The plan still shows two drive-thru windows. It is my understanding that the Board of Appeals has denied one of the windows and that you are appealing their decision. The plan should reflect the Board of Appeals' decision. 2. The Planning Board had asked in their letter of June 22, 1999 that you revise the canopy by providing recessed lighting and some colonial features. This still has not been done_ 3. In the same letter(June 22, 1999)the Planning Board requested a traffic plan which must include some conceptual queuing of various sized vehicles. This plan has not been provided. 4. Curb-cut radii have not been provided. 5. Only 47 parking spaces have been shown on the plan. There must be a minimum of 50 parking spaces shown. 6. The Engineering Department has informed this office that the drainage issues have not been resolved. 7. Colors and textures of the proposed building must be provided. 8. The dumpster must be screened and fenced with a gate. The size and type of enclosure must be shown on the plan. 1 9. The loading area must be moved at the Building Inspector's request to the north side of the building. The Drive-thru window shown on this elevation should be removed. 14. All plans must be stamped by the appropriate profession. Please be advised that this is only my review. Additional issues may be raised by other departments and the Planning Board. Premises affected - 6 North Westfield Street Date - October 4, 1999 Case# 1609 The Board of Appeals conducted a public hearing on August 5, 1999 and reconvened on September 2, 1999 at the Agawam Middle School Cafeteria, 68 Main Street, Agawam, MA for all parties interested in the appeal of Pride Convenience, Inc., which is seeking a Special Permit in accordance with Section 180-44, Paragraph I of the Zoning Ordinances, which would allow for the construction of a"Drive-up Bank Automated Teller Machine" at the premised identified as 6 North Westfield Street. A thorough review of the facts presented at the public hearing along with several on-site inspections by individual members of the Board, allowed the Board to conclude the following facts in evidence: 1. The premises in question, 1380 Springfield Street is an existing"gas-convenience store" operation which has been owned and operated by the petitioner for several decades. 2. The petitioner has purchased additional land in order to be allowed to upgrade and expand it's current operation. 3. It is on this additional land purchased by Pride Convenience that the proposed "Drive-up Bank Automated Teller" machine will be located. 4. A plan presented to this Board dated 9/l/99 and revised, displays a proposed traffic plan and parking with fifty (50) parking spaces including three (3) handicapped spaces, as required by law. 5. Pride Convenience is in the process of receiving Site Plan Approval for,,this location. 6. At the original hearing one of the abutters voiced her concern for traffic, noise and pollution caused by this operation. Case 4 1609 Decision Continued 7. The Stop and Shop Supermarket Company, an abutter submitted a letter to the Board outlining their concerns for traffic and drainage. 8. There are several automated teller machines located throughout the Town including two (2) within 100-200 feet of the proposed operation. The Board has found that there will be no additional nuisance or potential hazards as a result of the proposed operation since adequate safeguards and controls can be provided to insure the proper and safe operation of this proposed use. Therefore, by a unanimous vote of its three members, the Agawam Board of appeals grants the requested Special Permit subject to the following conditions: 1. The proposed automated teller shall be constructed in accordance with discussions at the public hearing and with a final plan to be submitted to this Board and subject to the approval of the Building Inspector and the Zoning Board of Appeals. 2. The final approval plan for parking and traffic will be submitted to the Board and subject to approval of this Board and Building Inspector, 3. All lighting should be directed inward to the property with particular care taken for the nearest residential abutter on North Westfield Street. 4. The petitioner must receive Site Plan Approval from the Planning Board. 5. Any drainage plan must be approved by the Department of Public Works. 6. The property Iine along the North East area of the parking area must be reviewed and approved by the Conservation Commission. 7. The proposed facility will be constructed in accordance with all zoning and building code requirements. 8. There will be no nuisance or potential hazard to vehicular or pedestrian safety. d.) That adequate safeguards and controls will be provided which will allow proper and safe operation of the proposed use or service. 4. The immediate area surrounding 6 North Westfield Street is comprised of commercial and residential structures, including Banks, Gas Service Stations, Assorted Retail Businesses, a School, Churches and residential facilities. -2- Case# 1610 Decision, Continued 5. At the public hearing the Board noted an abutter's traffic, safety and pollution concerns. 6. The Board received a letter from Stop and Shop Food Supermarkets, which expressed concerns for traffic and drainage problems. The Board has found that such a use as proposed, when taken into consideration with the immediate neighborhood that there will be no additional nuisance or potential hazards since adequate conditions and safeguards can be made to insure the proper and safe operation as proposed. Therefore, by a unanimous vote of its three members, the Agawam Board of Appeals grants said Special Permit subject to the following conditions: 1. The proposed donut/coffee drive-thru shall be constructed in accordance with discussions at the public hearing and submission of a"Final Finished Plan" which must be submitted to the approval of the Building Inspector and the Zoning Board of Appeals. 1 A final completed plan for the parking and traffic flow must be submitted to the Board and subject to approval of this Board and the Building Department. 