As discussed, the School Club currently is a licensed "School Age Child Care Program" pursuant to G.L. c. 28A and its operation is overseen by the State Office of Child Care Services . The license covers the premises located at 1403 Suffield Street, Agawam, Massachusetts operated by the School Club and currently serves 50 children. The School Club will shortly be filing for site plan approval for the redesign and expansion of its current facility. The license for its expanded school age child care program has been approved, subject to the construction of the proposed expansion by the Office of Child Care Services. The expanded facility will service in excess of one hundred (100) children. The School Club operation at the Suffield Street location being licensed as a School Age Child Care Program provider as defined in section 9 of G.L. c. 28A is, as such, exempt from local zoning use requirements pursuant to G.L. c. 40A, § 3. See Petrucci v Board of Appeals of Westwood, 45 MASS, App. Ct. 818, 821-822; 702 NE2d 47, 50 (copy attached) . G.L. c. 40A, § 3 provides in pertinent part (paragraph 3) that "No zoning ordinances or bylaw in any city or town shall 'prohibit, or require a special permit for, the use of land or structures, or the expansion of existing structures, for the primary, accessory or incidental purpose of operating a child care facility; provided, however, that such land or structures may be subject to reasonable regulations concerning the bulk and height of structures and determining yard sizes, lot area, setbacks, open space, parking and building coverage requirements . As used in this paragraph, the term " child care facility" shall mean a day care center or a school age child care program, as those terms are defined in section nine of chapter twenty-eight A." (Emphasis added) (Section 3 is attached as Exhibit A) G.L. , c. 28A, § 9 defines a school age child care program as "... any program or facility operated on a regular basis which provides supervised group care for children not of common parentage who are enrolled in kindergarten and are of sufficient age to enter first grade the following year, or an older child who is not more than fourteen years of age, or sixteen years of age if such child has special needs. Such a program may operate before and after school and may also operate during schooll vacation and holidays. It provides a planned daily program of activities that is attended by children for specifically identified blocks of time during the week, usually over a period of weeks or months . A school age child care program shall not include: any program operated by a public school system; any part of a private, organized educational system, unless the services of such system are primarily limited to a school age day care program; a Sunday school or classes for religious instruction conducted by a religious organization where the children are cared for during short periods of time, while persons responsible for such children are attending religious services; a family day care home except as provided under large family day care home; an informal cooperative arrangement among neighbors or relatives; or the occasional care of children with or without compensation therefor." (G.L. , c. 28A, S 9 is attached as Exhibit B. ) The Office of Child Care Services has determined that the current operation of the Sand Trap Facilities at 1403 Suffield Street is a school-age child care program and has licensed it as such under its authority under c. 2 8A of the general laws . I have attached a copy of the current license to operate a School-Age Child Care Program covering the premises at 1403 Suffield Street (see Exhibit C) and a copy of a brochure outlining the current staff, equipment and services and School Club programs covered by the license. (Exhibit D) The section 3 exemption prevents a municipality from prohibiting or requiring a special permit for the use or Expansion of structures for the primary, accessory or incidental purposes of operating a School Age Child Care Program. All of the proposed modifications to the premises as well as all the programs, games and activities offered will either be primary, accessory or incidental to the operation of licensed program. The expansion of the School Club facilities will result in the closure of the existing chip and putt course and replace it with domed indoor recreational area with batting cages, golf simulator, new recreational areas, new parking area and new structures for class activities with both indoor and outdoor programs . A restaurant is also to be incorporated into the new design for use by the participants. A rendering of the proposed site is included as part of Exhibit D. The operation of the School Club as it currently exists and as. proposed, is allowable as of right at the current location. Any prior issues that may have existed regarding the use of this site are not applicable in light of School Club' s exemption from local zoning use restrictions .
