8285_SITE PLAN- AGAWAM SOCCER ASSOC. - MAYNARD ST. #�a�s �G{7 waw, 0 ncto �I-r2e-I- v COMMONWEALTH OF MASSACHUSETTS/ CITY OF AGAWAM SPECIAL USE PERMIT FOR MAYNARD STREET- AGAWAM POOL PROPERTY Pursuant to the authority set forth in Chapter 132A, Sections 7 of the General Laws of the Commonwealth of Massachusetts; rules and regulations promulgated thereunder (including 304 CMR 12.00 et se . , and all other power enabling: The Commonwealth of Massachusetts, Department of Conservation and Recreation, Division of State Parks and Recreation, 251 Causeway Street, Boston, Massachusetts (hereinafter "the Department"), does hereby authorize the City of Agawam (hereinafter the "Permittee'), acting through its Mayor, Richard A. Cohen, on behalf of its Recreation Department:, Christopher Sparks, Recreation Director, 760 Cooper Street, Agawam, Mass. 01001 to utilize Department lands surrounding the Agawam Pool, Maynard St., Agawam, Mass. and the filter room/water supply building (hereinafter the "Site") (a map showing exact layout is available and on file with this permit at the Department of Conservation and Recreation with a copy on file with this permit in the Office of the City Clerk] for the development and use-of recreation, including soccer fields. In order to protect the rights and safety of the general public as well as to insure the reasonable exercise of the permitted use, the following conditions and provision shall govern: 1. The Tenn for the use authorized hereby shall be for a period of five (5) years beginning March 12004 and expiring on March 1 2009. No later than 60 days prior to the date of germination of this permit, Permittee may request an extension and renewal of this permit: Requests must be in writing and submitted to the Department(at 251 Causeway St., Boston, MA 02114 attention: Director of Stage Parks and Recreation). Request for extension and renewal shall not be unreasonably withheld. Failure to request renewal within the prescribed time will result in automatic termination of this permit and revocation of all rights authorized herein. In the event the Department fails to extend or renew this permit:, Permittee shall have thirty (30) days from the date of expiration of this permit to vacate the premises. 2. IN CONSIDERATION FOR SUCH USE THE PERMITTEE SHALL: Create or cause to be created soccer fields; maintain the fields; and pay-for all costs associated with its use of the Site and shall operate and make available said soccer fields to the general public on an equal basis as to availability and cost without regard to residency. 3. The Permittee will, at its own expense: a. Work with the National Guard Armory, abutters to the Site, and owners of abutting land that will be used for parking of vehicles and access to the soccer fields; b. Perform or cause to be performed all necessary site work and landscaping; C. install or cause to be installed in-ground irrigation; d. Develop or cause to be developed access road and parking (on abutting lands owned by the City and National Guard). e. Obtain or caused to be obtained all necessary and applicable permits, licenses and approvals. 4. Future utilization, if any, of the Departments (pool) concession and bathhouse buildings will be the subject of a separate, negotiated agreement. 5. Prior notification of not less than 24 hours must be given to the Robinson State park Supervisor, Joe Sarkis, before any major work(ie. Removal of sod, installation of irrigation pipes, etc.) commences at the Site. 6. The Permittee agrees to conform to all laws, rules and regulations of the Division of State Parks and Recreation those of all other state, federal and local agencies. 7. This permit is not transferable and no privilege contained herein may be assigned or sublet to any other person or organization. 8. Permittee's use of the site is not exclusive. Members of the general public may use the site for the purposes authorized herein and shall be subject to the rules and regulations of the Department and of the Permittee. 9. The exercise of this permitted use shall constitute Permittee's acceptance of complete liability and responsibility for Permittee's use of the property and its actions and the actions of its members, guest, invitees, agents and employees upon the site, and an agreement that the Permittee will indemnify and hold harmless the Department against any and all claims that may arise therefrom. Further, the Permittee will not make any claims against the Department for any injury, loss or damage to persons (including bodily injury or death) or property occurring from any cause arising out of the authorized use by the Permittee, its agents or guests, except in the event of willful misconduct or negligence of the Department and/or its agents, employees, or servants. 10. The Commissioner of the Department or the Director of the Division of State Parks and Recreationmay cancel this permit at any time upon ninety (90) days written notice to the Permittee and for any reason which, in his sole opinion and judgment, is in the best interest of the.Department. f 11. The Permittee shall be allowed access to the filter room/water supply building f located on the Site and shall be allowed to use the same to install, house, and operate all meters and irrigation controls for the fields. Donald Galler i S Subject: Site Plan - Agawam Soccer Association - Maynard Street Date: February 12, 2004 4n February 11, 2004, Bill Coughlin from the Agawam Soccer Association came to HQ to see me. He had a new and revised site plan for the Soccer fields on Maynard St. The new site plan has parking spaces that are depicted for reference only. However, Mr. Coughlin agreed to place three Handicapped Parking Spaces in the middle of the gravel parking lot and close to an opening in the fence. This action satisfies my concern over Handicapped Parking spaces. Mr. Coughlin also stated to me that the gate at the driveway into the parking area off Maynard Street would remain locked at all times unless the fields were being utilized. This locked gate will prevent malicious damage to the fields and prohibit people from going into the far back corner of the property at night. Therefore, the site plan by the Agawam Soccer Association to spread gravel over the existing parking area at the fields located by the State Pool on Maynard Street should have no impact on pedestrian or traffic safety. I would recommend from a crime prevention standpoint that this gate not be removed and kept locked except for the usage of these fields. The following comments must be addressed before approval can be given. The site plan depicts improvements on parcels owned by three different owners. I request a letter from a representative of each of the owners acknowledging the proposed improvements and giving permission for the work to proceed. The plan must depict existing and proposed elevations throughout the site. The proposed elevations must be such that stormwater drains properly off the proposed gravel parking area. The plan must include a description of the work that is proposed including the depth of gravel to be placed. The plan must include a line which shows the edge of asphalt pavement near the existing curb cut. Sediment control measures during construction must include 20 to 30 feet of 1" to 2" diameter stone be placed at the existing curb cut to reduce tracking of soils onto the adjacent streets during construction of the improvements. Please add a construction note on the plan which states that measures will be implemented during construction to ensure that soils from the site are not tracked onto adjacent roadways. Page 2 As of Tuesday Jan. 27, 2004 a revised plan addressing these comments has not been received by DPW Engineering.