3. All lighting should be directed inward to the petitioner's site taking particular care for the immediate residential abutters on North Westfield Street. 4. The petitioner must receive Site Plan Approval from the Agawam Planning Board. 5. Any and all drainage concerns shall be addressed by the Town Engineer and the Department of Public Works. 6. A final and approved plan must be reviewed and approved by the Conservation Commission. 7. The proposed structure and drive-thru shall be constructed in accordance with all zoning and building code requirements. 8. The petitioner shall meet and address all reasonable safeguards and controls required by any and all Town, State and Federal agencies. 9. Historically, drainage has been a problem in this area and we would like to be assured the problem will not increase. We would like to be assured that the peak rate of runoff does not increase during storm events and that a stormwater management system is adopted to insure water quality is properly addressed. This is customarily done with a Drainage Study completed by the Applicant. We request the Applicant be directed to complete a study and propose proper mitigation. Our second concern is the increase in traffic. The project proposes to add fast food uses, two (2) drive through windows and an ATM machine. This should increase the traffic at the Pride site and will, therefore, increase turning movements in the adjacent roadways. There is a potential that unacceptable delays will occur in surrounding intersections and of queuing backups on both North Westfield and Springfield Streets from traffic associated with the project. It is our understanding that the Town has requested a Traffic Study to assess the impact on North Westfield and Springfield Streets. It is our feeling that due to the close proximity of the Stop & Shop signal to the Pride site, a review of the proposed traffic impacts for both traffic signals (N. Westfield/Springfield and Stop & Shop signal) is warranted to make sure impacts are properly mitigated. The proposed project consisted of a 3,800 sq.ft. convenience store with an accompanying gas station, two drive-thru restaurants (Dunkin Donuts and Subway)and a free-standing ATM. Attached please find the memos from the Inspector of Buildings, Engineering Department, the Fire Department, the Safety Officer and the Planning Department, Mr. Bolduc attended the Planning Board's June I Th meeting. The Board asked for five issues to be addressed. The letter sent to Mr. Bolduc outlining these requests has been attached. No revised plans have been submitted to date. Also at this meeting, the Board informed Mr. Bolduc that they would not take further action on this plan until the Board of Appeals had taken action on the plan. The Site Plan submitted on June 2'was a refinement of an earlier plan submitted for the site in 1996. The recent plan incorporates a number of requests the Board had regarding the earlier plan (i.e., colonial facade of building, additional parking spaces, enhanced landscaping and additional stacking room for drive-thru customers). The Planning Board appears to be satisfied that the new plan is an improvement over the earlier submitted plan. With regard to the Conservation Commission, the Commission has received a Notice of Intent and has held their public hearing. However, the plans submitted by Mr. Bolduc have not been prepared by an engineer and no drainage calculations have been submitted. Provision for Traffic Flow: The Site Plan shows three proposed curbcuts. One is on North Westfield Street and two are proposed to be located on Springfield Street. Widths and radii on all curbcuts must be shown. Parking: Fifty-one (51) parking spaces are provided. Under Agawam's Zoning Ordinance Drive-thru restaurants require fifty spaces each. The road is appr. 47 feet in total width. The eastbound lane is appr. 20 feet wide and the westbound lane is appr. 20 feet wide. The eastbound lane has a breakdown lane/PVTA bus stop that is appr. 5 feet wide and the westbound lane has appr. 2 feet from the fog line to the curb. North Westfield Street is a paved roadway with three lanes of travel. The road is appr. 42 feet in total width. The north bound lane is appr. 18 feet wide and the south bound lane is appr. 11 feet wide. The south bound lane has a left turn lane to Springfield Street that is appr. 13 feet wide. There are no breakdown lanes and no fog lines in this area. Visibility: Visibility is unobstructed and good exiting the Pride Convenience Store onto Springfield Street. Visibility is obstructed to the north with poles, mailboxes and trees and is only fair when exiting from the store onto North Westfield Street. Lighting: There is a street light located on the corner of Springfield St. and North Westfield St. and is on the same side of the roadway as the Pride. This is other lighting in the area from other businesses and houses. Traffic Controls: At the intersection of Springfield Street and North Westfield Street there is an automatic four way traffic control signal. North Westfield Street also has a left turn arrow for traffic turning onto Springfield Street and heading eastbound. Sidewalks: There is a sidewalk on Springfield St. and North Westfield St. and is located on the same side of the road as the Pride. School Zones: The Granger Elementary School is located directly across Springfield Street from the Pride. The Junior High School is located appr. 1/4 of a mile east of the Pride. Both of these schools produce a high volume of pedestrian traffic when the schools are released at the end of the day. Playgrounds: The Granger Elementary School is located directly across Springfield Street from the Pride. The Junior High School is located appr. 1/4 of a mile est of the Pride. Both of these schools have playgrounds/recreational areas for children. Parking:According to the site plan, the parking area will have 51 parking spaces, 2 which are designated as Handicapped Parking. These parking spaces are not in compliance with the Planning Board