CO � � . sd(oa May 17,2005 Planning Board Town of Agawam 36 Main Street Agawam,MA 01001 RE: Regal Homes and Development Corporation Buffer Strip Nolan Lane/Avalon Place Dear Planning Board, Pleased be advised that the below property owners of Nolan Lane, Feeding Hills, MA have retained counsel to represent us with regard to the permanent buffer strip. On or about April 17, 2002, a covenant to create a permanent buffer strip protecting the above-referenced property was recorded by Regal Homes and Development. See Hampden County Registry of Deeds,Book 12271, Page 272. The buffer strip created by said covenant requires"no cutting of trees, clearing of brush, grubbing, digging, filling with sod, soil, fill or other debris and no construction of buildings, swimming pools or other structures shall be allowed in the buffer strip". Since that time Regal or its successors or assigns have cut trees down, cleared brush,installed sprinkler systems and constructed other structures within the permanent buffer strip. These acts are clearly in violation of the above-mentioned covenant. We have attended numerous meetings with the Town of Agawam, Regal Homes and some of the owners of Avalon Place concerning the permanent buffer strip. As of now nothing has materialized with regard to restoring the permanent buffer strip. There have been plans put forth to the property owners of Nolan Lane that would restore or simulate a permanent buffer strip along with addressing the water run off and soil erosion issues,but none of these plans have ever materialized. We continue to experience problems with these issues to our properties. We have submitted lists of the issues concerning each property owner affected on Nolan Lane, as well as some solutions to the problems. We request a meeting to address all of our concerns. We are requesting that the Town of Agawam/Planning Board withhold the bond until the permanent buffer strip is restored, along with resolution to the soil erosion issues.
