Description of Site: Site is presently fully developed as a car lot (previously a gas
station). Most of the site is in building, pavement or gravel. There is a wetland within
50 feet of the site.
Provision for Traffic Flow: Plan shows two proposed approximately 30' curbcuts on
to Main Street. Presently there is only one curb cut.
Parking: Eleven (11) parking spaces are being proposed. Agawam's Zoning
Ordinance requires fifty (50) spaces for a drive-thru restaurant. The applicant is
seeking a variance from this requirement from the Board of Appeals. The Planning
Board's Parking Guidelines require 1.5 spaces for every 200 sq.ft. of gross floor area.
This would necessitate 20 spaces.
Drainage: The Site Plan does not address drainage. A drainage plan must be
submitted, prepared by a register Engineer and reviewed by the Engineering
Department.
Public Utilities: No utilities are shown on the plan.
Landscaping/Screening and Buffers: In 1997, the Town received a grant to plant
trees along both sides of South Main Street. Trees were planted in the treebelt of this
property. Those trees should not be removed or future grant funds will be jeopardized.
Trees located in the public way require permission of the Tree Warden for removal
and a public hearing. The following landscape note must be placed on the plan: "All
plantings must be maintained and that portion of the public way abutting the parcel
and including the treebelt shall be maintained in a safe and attractive condition by the
owner of the parcel."

Exterior Lighting: All exterior lighting must be shown, heights and types.
Rendering or Elevations: A colored rendering must be provided. Textures must also

Other Comments or Concerns: The Building Inspector is requiring that a Special
Permit be sought for this application (Drive-thru) and three variances. The variances
relate to the provision of the less than the required fifty parking spaces and setbacks.
Since the plan so heavily relies on the Board of Appeals actions, I would recommend
not taking any action until the Board of Appeals has rendered its decisions.

The Board of Appeals conducted a public hearing and meeting on July 8, 1999 at the Agawam
Middle School Cafeteria, 68 Main Street, Agawam, M.A.for all parties interested in the appeal of
O'Connell Oil Associates, Inc., who are seeking relief in accordance with Section 18046,
Paragraph C of the Zoning Ordinances, which would allow for the construction of a structure
with less than the required rear yard at the premises identified as 1801 Main Street.
The Agawam Zoning Board of Appeals, after said public hearing and meeting duly noticed, and
after a thorough review of the facts presented at the public hearing and after individual "on-site"
inspections, concluded the following:
1. The subject property is located in an area of Town zoned Business A.
2. Section 180-46, Paragraph C of the Agawam Zoning Ordinances requires a rear
yard of at least twenty-five feet (25').
3. The petitioner is requesting a Variance from Section 180-46, Paragraph C of the
Zoning Ordinances in order to construct a 100 ft. by 28 ft. canopy with a rear yard
of fourteen feet two inches (14'2").
4. The petitioner cited that the relief requested is necessary to protect the electronic
and computerized components of the proposed four (4) gasoline dispensers.
5. Several area residents expressed their concerns during the public hearing.
6. Memos were submitted to this Board from:

8. The Board has found that a literal enforcement of the provisions of this Zoning
Ordinances will not restrict the use of this parcel. As such, it is the Board's
opinion that the petitioner is not being subjected to a substantial hardship, financial
or otherwise.
9. The Board has found that the granting of this Variance to allow for the
construction of the proposed canopy would be substantially derogating from the
intent or purpose of Section 180-46, Paragraph C of the Agawam Zoning
Ordinances.
Now, therefore, the Zoning Board of Appeals, by the unanimous vote of its three members,

At its duly called meeting held on June 17, 1999, the Agawam Planning Board voted to return the
Site Plan entitled "O'Connell Oil Associates Convenience Plus, Site Plan for 1801 Main Street,
Agawam, MA" prepared by Decker & Company and dated June 27, 1999. The Planning Board's
decision to return the plan is due to the need for a Special Permit and three (3) variances from the