Page 2 June 17, 1999 Town code for Handicapped Parking. There should be 3 Handicapped Parking spaces in conjunction with 51 parking spaces. Other: The intersection of Springfield Street and North Westfield Street, also known as Feeding Hills Center, is one of the busiest intersections in the Town of Agawam. This intersection produces a very high volume of motor vehicle and pedestrian traffic. It would be my recommendation that the existing entrance on Springfield Street be moved east 150 feet from the intersection of Springfield St. and North Westfield St. I would also recommend that the existing entrance be"enter only". It is also my recommendation that the new entrance on Springfield St. be "exit only". These recommendations would relieve congestion in the intersection and provide for greater safety of motor vehicle and pedestrian traffic. Stone, File, VRK From: Engineering Date: June 16, 1999 "t Subject: Site Plan - Pride Convenience Store - Springfield & North Westfield Streets - SP 41 334 Per your request dated June 3, 1999 we have reviewed the site plan entitled, " Site Plan, 6 North Westfield Street, Agawam, MA 01101, Scale 1" = 20', Prepared for Pride, By V.R.D. Associates, Dated 5/28/99 " and we have the following comments: 1.) The following complete note should be added to the plan, "Prior to any installation of any sewer, water or drainage lines, the contractor/owner shall contact the Town of Agawam's Engineering Division, 786-0400 x 275/8. No piping/appurtenances will be installed or backfilled without the permission of the division." 2.) The plan should include both existing and proposed contours. 3.) There is a Notice of Intent submitted for this site and it is currently under review by the Conservation Commission. 4.) An exterior lighting plan should be included for the site. 5.) A Curb Cut Permit will be required by the Department of Public Works. 6.) A Storm Drain Permit will be required by the Department of Public Works. The area of the two lots is over an acre. Storm drain calculations will have to submitted for both pre and post conditions for 2 year, 10 year,and 100 year storms. This site will require detention with positive outflow. We do not give credit for infiltration as means of detention. We suggest consideration be given to reduction in the number of paved parking spaces, which would decrease the amount of impervious area. Based on parking generation studies published by the Institute of Transportation Engineers and the latest square footage breakdown proposed by Pride (3263 sf-convenience store, 537 sf- restaurant drive thru), peak parking demand would seem to be half of what is being provided. Perhaps the entire area can be designated for parking but full development delayed until either need is evident or use changes. In the meantime the unpaved area could be maintained in a grassed park-like setting to enhance the area and complement the common across the street. There have been drainage problems in this area in the past and the stream/drainage swale, located north of the site, needs to be dredged out because of the silt that has built up over the years. We will not waive detention on site in order to accommodate 50 parking spaces for a drive thru window. The Sheet labeled, Drainage Plan, labels the drainage pipe as Schedule 40, we do not recommend the use of Schedule 40 for drainage pipe, we recommend the use of S DR 35 (PVC). We do not accept the proposed drain line to enter the existing catch basin in North Westfield Street without any calculations proving there will not be an increase in run-off. 7.) A Form A will have to be submitted to the Planning Board for review for the proposed combining of the two lots. The submitted plan shows that there is only one lot. The Form A will have to be submitted by a Massachusetts Registered Land Surveyor. We have a plan that is entitled, " Plan of Land, Springfield &North Westfield Streets, Agawam, MA, Owned by Robert & Roberta B. Bolduc, Scale I" = 20', Dated May, 1995, by Smith Associates Surveyors, Inc." that has property line lengths that are different than the submitted plan. 8.) The location of any trees or woodline should be shown on the plan. 9,) Our qivision requests that a traffic study be done for the intersection of Springfield and North Westfield Streets to see what impacts will be created by the proposed Convenience/Fast Food Outlet will have. 10.) The existing and proposed utilities, such as the water service, sanitary sewer, and any drainage should be shown on the plan. The existing water and sanitary sewer services should be used, so as to prevent any disturbance in the pavement of Springfield and North Westfield Streets. 11.) The location of the Loading Area and the Enclosed Dumpster is less than desirable being located on Springfield Street. 12.) The location of the parking area with relationship to the proposed building would not be beneficial for this site. The pedestrians should not have to walk through traffic lanes to get to the proposed building. The handicap spaces should be closer to the building, the present path of travel on the proposed plan for wheelchairs would be difficult to navigate. 13.) Details should be included for various items throughout the plan. Details will be needed for: sidewalk handicap ramps to current AAB standards, sidewalks, curbs, parking lot - typical section, trench sections for sanitary sewer, vertical granite curbs, both drain and sanitary sewer manholes (if needed), and catch basins, etc., but not limited to these items. 14.) We request that vertical granite curb be provided along the entire length of property on both Springfield and North Westfield Streets. 15 The sidewalks within the Right of Way should be a minimum of five feet in width and according to Town Specifications. 16.) We do not have a problem with the address being changed to 6 North Westfield Street as long as the Building Department sees that there is not a problem with the change. If the address is to remain on Springfield Street, the new address should be changed to 1370 Springfield Street.
