the property located at 156 SUFFIELD STREET, AGAWAM, HAMPDEN COUNTY,
MASSACHUSETTS, as more particularly described by deed dated December 23, 1996 and
recorded in the Hampden County Registry of Deeds in Book 9732, Page 158; and
Whereas, STRATUM LIMITED PARTNERSHIP, a Massachusetts Limited
Partnership, having an office at 335 Walnut Street Ext., Agawam,Hampden County,
Massachusetts, is the present owner of the property located at 146 SUFFIELD STREET,
AGAWAM,HAMPDEN COUNTY,MASSACHUSETTS,as more particularly described by
deed dated February 1, 1995 and recorded in the Hampden County Registry of Deeds in Book

Now, therefore, for the purpose of declaring their intentions, the undersigned hereby

1) That a driveway exists upon the land of GRAMACY,LLC. at 156 SUFFIELD

parking area of the property owned by STRATUM LIMITED PARTNERSHIP

LIMITED PARTNERSHIP for the use and enjoyment of the driveway of
GRAMACY, LLC. for the purpose of providing access to the parking area
of the property of STRATUM LIMITED PARTNERSHIP as designated by
the site plan attached hereto.
3) Said easement is granted solely for the customary use and enjoyment of a
driveway and STRATUM LIMITED PARTNERSHIP shall hold
GRAMACY, LLC.harmless for any and all damages and injuries to persons
and/or property of persons entering said driveway for access to the parking area
of STRATUM LIMITED PARTNERSHIP.
4) STRATUM LIMITED PARTNERSHIP hereby agrees to pay its proportionate
share of costs for the repair, maintenance,and/or replacement of that portion of
the driveway which is used for access to the parking area of 146 SUFFIELD
STREET.

The Board of Appeals conducted public hearings on March 4, 1999; March 25, 1999 and a public
hearing and public meetings on April 7, 1999 and May 20, 1999 at the Agawam Wddle School
Auditorium, 68 Main Street, Agawam, NL-k for all parties interested in the appeal of Stratum
Limited Partnership, which is seeking to alter a previous Board of Appeals Decision, Case ir"r 1370,
dated 4/17/92, which would allow for the commercial use of a structure in a Residential A-2
district, at the premises identified as 146 Suffield Street.
After the public hearings and after a thorough review of the facts presented at the public hearings
and indi-vidual "on-site" inspections, the Agawam Board of Appeals trade the following findings:
1. The petitioner was issued a Special Use Permit, Case r 1370, dated 4/17/92, which
allowed for the commercial use of a residential structure with certain conditions.
?_ The petitioner leased this structure for commercial use to Mr. Thomas Dzral,
owner of Preferred Payroll Plus in the fall of 1998.
3. The petitioner relocated his rental management business into the Gramacy
Apartments located at the adjoining lot on Suffield Street in violation of the
Town's Zoning Ordinances.
4_ Ntr. Dzral received a Certificate of Occupancy from the Inspector of Buildings in
October, 1998.
5. Condition r 1 of the Special Use Permit, Case `` 1370, cites that there shall be no
more than three (3) employees allowed. Preferred Payroll Plus has five (5)
employees, both full and part time.
6. Condition T 2 of the Special Use Permit, Case T 1370, cites that this use is for the
benefit of Vir. John Van Amsterdam only.
7. Condition m 3 of this Special Use Permit, Case 9 1370, cites that parking shall be

restricted to on-site parking at the Gramacy Apartments and to the existing
driveway on said premises. A sic (6) car parking area has since been constructed
on the premises without Site Plan Approval as required under Section 180-13.
8. The subject property currently has three (3) display signs. Section 180-23,
Paragraph C cites "no display, sign or other advertising devise shall be permitted
except an interior illuminated, reflective or non-illuminated professional nameplate
having an area of not more than one hundred forty four (144) square inches".
9. A letter in support of this petition, signed by several occupants of the Gramacy
Apartments, was submitted to this Board.
10. Robert and Beth Megatulski, residents of the Gramacy Apartments, spoke in
opposition of this petition.
11. The zoning map for the Town of Agawam, found in the offices of Inspection
Services, shows the subject property to be located in a Business A zone.
12. After consulting with both the Building Inspector and the Engineering Department,
it was concluded that the subject property is zoned Residential A-2 as is stated in
the original Special Use Permit, Case T 1370.
The petioner has been found to be in violation of Conditions T 1, T2 and 73 as set forth under the
Board of Appeals Decision, Case 113 70. However, due to the confusion caused by the zoning
map, the Board members have agreed that to deny this Special Use Permit would not be in the
best interest of either the Town or the petitioner. Now, therefore, the Zoning Board of Appeals,
by a unanimous vote of its three (3) members, hereby grants Mr. John C. Van Amsterdam an
alteration of the previous Board of Appeals Decision, Case ,1 1370 which would allow for the
commercial use of a structure in a Residential A-2 district with certain conditions:
1. The petitioner shall be allowed to lease the use of the subject property to Mr.
Dzral only. Any change other than that allowed by this decision, including the
relocation of the petitioner's rental management business, must come back to this
Board for a public hearing.
2. Any structural renovations to the exterior of the existing building must crime back
to this Board for a public hearing,
3. Preferred Pavroll Plus may not have more than four (4) employed on the premises
at any one time.

4. The existing parking area is subject to Site Plan Review and must receive approval
from the Agawam Planning Board.
5. Preferred Payroll Plus must remove all existing display signs which are in violation
of the regulations as set forth under Section 180-23, Paragraph C.
6. The petitioner has ninety (90) days from the date of this decision to vacate the
rental management business from the Gramacy Apartments. If after said period,
the violation has not been corrected, the petitioner shall be fined to the full extent
allowed under Section 180-16 of the Town's Zoning Ordinances.
7. This Special Use Permit shall remain in effect for three (3) years from the date of
this decision_ The petitioner is required to file a renewal application with this
Board at least sixty (60) days prior to expiration.
8. The petitioner shall record with the Hampden County Registry of Deeds, a"Notice
of Special Use Permit" form, which shall be provided by this Board and which
proof of said filing must be submitted to the Inspector of Buildings.