Per your request dated June 1, 1999 we have reviewed the site plan entitled, " Site Plan for
1801 Main Street, Agawam, MA, prepared for O'Connell Oil Associates Convenience Plus, by
Decker& Company, dated May 27, 1999, Scale 1"=10"' and we have the following comments:
1.) The submitted plan notes a 50 parking space requirement while providing 8 to 11 parking
spaces and the proponent apparently intends to deal with this matter in subsequent actions.
2.) Our comments noted in our Memorandum to the Conservation Commission dated June 9,
1999 still apply for this site, a copy has been attached. Some of the comments may impact
the present design.
3.) The following note should be added to the plan, "All plantings must be maintained and that --�
portion of the public way abutting the parcel and including the treebelt shall be maintained
in a safe and attractive condition by the owner of the parcel."
4.) The following complete note should be added to the plan,"Prior to any installation of any
sewer, water or drainage lines, the contractor/owner shall contact the Town of Agawam's
Engineering Division, 786-0400 x 275/8. No piping/appurtenances will be installed or
backfiiled without the permission of the division."
5.) A Curb Cut Permit will be required by the Massachusetts State Highway Department. The
proposed southern most curb cut for this property cannot extend in front of the property
south of this site. All radii should be labeled throughout the site.
6.) The handicap ramp shown north of the handicap van parking space, should be labeled. A
detail should be included on the plans that conforms with the current AAB standards.
7.) A detail of a parking lot/pavement typical section should be added to the plans.
8.) A detail of a sidewalk section should be added to the plans. The sidewalk should extend
southerly(in front of the proposed building)two feet to maintain a 4'minimum walkway for
pedestrians to accommodate 2' overhangs by parked vehicles.
9.) In keeping with our policy,we recommend cement concrete sidewalks and vertical granite
curb to be built within the Right-of-way along the Main Street frontage. Details should be
included on the plans for these items.
10.) A detail of the proposed curbing throughout the site should be included in the plans.
11.) All existing utilities should be shown on the plan. The existing water service is not shown
and can be utilized for this site.
12.) The proposed cleanout for the sanitary sewer line will be located within the pavement. A
detail should be provided and include a cleanout cover("Neenah R-7506 Series Floor Box
Frame and Lid or equal wIS.S. cap screw lid closure) and must include a concrete collar.
13.) The easement should be shown for the sanitary sewer line runs throughout the adjacent
property north of the site. Currently if the easement does not exist, then it will have to be
obtained.

Subject: Notice of Intent- 1801 Main Street-O'Connell Associates - CC 215
Per your request dated May 28, 1998 we have reviewed the Notice of Intent for O'Connell
Oil Associates, 1801 Main Street, Agawam, MA and have the following comments:
1.) While this site does not meet the threshold of one acre, to be under the jurisdiction of the
Town Storm Drain Ordinance, we are concerned about the drainage. The proposed
infiltration drainage disposal may not work as expected with a high ground water table or
with a clogged soil infiltration bed. An overflow system discharging to the State's drainage
system in Main Street may be acceptable to the state if there is sufficient attenuation in an
on-site detention system. We recently discussed such a system for a location very close to
the subject site with the state.
2.) The submitted Notice of Intent states that there is an intermittent stream over 100'away from
the proposed service station. The plan does not include an inner and outer riparian of the
stream because it is labeled as an intermittent stream nor does it show the streams location
on the submitted plan. We recommend that the Conservation Commission verifies that it is
an intermittent stream.
3.) It is mentioned in the Notice of Intent that this site is not exempt from the Stormwater
Management Policy. If it is not exempt from the Stormwater Management Policy, the
applicant will have a fill out a completed Appendix C. Considering that there is not an outlet
directly discharging in the nearby wetlands and subject to item No. 1,our division questions
whether the Stormwater Management Policy is applicable.
4.) Our division recommends that test pits should be preformed to check the depth of the
groundwater in the area where the subsurface drainage system is being implemented. We
have witnessed a high ground water table while inspecting a sewer connection in this area..
5.) The submitted USGS Topographical Map has been blown up to an unknown scale. The scale
should be added to the plan. Show the layout lines of Sunnyslope Avenue and Veranda
Drive,break lines can be used,so as to show the relation of those streets to the subject site.
6.) A detail of the 12,000 gallon UST Tanks (as well as its depth) should be included on the
plans. The Notice of Intent mentions that it is included in the site plan The detail was not
included on the site plan.
7.) The location of the 24"perforated pipe in a bed of stone should be included on the plan, A
detail of this should be submitted as well as its depth that it will be placed in the ground. We
recommend a test pit in the location of the 24" perforated pipe as well.
8.) The plan should include the rim and invert elevations of the proposed Drain Manholes. The
plan should also include details of the Drain Manholes and the Catch Basins.
9.) A detail, if need be, should be submitted of the silt sack to protect nearby existing catch
basins.
10.) The 100'buffer from the wetlands should be labeled on the Grading&Utility Plan.
11.) There should be a proposed 88'contour north of the proposed building.

Roadway: Main Street is a State Highway that is heavily traveled by both commercial traffic and
commuter traffic. Traffic is also affected by patrons of Riverside Park. Main Street is a paved
roadway with the north bound lane being appr. 13 feet wide and the south bound lane being appr.
12 feet wide. Both sides of the roadway have break down lanes that are 6 feet wide.
Visibility: The visibility is unobstructed in both directions for traffic pulling out of 1801 Main
Street.
Lighting: There is a street light located across the street from 1801 and there is another street
light located appr. 200 feet to the south of 1801. There are numerous businesses in the area that
provide commercial lighting.
Traffic Controls:None Present.
Sidewalks:None.present.
School Zones: James Clark Elementary School and Borgatti Field are both within one mile of
the site.
Playgrounds: James Clark Elementary School and Borgatti Field are both within one mile of the
site.
Parking: There are 8 parking spaces with one designated Handicapped parking space on the site
plan. This complies with the Town of Agawam Handicap parking ordinance.
