DSD:prk � � z N O rr4 r� y TOWN OFAGAWAM 36 ii/L41N STREET AGA WAM, MA 01001 y DECISION OF BOARD OF APPEALS Petition of: Mark & Heidi Dintzner Premises affected - 970 Springfield Street Date - August 12, 1999 Case # 1608 w The Board of Appeals conducted a public hearing and meeting on July 22, 1999 at the Agawam Middle School Cafeteria, 68 Main Street, Agawam, MA for all parties interested in the appeal of Mark & Heidi Dintzner, who are seeking a Special Permit in accordance with Section I80-23, Paragraph B of the Zoning Ordinances, which would allow for the continued use of a second housekeeping unit at the premises identified as 970 Springfield Street. After the public hearing and after a thorough review of the facts presented at the public hearing and individual "on-site" inspections, the Agawam Board of Appeals made the following findings: 1. The subject property is located in an area of Town zoned Agriculture. 2. The subject property involves a residential dwelling, which contains a second housekeeping unit that has been in existence for at least 25 years. 3. The petioner wishes to convert the existing garage into two bedrooms servicing the second housekeeping unit as well as construct an addition to the opposite end of the dwelling. 4. The petitioner owns the adjoining lot and will be delineating the lot line between parcels two and three and creating one lot. 5. Three letters of approval for this petitioner were submitted to this Board. 6. There was no opposition voiced at the public hearing nor received in writing by this Board. 4. 7. This Board has found that the subject property is an appropriate location for such a use. 8. This Board has found that the use will not adversely affect the health, safety or -2- Case # 1608 Decision, Continued property values of the neighborhood. 9. This Board has found that there will be no nuisance or potential hazard to vela or pedestrian safety and that adequate and appropriate facilities and controls�nll be provided for the proper and safe operation of the proposed use. Therefore, by the unanimous vote of its three members, the Board of Appeals grants the Special Permit subject to the following conditions: 1. The proposed addition will be constructed in accordance to the plans submitted to this Board. 2. The proposed additions will be constructed to meet all zoning and buildings requirements. 3. The petitioner will delineate the property line between Parcels 2 and 3 to create one lot. 4. The petitioner must receive Form "A" approval from the Planning Board. 5. The use of this in-law apartment is for immediate family only. 6. The in-law apartment is not to be used for rental income. 7. The petitioner shall record with the Hampden County Registry of Deeds a"Notice of Special Permit" form, which shall be provided by this Board and proof of said filing must be submitted to the Inspector of Buildings.
