site being discussed this evening and informed hire that a new Notice of Intent would also have to be filed with the Conservation Commission. Mr. Hopkins started that the Board would treed elevations of the addition and the area to be filled. Ms. Etachos stated that Mr. Cirillo stated at a Conservation Commission meeting that this are would never be used for parking, only for picnic tables. Mr. Cirillo stated that circumstances change. Mr. Hopkins stated that the added seating could have an impact on the parking and that the following issues must be addressed on a revised plan: will the area be paved or impervious, drainage`,-landscaping; grading; si,gnage; and proximity to brook. He also stated that if the addition has the;.possibility of 18 additional seats, the Board must look at that as the maximum allowed and that the parking analysis should reflect that. Since this wall is less than 4' exposed support, the wall does not fall under the Building Inspector's purview. Engineering does not have staff qualified in structural design to perform these inspections. 2. Engineering recommends that the guard railing shown on the plan be installed for public safety, as opposed to the wooden railing mentioned by Mr. Cirillo, In a conversation with Mr. Cirillo he had, stated that the location of the wall was going to be about parallel with the foot of the exterior' stairway. Then from the top of the wall there was going to be a vegetated strip sloping to the top where there will be wooden railing similar to that which is already on-site. In a conversation earlier this spring with Mr. Cirillo, he stated his concern with the layout of the current two-way northern curb cut on Main Street. He had proposed possibly having one-way circulation on the site, if this is still the case it may be necessary to have a new one-way curb cut on South Street where the traffic would exit while retaining the northern curb cut on Main Street as a one-way entrance. Please evaluate the feasibility and necessity of these changes. NOTICE OF INTENT COMMENTS: 8. This project requires a Notice of Intent to be submitted to the Conservation Commission. Besides the obviousness of backing up northward in the south bound lane, the maneuver of the delivery truck created visibility problems for both north and south bound traffic as well as; traffic entering/exiting South Street. The proposed addition, which will have seating for"1 ", could increase the number of Twisty's customers. Added to this, the Six Flags patrons who may park at Twisty's, and the safety to pedestrian, bicycle, and motor vehicle traffic will decrease drastically. There still exists a negative impact on the pedestrian, bicycle, and or motor vehicle traffic safety. This business will increase pedestrian, bicycle, and motor vehicle traffic at this site. Listed below are but some of the areas of concern: 1. Lack of sidewalks on both South Street and Main Street 2. The parking configuration (of the upper lot) will lead to motor vehicles backing out of parking spaces into the same area of pavement as those motor vehicles entering the site. 3. Will the roadway leading to and from the lower(rear) parking lot accommodate two way traffic? 4. Stone-DPW Supt., Reinhardt Assoc.; P"rorn Engineering.: PaNKING BOARD Date: March 25, 2005 Subject: Site Plan - 453 _ Twisties, A.K.A. Doggies, 1504 - 1510 Main Street - Cirillo Per your request dated, May 17, 2005, we have reviewed the revised site plan entitled "Site Plan For Anthony Cirillo - Agawam, MA; Prepared by: Reinhardt Associates, 430 Main Street,,Agawam, MA; Scale. 1" = 10'; Dated: 5/1 /05", and we have the following comments: This new submittal does not address the following previously described comments by Engineering. I would not recommend the approval of this site plan until all Engineering comments are addressed. The current plan does not have complete information for site plan approval. A brook is located within the site. 1t is recommended that all environmental permitting be resolved before this site plan is approved. This;project will fall under the jurisdiction of the Wetland Protection Act and River front Area requirements. Significant changes to the proposal will result. The several outstanding issues to be addressed are as follows: 1. The following notes shall be added to the site plan if there are any proposed drainage, water, or sewer lines;: "Prior to any installation of any sewer, water or drainage lines, the contractor/owner shall contact the Town of Agawam's Engineering Division, 786-0400 x 75/8. No piping/appurtenances will be installed or backfilled without the permission of the division'. 2. This submission proposes an increase,to the impervious area of the site. Appropriate water volume and water quality controls roust be proposed to comply with the D.E.P. stomwater policy; 3. Contact the Conservation Commission for all requirements due to the proximity of the Four Mile Brook within the southern one third of the property. Show all relevant wetland and riverfront boundaries within the parcel as appropriate. 4. The following, information is required for all site plan submittals S 180-13 C.3. and is not shown on the plan currently under review. These items remain from the longer list previously noted_ Topography of site and adjacent lands. The entire area of the site plan does not include topography. - Radii of curb cuts. - Drainage (Show proposed elevations and spot grades as appropriate. As noted earlier, drainage design must comply with DEP requirements.) - A professional engineer or an architect stamp. 5. NEW COMMENT - A full design of the on-site drainage system must be shown on the plan. It must reflect DEP and DPW requirements for the added impervious area. The current plan shows sheet flow off the parking areas with no on-site detention. The sheet flow of the parking lot, particularly the western edge onto the adjacent property off the site is not appropriate. If you have any questions, please contact our division.
