My client would like to create a building lot out of the land between Lot#3 on the west on said plan and Alexander Avenue on the east and three or four lots fronting on Churchill Avenue. I understand the Town's usual position will be that since this will be a subdivision Chapter 41 Section 8 1 L would apply and in this case Churchill Avenue and Alexander Avenuse would have to be constructed and laid out in order to obtain subdivision approval. Will the Board consider a subdivision approval that would create the rear tots as non buildable lots recited onto the plan until such time as adequate legal access is provided to these lots? My client would be willing to place a deed restriction on said lots prohibiting any construction on said lots until such time as adequate legal access is provided to said lots. It is my understanding that the Town has been discharging storm water runoff onto my client's premises with no record of any easement taken by the Town or granted to the Town in the records of the Hampden County Registry of Deeds.
