8239_ZONING AMENDMENT - SITE PLANS - EXEMPT SINGLE FAMILY DWELLING � � �� - Zon � n � A ��� � nd - ��� e �� � - � , te � IcAv� S — �x2m�� � � ;, qlf, �� ,», I �) J � � we ll i� o) TOR-2002- AN ORDINANCE TO AMEND ARTICLE ViII,Section 180-13 B (3), ENTITLED "SITE PLANS",OF THE CODE OF THE TOWN OF AGAWAM WHEREAS,the Agawam Zoning Ordinance in Section 180-13 sets out provisions for the submission of Site Plans for certain identified activities; and WHEREAS, it was not the intent of this Section to unnecessarily burden single family homeowners.in the Town of Agawam, and WHEREAS, Subsection B (3) requires single family dwellings in the Ffoodplain to obtain Site Plan approval from the Planning Board and a Special Permit from the Board of Appeals, and WHEREAS, such a procedure can result in a financial hardship to owners of single family dwellings, NOW,THEREFORE BE IT ORDAINED AND ENACTED BYTHE AGAWAM CITY COUNCIL,THAT ARTICLE Vill, SECTION 180-13 B (3) 1S AMENDED TO READ AS FOLLOWS TO BE EFFECTIVE UPON ADOPTION: (3) Any use requiring a special permit from the Board of Appeals. If approved by the Town Council, the amendment will exempt single family dwellings used for residential purposes only from the requirement of Site Plan approval when they must seek a Special Permit. At present, if a residence is to be constructed or altered in the Floodplain,the owner must seek to obtain a Special Permit from the Board of Appeals, an Order of Conditions from the Conservation Commission if located in the 100 year Floodplain and Site PIan approval from the Planning Board. The Board does not feel that it was the intent of the Site Plan Review process to excessively burden residential property owners who wish to use their property solely for residential purposes. Therefore, the Planning Board recommends that such a use should be exempt from the requirement of hiring a professional to prepare a Site Plan. The Board had two public hearings scheduled for that meeting. The public hearing for the Springfield Street zone change was a continuation from the November 21, 2002 meeting. The other public hearing regarding the exemption of single family dwellings from the Site Plan requirements was also scheduled. The Planning Board must re- advertise these hearings under state law. Due to the statutory time requirements, the Council must hold its public hearing on the Springfield Street zone change within 65 days of the Planning Board's receipt of the petition which is January 5'n. Therefore the Council should go ahead and hold its hearing on December 16, 2002. However, the Planning Board will not be holding its continuation until January 2, 2003. Please hold your hearing on this item on December 16,2002,but do not vote until your first muting in January. The Planning Board will have its report ready for this zone change for that meeting. The Council has until February 19, 2003 to take action. 0 0 Regarding the single family exemption,please also hold your hearing on this item,but delay action until your January 6`h meeting.
