Dear Mr. Matz:
At its duly called meeting held on September 19,2002, the Agawam Planning Board voted to deny
the Form A for a parcel of land located on North Street Extension. The proposed plan would create
a lot that does not have the required frontage on a public way and, therefore can not be approved as
an"Approval Not Required(ANR)Plan".
If you have any questions, please contact the Planning Office at 786-0400, extension 283.
Sincerely,
Dennis B. Hopkins, Chairman

Re: N/S North Street Extension--Premises owned by Lenhart Matz
Dear Planning Board,
Please be advised that I represent Lenhart Matz of Agawam, Mass. who awns the
premises shown as an unnumbered lot on North Street Extension in Agawam on a plan dated
December 14, 2001 and recorded in Hampden County Registry of Deeds Plans 323 Page 99
Located on the westerly side of Alexander Avenue and the south side of Churchill Avenue
(unbuilt private ways).
My client would like to create a building lot out of the land between Lot#3 on the west
on said plan and Alexander Avenue on the east and three or four lots fronting on Churchill
Avenue. I understand the Town's usual position will be that since this will be a subdivision
Chapter 41 Section 8 1 L would apply and in this case Churchill Avenue and Alexander Avenuse
would have to be constructed and laid out in order to obtain subdivision approval.
Will the Board consider a subdivision approval that would create the rear tots as non
buildable lots recited onto the plan until such time as adequate legal access is provided to these
lots? My client would be willing to place a deed restriction on said lots prohibiting any
construction on said lots until such time as adequate legal access is provided to said lots.
It is my understanding that the Town has been discharging storm water runoff onto my
client's premises with no record of any easement taken by the Town or granted to the Town in
the records of the Hampden County Registry of Deeds. My client would be willing to grant the
Town an easement to do so as part of his request for subdivision approval as above stated.
r Y. Very truly yours,
Dennis E. Tully
