2004, Rev. 2-11-05. 1 have the following comments.
1. The layout of vehicle spaces is shown on the revised site plan. Twenty-four display spaces are shown.
An area behind the existing building is designated as employee and customer parking. This does not seem
to be an appropriate location for customer parking, as the spaces are not marked and potentially do not have
adequate access. It is suggested that some of the display spaces should be used for customer parking if they
are in appropriate locations. One handicapped parking space is shown. Appropriate pavement markings
should be shown on the plan.
2. Curb cuts for the one-way in and one-way out direction, as shown on the revised plan, should be signed
and/or arrow-One Way pavement markings applied because the curb cut is only 12'wide.

The Agawam Board of Appeals conducted a public hearing on February 14, 2005, at the Library
Conference Room,Agawam Public Library, 750 Cooper Street, Agawam, MA, for all parties
interested in the appeal of Daniel C. Rising, Sr. who is seeking a Special Permit in accordance
with Section 180-7, Paragraph B2 of the Zoning Ordinances, which would allow for the
expansion of a non-conforming business at the premises identified as 521 River Road.
After the public hearing,and after a thorough review of the facts presented,the Agawam Board
of Appeals made the following findings:
l. The subject property is located in an area of Town zoned Business A.
2. The petitioner owns a used car business on the subject property.
3. The petitioner wishes to increase the number of cars to be sold on the subject property.
4. Section 180-44 (D) states `Body and fender work and the painting or selling of cars in or
out of doors is prohibited."
5. The petitioner's used car business has been in existence prior to the enactment of TOR
2004-7 which prohibits the selling of cars in a Business A district.
5. Section 180-7 (B) states a nonconforming use may be"altered or enlarged in that use, but
only after the granting of a permit thereof by the Board of Appeals; thus the request for
relief.
7. The deed presented includes an easement right to the"triangular parcel of land lying
southerly"to the subject property.
8. According to the rules and regulations of the licensing authority, 42 vehicles are allowed
on the subject property
9. There was no opposition expressed at the hearing nor received in writing by this Board.
10. The subject property is an appropriate location for such a use.
11. The proposed use as developed will not adversely affect the health, safety or property
values of the neighborhood.
12. There will be no nuisance or potential hazard to vehicle or pedestrian safety.
13. Adequate and appropriate facilities and controls will be provided for the proper and safe
operation of the proposed use.
14. The proposed use is not considered so objectionable or obnoxious that the proposed use
would be against the public interest or detrimental or injurious to the charter of the
neighborhood.

Based on its findings, the Board is of the opinion that the requested relief is within the authority
of the Board of Appeals to grant a Special Permit in accordance with Section 180-7 of the Zoning
Ordinances.
Therefore, by a unanimous vote of its three members, the Zoning Board of Appeals hereby grants
the petitioner a Special Permit to allow for the expansion of a nonconforming use subject to the
following conditions:
1. The subject property is to be developed according to the plans submitted entitled"Daniel
C. Rising, Sr., last revision dated February 11, 2005, by Marc Shute, Professional Land
Surveyor of D.L. Bean, Inc."and signed by the members of this Board. This includes
revisions made at the February 14, 2005 hearing and noted on the plan.
2. The petitioner is allowed to display for sale up to twenty-five (25) automobiles.
3. A sufficient number of arborvitae must be planted between the subject property and Lot
#4 (as shown on plan) so as when fully mature will create an effective screening of the
subject property from Lot#4. This planting must occur within one (1) year from the date
of this decision.
4. The existing arborvitae to the rear must be properly maintained to continue its use as a
screening device of the subject property from the abutting properties.
5. Any changes to this plan must come back before this Board for approval.
b. All state and local building requirements must be met.
7. The petitioner shall record with the Hampden County Registry of Deeds a"Notice of
Special Permit" form, which shall be provided by this Board and proof of said filing must
be submitted to this Board and to the Inspector of Buildings.
8. This special Permit shall become null and void if construction does not commence within
two (2)years from the date of this decision.

2. PRELIMINARY PLAN - Capua Estates - Mill Street
The applicant's representative requested that this item be tabled to the next meeting.

3. SITE PLAN - D&J Auto Sales - River Road

been submitted which shows the layout of the parking spaces on the site(twenty-five spaces are
being requested). Mr. Ward asked where the customer parking is located. Mr. Rising stated is
located at the rear of the building with the two employee parking spaces. Attorney Bonavita
stated the plan shows parking area rather than exact number of spaces per the Zoning Board of
Appeals. Mr. Hopkins explained that the used car lot requirements call for showing the parking
layout for the number of spaces being applied for. There was discussion regarding the location
of the customer parking. Mr. Rising suggested placing a"customer parking" sign on the building
to alert the customers. The members were in agreement with that.
Motion was made by Mr. Ward and seconded by Mr. Zini to approve the Site Plan for D&J Auto
Sales on River Road with the condition that a"customer parking" sign be placed on the side of
the building where the current paved area is.

