The proposed location is on the property of Leonard and Birdie Mae Gardner, 1804 Main Street,Agawam,MA 01001, Tax Map No. KI, Block 1,Lot 3. Introduction American Tower is the nation's leading independent full-service infrastructure company operating more than 13,500 towers in North America, giving effect to pending transactions. Based in Boston,the company has a national footprint with regional hubs in Boston, Atlanta, Houston, San Francisco,and Chicago. A publicly traded company on the New York Stock Exchange, American Tower develops, acquires, manages and leases tower sites to the broadcast and wireless communications industries. We have established relationships with virtually every wireless provider in the country, allowing us to aggressively market collocation space on these facilities. At this time,VoiceStream, Cingular and Nextel have equipment located on the existing site at 1804 Main Street in Agawam. American Tower's principal line of business is renting space on these facilities and providing related services for a diverse range of wifeless communications, including personal communications services (PCS),cellular,paging,two-way radio, specialized mobile radio (SMR), enhanced specialized mobile radio(ESMR), and other wireless technologies. A direct result and community benefit of American Tower's proposal is the alleviation of unnecessary tower proliferation. Proposal American Tower has entered into an agreement with Leonard and Birdie Mae Gardner to lease a 60' x 75' parcel of land, upon which currently stands a 190' monopole telecommunications tower with three carriers. Applicant proposes to rebuild the existing structure, maintaining the current height. Applicant proposes to construct a 190' monopole, capable of holding six carriers, immediately adjacent to the existing structure. Upon completion of the new structure, the old one will be dismantled immediately. The proposed wireless service facility will be comprised of the 60' x 75' fenced equipment compound,containing one 190' monopole. None of the existing ground shelters will be disturbed. The property is zoned Business B, and a telecommunications facility is permitted subject to the issuance of a Special Permit and Site Plan Review, On October 4, the ZBA voted unanimously to approve the requested Special Permit. Applicant now submits the proposal to the Planning Board for Site Plan Review. The facility will be unmanned and visited on an average of once a month for routine maintenance, so it will not cause an increase in traffic volumes. It will emit no noise, glare or odor, and will not interfere with either television or radio reception,nor will it have any signage other than those required for identification. The facility will comply with the strict guidelines of the FCC and FAA, which are designed to protect public safety. To ensure the structural integrity of the tower, American Tower will construct and maintain it in compliance with all federal, state, and local building codes and standards. Site Selection/Design n American Tower carefully selected this location to re-build a multiple carrier structure that will provide the necessary coverage for the Town of Agawam. Each site must be precisely located relative to other sites. The design must reflect the contours of and topography of the area, and the radius of the antenna's reliable transmission. American Tower has assisted virtually every wireless provider in the country, including the current tenants, with their infrastructure development, and is aware of the associated requirements. Following a thorough investigation of the properties in the geographic area,we have concluded that there are no existing structures within a reasonable distance of the location that are feasible for the proposed collocation. This particular site was selected to provide adequate height and range of coverage for wireless service providers. American Tower builds all new structures to accommodate antennas for additional carriers, and we are confident that this site will be an ideal location. Communities must develop the necessary communication infrastructure, as they do with sewers, roads, and other public utilities. These structures are critical for maintaining the safety and general welfare of the community, while not disrupting the scenic views in the area. Poorly designed or insufficient communication infrastructure will result in communities not being able to provide adequate education, information, and safety services. Additionally,this site will provide a necessary communication link for new businesses and industry coming to the area, thereby promoting economic growth. A properly designed communication facility at the proposed location will benefit the public by providing essential wireless services to the community while maximizing a location that has already been designated for use as a telecommunications facility. The proposed tower will be built for collocation and will be able to double the number of carriers on the existing structure,reducing the need for additional towers in the area. Every day, over 50,000 emergency 911 calls are made from wireless phones. The proposed American Tower site enhances the general welfare of the community by providing the infrastructure for these calls, as well as providing vital means of communication during times of emergency when traditional land lines are not available or in cases of power failures. The carefully selected and designed facility allows these calls to occur, while meeting the needs of the current and future carriers in the area. (i) The only signage to be located at the proposed facility is that required by federal law. At this time, applicant intends to place one sign, approximately three square feet in area, on the outside of the fence of the compound. This sign will designate applicant as the owner of the facility, it will provide the identification number of the facility, and it will contain an emergency phone number. (j) At this time, applicant does not plan to provide any exterior lighting at the facility. After the public hearings and after a thorough review of the facts presented at the public hearing and an "on-site"inspection, the Agawam Board of Appeals made the following findings: 1. The subject property is located in an area of Town zoned Industrial A. 2. The petitioner wishes to replace the existing 190'monopole and expand the telecommunications facility. 3. Section 180-7, Paragraph B2 states a building or structure or land being put to a nonconforming use may be "altered or enlarged in that use,but only after the granting of a permit thereof by the Board of Appeals". 4. Opposition was expressed at the public hearings. 5. The specific site is an appropriate location for the proposed use and structure. 6. The use as developed, subject to the conditions set forth herein, will not adversely affect the health, safety or property values of the neighborhood. 7. There will be no nuisance or potential hazard to vehicular or pedestrian safety. 8. Adequate and appropriate facilities and controls will be provided for the proper and safe operation of the proposed use. There will be no storage of combustible materials on the subject property. 10. There will be no lighting of the tower and any lighting provided to the fenced-in area must be directed inward so as not to stray from the boundaries of the subject property. 11. The applicant will maintain the site in good order and condition. 12. The Town will be permitted to install a public safety repeater system on the tower so long as said system does not interfere with applicant's use or the use of other co-locators. If said equipment is available at the time the tower is constructed, applicant will install the equipment on the tower without any charge to the Town. 13. The applicant shall allow additional telecommunications carriers to locate equipment on the tower and at the site for fees consistent with market rates. Co-locators shall be allowed on the monopole tower without the need for an additional special use permit. Additional co-locators, however, must obtain any and all other permits required by the Town of Agawam Zoning Ordinances including building permits and variances as applicable. 14. The applicant shall take all reasonable steps needed to minimize the visual impact of the facility by use of appropriate painting and screening. 15.
