has taken this action based upon the decision of the Agawam Board of Appeals,case#1692,which
prohibits the placing of storage containment boxes on the site. If, in the fixture, you find the need
to make more improvements to the site, a Site Plan will be required.

This is in response to your letter dated April 4, 2003 regarding Richy's Tree Services. It appears
that you are requesting the Board of Appeals to put the cart before the horse. Your statement
that"the Planning Board anticipates that there will be a number of changes that it will require to
the Site Plan if the use is approved".
You should be aware that a site plan approved under special permit by the Board of Appeals is
final and no addition or alteration to these plans can be made without approval by the Board of
Appeals. We appreciate your concern to the applicant not to incur additional cost,but the health,
safety and welfare to our community comes first.
We suggest, to your board, that you read the Board of Appeals letter sent to you March 12, 2003,
which reads "comments and recommendations you may have to our Board, so that we may
consider them in our final decision". If you have any recommendations please give them to us to
use, and not after we issue the permit.

The Agawam Board of Appeals conducted public hearings and meeting on May 12, 2003, and
June 9, 2003, at the Library Conference Room, Agawam Public Library, 750 Cooper Street,
Agawam, MA 01001; for all parties interested in the appeal of Richard B'Shara, who is seeking a
Special Permit in accordance with Sections 180-62 and 180-55 (31) of the Zoning Ordinances
which would allow for the establishment of a tree cutting service, located at the premises
identified as Lot#14, 251 Silver Street.
After the public hearings, along with two "on-site"inspections,and after a thorough review of
the facts presented, the Agawam Board of Appeals made the following findings:
1. The subject property is located in an area of Town zoned Industrial B.
2. The petitioner wishes to locate a tree cutting business on the proposed site.
3. The petitioner wishes to store logs and cordwood on the proposed site.
4. Several area residents spoke in opposition at the public hearing
5. The Board has found that the site is an appropriate location for such a use.
6. The Board has found that the use as developed will not adversely affect the health, safety
or property values of the neighborhood.
7. The Board has found that there will be no nuisance or potential hazard to vehicle or
pedestrian safety.
S. The Board has found that there will be adequate and appropriate facilities and controls
providing for the proper and safe operation of the proposed use.
Based on its findings,the Board is of the opinion that the granting of the requested Special
Permit is within the authority of the Board of Appeals as stated under Sections 180-62 and 18Q-
55,Paragraph B (31) of the Zoning Ordinances. CIO

Now, therefore, by a unanimous vote of its three members, the Zoning Board of Appeals hereby
grants a Special Permit for the construction of the additions with the following conditions:
1. All wood cutting shall be done on the southerly part of the proposed site, as far away
from residential dwellings as possible.
2. There is to be no storage containment boxes allowed on the site at any time.
3. The hours of operation shall be Monday through Friday, 9:00 A.M. thru 5:00 P.M.
4. The petitioner shall record with the Hampden County Registry of Deeds, a "Notice of
Special Permit" form which shall be provided by this Board and proof of said filing must
be submitted to this Board and to the Inspector of Buildings.
5. This Special Permit shall become null and void if construction does not commence within
two (2)years from the date of this decision.

Dear Ms. Prouty:
At its meeting held on April 3, 2003, the Planning Board voted to table action on Richy's Tree
Service until the use has been approved by the Board of Appeals. The Board anticipates that there
will be a number of changes that it will require to the Site Plan if the use is approved. Out of
consideration to the applicant,the Board will not require that he incur the cost of the plan revisions,
unless and until the Board of Appeals acts favorably on the application.
The Board also tabled action on the Bondi's Island submission. The Chairman of the Conservation
Commission has asked that the applicant file a Determination of Applicability with the Commission.
Finally the Board tabled action on the Tower Venture's Site Plan because revised plans have not
been submitted.

1. We could not complete this review due to missing information, if we assume this is a temporary
installation we could approve it for that time period (no more than a year from approval date)
with the following conditions:
A. Request trip generation data and types of vehicles entering and exiting the site.
B. Must protect any existing bituminous sidewalk from vehicular traffic damage.
C. Would recommend bituminous pavement from Silver Street up to the 20'metal gate.
D. Would recommend extending driveway width from 15'to 20' starting from the metal gate to
existing pavement on Silver Street and installing a new 20'Radius curve at driveway exit.
2. Recommend more time to do a more in-depth sight distance study, traffic study, and review
possible need for a culvert and general drainage design for a long term approval.

Description of Site: Site is mostly wooded and has a large wetland area to the rear. The
Chairman of the Conservation Commission has inspected the site. He has recommended
that the resource areas be mapped (wetland and buffer) prior to the Planning Board
acting on the site plan. There are two residential structures close to where the work is
being done.
Provision for Traffic Flow: There is a 15' gravel driveway into the site from Silver Street.
Parking: The plan is conceptual. It does not show dimensions of parking.
Drainage: Drainage from the site has not been addressed.
Public Utilities: Not provided.
Landscaping/Screening and Buffers: Not provided.
Sign Location: Not provided.
Exterior Lighting: Not provided.
Rendering or Elevations: Not provided.

Other Comments or Concerns: This plan was provided to the Planning Board and the
Board of Appeals as a result of the Building Inspector determining that the use is
offensive and needs a Special Permit from the Board of Appeals. The abutters
complained about the noise associated with the activities conducted on the site (i.e.,
chain saws, chippers, etc.). I would suggest that the Planning Board delay action on this
plan until it is determined whether the Board of Appeals will approve the use. If they
do, then the Planning Board may wish to consider sound barriers, permanent structures
to house sanitary facilities, formal parking and the like.