4, SITE PLAN - Cirillo - Main Street
Mr. Cirillo's representative requested that this item be tabled.

5. SITE PLAN - Walking& Fitness Trail - Borgatti Field
Andrew and Erik Jensen are Agawam residents who are working on their Eagle Scout project.
The have chose to construct a 660' long walking/fitness trail at Borgatti Field. Andrew Jensen
explained that the trail will consist of 3" to 4" of stone on the trail and will have various fitness
stations located on it. He stated that since it is across from the entrance to the beginning of the
new bike path on River Road, people could use this area as a warm up before or after using the
bike path. The Engineering Department submitted comments which Mr. Jensen stated they will
address.
Motion was made by Ms. Baldwin and seconded by Mr. Ward to approve the Site Plan for the
Walking/Fitness Trail at Borgatti Field.

7. STREET ACCEPTANCE PLAN - High Meadow III
The Engineering Department has reviewed and approved the Street Acceptance Plan that was
submitted for High Meadow III.
Motion was made by Mr. Morassi and seconded by Mr. Ward to approve the Street Acceptance
Plan for High Meadow III.

The meeting was called to order by Mr. Hopkins at 6:35 PM.

3. SITE PLAN - D&J Auto Sales - River Road
Mark Shute of D.L. Bean, Inc. presented this Site Plan. He explained that the applicant would
like to remove an existing island and close an existing curb cut on his property. Additional
vegetation is proposed to be installed.
Motion was made by Mr. Morassi and seconded by Ms. Baldwin to table the Site Plan for D&J
Auto Sales on River Road at the request of the applicant.

4. SITE PLAN - Six Flags New England - General Site Alterations
Chuck Davis of Six Flags New England was in attendance along with Jessica Bates of Vanasse
Hangen Brustlin. Ms. Bates began by stating that a plan for the removal of arborvitae at the Park
will come in a later date. She stated that this evening they are seeking site plan approval for three
proposed projects. The first is the expansion of the existing American Hotdog Stand. A 22' x 18'
addition to the north side of the existing building is proposed. The second is the relocation of an
elliptical shaped gazebo which is a self-supporting structure and does not require foundations for
support. The third is the installation of a new arcade-type game in the vicinity of where the
gazebo was located. The structure will be 18' x 30' in size and will house various arcade-type
attractions. There will be no impact to stormwater runoff associated with these three projects.
Motion was made by Mr. Morassi and seconded by Mr. Zini to approve the General Site
Alterations for Six Flags New England as presented this evening conditional upon the Agawam
Fire Department comments being addressed.

5. PRELIMINARY PLAN - Poplar Street - Poplar Development LLC
Mark Reed of Heritage Surveys and Tom Lucia of Poplar Development LLC were in attendance
to present this preliminary plan which shows a cul-de-sac approximately 500' in length and the
creation of seven single family lots. The parcel contains approximately 4.49 acres of land. No
waiver requests were submitted, however, the plan shows only one sidewalk. The Engineering
Department submitted comments to the Board dated January 26, 2005. There was discussion
regarding how the street length is measured and what waivers would be requested, if any. Mr.
Reed stated he would meet with the Town Engineer prior to the next meeting.
Mike Mendrala- DePalma Street asked what the purpose of the detention basin is. Mr. Reed
explained that it is designed to control runoff from the site.
Motion was made by Ms. Baldwin and seconded by Mr. Morassi to table the Preliminary Plan for
Poplar Street to the next meeting.

6. CONSTRUCTION PLANS - James Avenue- Calabrese
1 Mr. Calabrese submitted a request for the following waivers on his lot on James Avenue:
sidewalks, treebelts, curbing and cul-de-sac. The members had discussed these construction

plans at their previous meeting and agreed that action would be needed on any waivers.
Motion was made by Mr. Zini and seconded by Mr. Morassi to approve the following waivers for
the Construction Plans for James Avenue: sidewalks, treebelts, curbing and cul-de-sac.

7. BOND SETTING - James Avenue
Motion was made by Ms. Baldwin and seconded by Mr. Morassi to sent the bond for James
Avenue at $20,000 as recommended by the Engineering Department.

and include the add-on's.

10. CHAPTER 61 A - South West Street - Boglisch
Attorney Simon Brightenti was in attendance representing the Boglisch's. The Boglisch's have
received an offer on their property on South West Street which is under Chapter 61 A and
Attorney Brighenti has notified the Town as required.
Motion was made by Mr. Zini and seconded by Mr. Morassi to send a positive recommendation
to the Town Council to exercise the Town's right of first refusal with regard to the purchase of
the Boglisch property on South West Street.

9. FORM A - Suffield Street - HRCI Mass. Properties
