DECISION OFBOAP0 OF APPEALS Petition of Six Flags New England Premises affected: 1623 Main Street Date:T5ecember 18,2001 Case#: 1669 The Board of Appeals conducted a public hearing on December 6, 2001, and a public hearing and meeting on December 13, 2001, at the Agawam Middle School, 68 Main Street, Agawam, MA, for all parties interested in the appeal of Six Flags New England which is seeking a . Variance from Section 180-8,Paragraph B of the Zoning Ordinances, which would allow for the construction of a wooden soundwall at the premises identified as 1623 Main Street. The Agawam Board of Appeals, after said public hearings and meeting duly noted, and after a thorough review of the facts presented at the public hearings and after an"on-site"inspection, concluded the following: I. Six Flags New England is an established amusement park, which has been in continuous operation at this location for over 67 years. 2. The subject property is Iocated in an area of Town zoned as a Business B district. 3. The petitioner is proposing to construct a 20' high wooden sound barrier to the rear of the park, mostly along the Riverview Avenue boundary. 4. Section 180-50, Paragraphs A and B states rear yards shall be a minimum of 35' and side yards 15'. 5. This barrier surrounding the Town's pumping station has a set back and side yard of 5, thus the request for relief. 6. Several area residents spoke in favor and in opposition to this request. 7. The subject property is unique in its size and shape and in its topography due to the taking of land by the Town to accommodate a pumping station. 8. A literal enforcement of this Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 9. The granting of this Variance will not be substantially detrimental to the public good,nor will it derogate from the intent and purpose of the Agawam Zoning Ordinances. t 'i, y 1- DEC 2 t01 Page 2 Six Flags New England Case#1669 Z. Based in its findings,the Board is of the opinion that the requested relief is within the authority,. _ of the Board of Appeals to grant a Variance as stated under Massachusetts General Laws, Chapter 40A, Section 10. The 20'wooden sound barrier will be constructed according to the plans submitted to this Board at the December 13, 2001 hearing. 2.
