The Board of Appeals conducted a public hearing on June 24, 1999 and a reconvened public
hearing and public meeting on July 22, 1999 at the Agawam Middle School Cafeteria, 68 Main
Street, Agawam, MA for all parties interested in the appeal of William Moccio, who is seeking a
Special Permit in accordance with Section 180-55, Paragraph B-30 of the Zoning Ordinances,
which would allow for the creation of a trucking terminal at the premises identified as 339 Silver
Street.
After the public hearings and after a thorough review of the facts presented at the public hearings
along with individual "on-site" inspections, the Agawam Board of Appeals made the following
findings:
I. The subject property consists of approximately 36 acres of land and is located in
an area of Town zoned Industrial B.
2. The petitioner proposes to construct a trucking terminal. A one-story building will
accommodate office space, and a truck repair area for the loading and unloading of
trailers. The site will also include separate parking areas for employees, drivers,
tractors and trailers.
3. Section 180-55, Paragraph B-30 states a trucking terminal may be allowed only
after a public hearing before the Board of Appeals.
4. The proposed facility can accommodate up to 150 trailers. However, this
maximum will occur only 34 times a year with the average number being
approximately 40.
5. The immediate neighborhood is a mixture of residential and business structures.
6. The petitioner is currently operating Responsive Trucking, Inc. on a lot at
449 Silver Street.

7. There is a brook and designated wetlands to the sides and rear portions of the
property. All parking will be a minimum of 300 feet from the edge of the
wetlands.
8. Several area residents spoke of their concerns during the public hearing. No one
spoke in opposition at the hearings.
9. One letter of opposition for the proposed trucking terminal was received by this
Board.
10. Memos were received from the Planning, Engineering and Police Departments.
Memos were also received from various individuals regarding Responsive
Trucking's safety record.
11. This Board has found that the specific site is an appropriate location for such a
use.
12. The proposed use, subject to the conditions set forth herein, will not adversely
affect the health, safety or property values of the neighborhood.
13. The proposed use as developed will not create a potential hazard to vehicular or
pedestrian safety.
14. The Board is of the opinion that, subject to the conditions set forth herein,
adequate and appropriate facilities and controls can be imposed for the proper and
safe operation of this proposed use.
Now, therefore, the Zoning Board of Appeals, by the unanimous vote of its three members,
hereby grants the petitioner a Special Permit under Section 180-55, Paragraph B of the Agawam
Zoning Ordinances for the creation of a trucking terminal at the premises identified as 339 Silver
Street with the following conditions:
1. The petitioner shall construct the proposed trucking terminal according to the
revised plans dated 7/21/99, entitled Responsive Trucking, Inc., and prepared by
D. L. Bean, Inc. at Westfield, MA with the exception of the driveway placement.
2. The driveway and turning radius at the end of the driveway must receive approval
from the Engineering and Police Departments.
3. The petitioner must receive Site Plan Approval from the Planning Board.

4. The petitioner must receive approval from the Conservation Commission.
5. A letter from Tenneco, allowing the petitioner the use of the easement property,
must be submitted to this Board.
6. There is to be no storage of hazardous materials or bulk liquid trailers.
7. This Special Permit shall allow for the storage of up to 100 trailers and not more
than 40 tractor/truck vehicles.
8. No repair work of any kind shall be allowed out-of-doors. All tractor truck repairs
and maintenance will be performed in the service area of the planned officelservice
building.
9. The petitioner's usual hours of operation shall be 7:00 A.M.-7:00 P.M., Monday
thru Friday. The petitioner is allowed a maximum of two (2) trailer trips during off
hours, including week-ends, except during the last week of June and the last week
of September when there will be a maximum of six (6) trailer trips.
10. If in the future, the petitioner wishes to fence in a"bonded" area, such area must
be to the rear of the subject property.
11. Plans and construction shall be in accordance with the requirements of the Town
Engineer.
12. The petitioner must construct the proposed trucking terminal in accordance with
all local and state regulations.
13. The petitioner shall record with the Hampden County Registry of Deeds, a"Notice
of Special Permit" form, which shall be provided by this Board and proof of said
filing must be submitted to the Inspector of Buildings and to this Board.
14. This Special Permit shall become null and void if construction does not commence
within two (2) years from the date of this decision.

Slate also dated March 26, 1999 and have the following comments:
1. The survey data for Parcel 1 furnished with this Form A is in agreement with the original
survey data that appears on the Responsive Way "Definitive° Sub-division of Land Plan for
Liquori& Slate, latest revision July 17,1997. A small piece of land (2.1597 acres) has now
been added to Parcel 1 at it's Eastern corner. This addition provides 176.02' of frontage
for lot 1, which previously had only 60.12.
2. Street numbers should be added for some of the existing lots along Silver Street.
3. Except as noted above, we have no objection to this form A.
