The Agawam Board of Appeals conducted a public hearing on August 26, 2002 at the Library
Conference Room, Agawam Public Library,750 Cooper Street, Agawam, MA, and a-.public
meeting on August 29, 2002 at the Clerk's Conference Room,Agawam Town Hall, 36 Main
Street, Agawam, MA, for all parties interested in the appeal of Thomas I &Gail B. Mathes, who
are seeking a Variance from Section 180-41 of the Zoning Ordinances, which would allow for
the construction of a siinole family dwelling with less than the required frontage at the premises
identified as Lot A,Stony Hill Road.
The Agawam Zoning Board of Appeals, after sold public1hearing and meeting duly noted, and a
thorouSh review of the facts presented, along with individual"on-site"inspections, concluded
the following:
1. The subject property is located in an area of Town zoned Agriculture.
2. The subject property contains approximately 15 acres of undeveloped land with a sixty
foot (W) frontage.
3. Section 160-41 of the Zoning Ordinances requires a frontage of at least 120 Feet.
4. The petitioners are requesting relief from the frontage regttirernent to be allowed to
construct a single: family dwelling on the subject property_
5. The petitioners have received approval from the Conservation Committee for this
proposed project.

11. This Board has found that a literal enforcement of the provisions of Section 180-41 of the
Zoning Ordinances would affect abutting properties. It is also this Board's opinion that a
literal enforcement of Section 180-41 of the Zoning Ordinances would involve a
substantial hardship on the petitioners, both financially and otherwise.
12. This Board has found that the granting of this Variance,to allow for the construction of a
single family dwelling on the subject property, will not be substantially detrimental to the
public good,nor will it derogate from the intent and purpose of the Zoning ordinances.
The neighborhood surrounding the subject property consists primarily of residential
dwellings_
Based on its findings, the Board is of the opinion that the requested relief is within the authority
of the Board of Appeals to grant a Variance as stated tinder MGL, Chapter 40A, Section 6.
Therefore, the Zoning Board of Appeals, by the unanimous vote of its three members,hereby
grants the petitioners a Variance from Section 180-41 of the Zoning Ordinances to construct a
single fancily dwelling with less than the required frontage with the following conditions:
1. This Variance provides relief from the frontage requirement of Section 180-41 of the
Zoning Ordinances only. All other zoning requirements must be met.
2. This Variance is granted to allow for the construction of one single family dwelling on
the subject property.
3. A restriction is to be placed on the deed guarantee that the subject property will be used
solely for the purpose of a single fancily residence.
4. The driveway -,hall be constructed so as to meet all Town standards.
5. All state and local building mquire►nents must be met.
6. The petitioners shall record, with the }-Hampden County Registry of Deeds, a "Hoticc of
Variance" form which shall be provided by this Board and proof of said fling must be
submitted to this Board and to the Inspector of Buildings.
7. This Variance sliall become null and void if construction sloes not commence within one
(1)year from the slate of this decision.
