Provision for Traffic Flow: There are two existing curbcuts (60' and 54'). Radii have not been shown. It is not clear how the trucks will circulate through the site and whether they will conflict with the employee/customer parking. Parking: Thirteen (13) parking spaces have been shown. No handicapped spaces have been provided. The applicant has indicated through his Special Permit application that the property is to be used as a trucking terminal. No information has been provided as to the number of employees or the number of trucks to be kept on the site. Therefore, a number of parking spaces can not be calculated. As was stated above, some of the proposed spaces may conflict with the truck traffic on the site. Also cars are forced to back out onto Ramah Circle to exit some of the spaces. Other Comments or Concerns: It TOWN OFAGAWAM 36 MAIN STREET AGA WAM, MA 01001 y� DECISION OF BOARD OF APPEALS cn Petition of: Douglas Dreyer Premises affected - 55 Ramah Circle North Date - June 3, 1999 Case 9 1593 ► The Board of Appeals conducted a public hearing on May 6, 1999 at the Middle School Auditorium and a re-convened public hearing and public meeting on May 20, 1999 at the Agawam Middle School Cafeteria, 68 Main Street, Agawam, MA for all parties interested in the appeal of Mr. Douglas Dreyer, who is seeking a Special Permit in accordance with Section 180- 55, Paragraph B-30 of the Zoning Ordinances, which would allow for the creation of a truck terminal. The Agawam Board of Appeals, after said public hearings and a public meeting duly noticed and after a thorough review of the facts presented and individual "on-site" inspections, find the following: 1. The subject property is located in an Industrial A zone. 2. The petitioner has leased approximately 1200 square feet of existing structure to Brothers Trucking in order to accommodate six (6) tractor trailer vehicles. 3. Section 180-55, Paragraph B-30 allows for the use of a trucking terminal after a public hearing before the Board of Appeals. 4. A letter from WMECO, dated 5/18/99 was submitted, which states that the petitioner's request will in no way affect their easement right along the subject property. 5. Memos from Mr. James Daley, Town Engineer and Ms. Debbie Dachos, Director of Planning, were submitted to this Board. 6. Two (2) letters of supports for this petition were received by this Board. There was no opposition voiced at the public hearings nor received in writing. 7. The proposed use will not be against the public interest or detrimental or injurious to the character of the neighborhood. 9. The proposed use is in harmony with the general purposes and intent of the Town of Agawam Zoning Ordinances. Now, therefore, the Agawam Zoning Board of Appeals, by the unanimous vote of its three (3) members, grants the petitioner a Special Permit under Section 180-55, Paragraph B-30 of the Agawam Zoning Ordinances to allow for the creation of a trucking terminal, subject to the • following conditions: `j 1. The petitioner must receive Site Plan Approval from the Agawam Planning Board. 2. A maximum of six (6) tractors and six (6) trailers may be allowed on the subject property. 3. There will be no storage of hazardous materials on the subject property. 4. Storage of goods in trailers will be allowed up to a seven (7) day period. 5. There will be no repair of vehicles allowed on the subject property. 6. There will be no storage of junk materials allowed on the subject property. 7. No tankers of any kind will be allowed on the premises. 8. This Special Permit shall remain in effect for three(3) years from the date of this decision. The petitioner is required to file a renewal application with this Board at least sixty (60) days prior to expiration. 9. The petitioner shall record with the Hampden County Registry of Deeds a" Notice of Special Permit" form, which shall be provided by this Board and which proof of said filing must be submitted to the Inspector of Buildings. 10, This Special Permit shall become null and void if such action is not taken with two (2)years from the date of this decision. There are no major defects in the roadway. The travel lanes have no painted markings. Visibility: Visibility is clear in both directions for traffic exiting the property. Lighting:There is one street light located 108'to the northeast and another one 243' to south. There is private lighting from the other businesses in the area. Traffic Controls: There are no traffic controls present. Sidewalks: There are no sidewalks present. School Zones: The Agawam Middle School and the Robinson Park Elementary School are within a 1 'h mile radius. Playgrounds: Both the Middle School and Robinson Park Elementary School have playgrounds.
